We have printed the “Guidelines for Risk Management ofReal Estate Loans of Commercial Banks” and hereby distribute them to you. Please comply with and implement them.
 
现将《商业银行房地产贷款风险管理指引》印发给你们,请遵照执行。

All banking regulatory bureaus are requested to forward the present Notice to all urban commercial banks, urban credit cooperatives, rural commercial banks, rural cooperative banks, county-level united offices of rural credit cooperatives and foreign capital banks within their respective jurisdictions.
 
请各银监局将本通知转发至辖内各城市商业银行、城市信用社,农村商业银行、农村合作银行、农村信用社县级联社,外资银行。

Chapter I General Provisions 

第一章 总则


 
Article 1 The present Guidelines are formulated in accordance with the relevant banking regulatory laws and regulations as well as the requirements on prudent supervision of banks for the purpose of enhancing the capacities of commercial banks in risk management of real estate loans.   第一条 为提高商业银行房地产贷款的风险管理能力,根据有关银行监管法律法规和银行审慎监管要求,制定本指引。

 
Article 2 The term “real estate loans” as mentioned in the present Guidelines shall refer to the loans relevant to the development, business operation and consumption of house properties or land properties, mainly including land reservation loans, real estate development loans, home loans for individuals and commercial housing loans, etc.   第二条 本指引所称房地产贷款是指与房产或地产的开发、经营、消费活动有关的贷款。主要包括土地储备贷款、房地产开发贷款、个人住房贷款、商业用房贷款等。

The term “land reservation loans” as mentioned in the present Guidelines shall refer to the loans granted to the borrowers and used for the purchase of land or primary development and rehabilitation of land. The borrowers of land reservation loans shall be only limited to the institutions responsible for the first-class land development.
 
本指引所称土地储备贷款是指向借款人发放的用于土地收购及土地前期开发、整理的贷款。土地储备贷款的借款人仅限于负责土地一级开发的机构。

The term “real estate development loans” shall refer to the loans granted to the borrowers and used to develop and build real estate projects sold or leased in the market.
 
房地产开发贷款是指向借款人发放的用于开发、建造向市场销售、出租等用途的房地产项目的贷款。

The term “home loans for individuals” shall refer to the loans granted to the borrowers and used to purchase, build and overhaul various types of dwelling houses.
 
个人住房贷款是指向借款人发放的用于购买、建造和大修理各类型住房的贷款。

The term “commercial housing loans” shall refer to the loans granted to the borrowers and used to purchase, build and overhaul various types of house properties for commercial use.
 
商业用房贷款是指向借款人发放的用于购置、建造和大修理以商业为用途的各类型房产的贷款。

 
Chapter II Risk Control 

第二章 风险控制


 
Article 3 A commercial bank shall set forth the risk policies on real estate loans and the standards for operation and check of different types of loans, clarify the standards for examination and approval of different types of loans, the operational procedures, risk control, after-loan management, and selection of intermediary institutions, etc.   第三条 商业银行应建立房地产贷款的风险政策及其不同类型贷款的操作审核标准,明确不同类型贷款的审批标准、操作程序、风险控制、贷后管理以及中介机构的选择等内容。

A commercial bank shall, when handling real estate business, pay attention to the market risks, legal risks, operative risks, etc. of real estate loans, and establish corresponding rules on risk management and internal control.
 
商业银行办理房地产业务,要对房地产贷款市场风险、法律风险、操作风险等予以关注,建立相应的风险管理及内控制度。

 
Article 4 A commercial bank shall establish corresponding supervision and control workflow, guarantee that the employees abide by the abovementioned risk policies, and standards for operation and check of different types of loans.   第四条 商业银行应建立相应的监控流程,确保工作人员遵守上述风险政策及不同类型贷款的操作审核标准。

 
Article 5 A commercial bank shall, according to the professional division of the work on real estate loans, formulate separate occupational ethics and code of conduct for the acceptance, check, examination, approval of applications, and post-loan management, etc., as well as clarify corresponding powers, duties and assessment standards.   第五条 商业银行应根据房地产贷款的专业化分工,按照申请的受理、审核、审批、贷后管理等环节分别制定各自的职业道德标准和行为规范,明确相应的权责和考核标准。

 
Article 6 A commercial bank shall make annual special audit on the real estate loans of its internal functionary departments and its branches, and form an audit report containing the following contents:   第六条 商业银行应对内部职能部门和分支机构房地产贷款进行年度专项稽核,并形成稽核报告。稽核报告应包括以下内容:

 
(1) the overall situation on the loans granted by the internal functionary departments and the branches in the last year; (一)内部职能部门和分支机构上年度发放贷款的整体情况;

 
(2) the main problems found in the audit and the settlement opinions; and (二)稽核中发现的主要问题及处理意见;

 
(3) the rectification made by the internal functionary departments and the branches on the basis of the propositions in the last audit report. (三)内部职能部门和分支机构对上次稽核报告中所提建议的整改情况。

 
Article 7 A commercial bank shall, for the sake of selecting an intermediary institution that intervenes with real estate loans, attach importance to the assessment of its enterprise eligibility, prestige in the industry, and work operation procedures, etc., select the best one and conclude liability clauses with it. There shall be clear compensation measures on the banking business losses caused by the intermediary institution.   第七条 商业银行对于介入房地产贷款的中介机构的选择,应着重于其企业资质、业内声誉和业务操作程序等方面的考核,择优选用,并签订责任条款,对于因中介机构的原因造成的银行业务损失应有明确的赔偿措施。

 
Article 8 A commercial bank shall establish a risk warning and valuation system for the real estate industry, and pay attention to the market risks of the real estate industry.   第八条 商业银行应建立房地产行业风险预警和评估体系,对房地产行业市场风险予以关注。

 
Article 9 A commercial bank shall establish a sound platform for statistical analysis of real estate loans, make detailed records on the granted loans, and timely straighten out and analyze the relevant information, ensure the accuracy, authenticity and entirety of the information on loans, so as to effectively supervise and control the overall situation of the loans.   第九条 商业银行应建立完善的房地产贷款统计分析平台,对所发放贷款的情况进行详细记录,并及时对相关信息进行整理分析,保证贷款信息的准确性、真实性、完整性,以有效监控整体贷款状况。

 
Article 10 A commercial bank shall register the detailed information on real estate loans sum by sum, so as to guarantee that such information is accurately recorded into the statistical or credit registration and inquiry system of the banking regulatory department and that of other relevant department, to be beneficial for the information exchange between all commercial banks and between commercial banks and social credit institutions, and to help all banks to fully inquire about the overall information on the borrowers.   第十条 商业银行应逐笔登记房地产贷款详细情况,以确保该信息可以准确录入银行监管部门及其他相关部门的统计或信贷登记咨询系统,以利于各商业银行之间、商业银行与社会征信机构之间的信息沟通,使各行充分了解借款人的整体情况。

 
Chapter III Risk Management of Land Reservation Loans 

第三章 土地储备贷款的风险管理


 
Article 11 A commercial bank may not grant land reservation loans to any borrower whose capital is not fully contributed or is seriously insufficient or whose management is irregular.   第十一条 商业银行对资本金没有到位或资本金严重不足、经营管理不规范的借款人不得发放土地储备贷款。

 
Article 12 A commercial bank shall, when granting land reservation loans, make survey and analysis on the overall information of the land, including the nature, ownership and mapping of the land, the land contract restrictions, and whether the uses of the land in the overall urban planning conform to the intended development plan.   第十二条 商业银行发放土地储备贷款时,应对土地的整体情况调查分析,包括该土地的性质、权属关系、测绘情况、土地契约限制、在城市整体综合规划中的用途与预计开发计划是否相符等。

 
Article 13 A commercial bank shall pay close attention to the polices and researches of the relevant government departments and other relevant institutions on the land economic environment, the growth of land market, the future uses of land, and relevant planning and plans, etc., timely grasp the situation on land value, and avoid the loan risks caused from unreal increment of land value or other facts.   第十三条 商业银行应密切关注政府有关部门及相关机构对土地经济环境、土地市场发育状况、土地的未来用途及有关规划、计划等方面的政策和研究,实时掌握土地价值状况,避免由于土地价值虚增或其他情况而导致的贷款风险。

 
Article 14 A commercial bank shall establish a special account of funds of land reservation institutions for the granted land reservation loans, and strengthen its supervision and control over the proceeds from land business operation.   第十四条 商业银行应对发放的土地储备贷款设立土地储备机构资金专户,加强对土地经营收益的监控。

 
Chapter IV Risk Management of Real Estate Development Loans 

第四章 房地产开发贷款的风险管理


 
Article 15 A commercial bank shall not grant any form of loans to a project owner that has not obtained the state-owned land use certificate, the construction land planning license, the construction project planning license, or the construction project undertaking license.   第十五条 商业银行对未取得国有土地使用证、建设用地规划许可证、建设工程规划许可证、建筑工程施工许可证的项目不得发放任何形式的贷款。

 
Article 16 A commercial bank shall require a real estate development enterprise applying for loans that the proportion of its development project capital shall not be lower than 35%.
