| For the purposes of further implementing the decisions and arrangements of the CPC Central Committee and the State Council on strengthening the protection of intellectual property rights, fulfilling the Opinions on Strengthening the Protection of Intellectual Property Rights, and enhancing the intellectual property protection system, the Guiding Opinions on Further Strengthening Assistance in Intellectual Property Protection have been developed in accordance with the Regulation on Optimizing the Business Environment, and are hereby issued for your earnest organization and implementation according to the actual conditions. | Guiding Opinions on Further Strengthening Assistance in Intellectual Property Protection | | 关于进一步加强知识产权维权援助工作的指导意见 |
| Since the 18th CPC National Congress, there has been rapid growth in the area of assistance in intellectual property protection, with increasingly larger coverage and higher service quality, thereby effectively protecting the lawful rights and interests of the public and entities involved in innovation. Meanwhile, we have seen stronger and more diverse demands for intellectual property protection from the public and innovation-driven entities, as well as higher requirements for assistance in the protection of intellectual property rights (‘IPR'). For the purposes of further implementing the decisions and arrangements of the CPC Central Committee and the State Council on strengthening the protection of intellectual property, and fulfilling the Opinions on Strengthening the Protection of Intellectual Property Rights issued by the CPC Central Committee and the State Council, in accordance with the Regulation on Optimizing the Business Environment, the Opinions on further strengthening assistance in intellectual property protection are hereby offered as follows: | | 党的十八大以来，知识产权维权援助工作快速发展，覆盖面逐步扩大，服务水平不断提高，有效维护了社会公众和创新主体的合法权益。同时，社会公众和创新主体对知识产权保护的维权需求更加强烈、更趋多样，对知识产权维权援助工作提出更高要求。为深入贯彻党中央、国务院关于强化知识产权保护的决策部署，落实中央办公厅、国务院办公厅《关于强化知识产权保护的意见》，根据《优化营商环境条例》规定，现就进一步加强知识产权维权援助工作提出如下意见。 |
| I. General requirements | | 一、总体要求 |
| 1. Guiding ideology: By upholding Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era as guidance, efforts shall be made to comprehensively implement the underlying principles of the 19th CPC National Congress and the 2nd, 3rd and 4th Plenary Sessions of the 19th CPC Central Committee, and profoundly fulfill the decisions and arrangements of the CPC Central Committee and the State Council on strengthening the protection of intellectual property. Focusing on problems and demands, efforts shall also be made to enhance working systems and mechanisms, working standards, cultivation of talented personnel, and support and guarantees for assistance in intellectual property protection, improve the systems for IPR protection assistance, and increase the quality of assistance services. The intellectual property protection system shall be continuously upgraded and strengthened, so as to serve high-quality economic development, and support the creation of a better pro-business environment. | | （一）指导思想。坚持以习近平新时代中国特色社会主义思想为指导，全面贯彻党的十九大和十九届二中、三中、四中全会精神，深入落实党中央、国务院关于强化知识产权保护的决策部署，坚持问题和需求导向，着力加强知识产权维权援助工作体系、工作机制、工作规范、人才队伍建设和支撑保障，着力完善维权援助制度，提高维权援助服务水平，不断完善和加强知识产权保护体系建设，服务经济高质量发展，促进优化营商环境。 |

| Continuing the demand-oriented approach and serving the national strategy: In order to continue serving the national strategic development, the layout of services in key areas and major industries shall be optimized, and the coordination between demands and resources shall be strengthened. The service network for IPR protection assistance shall be extended to provide more assistance to enterprises “going global”, private enterprises, micro, small and medium-sized enterprises and self-employed traders in the protection of intellectual property. | | 坚持需求导向，服务国家战略。坚持服务国家战略发展方向，加强重点区域、重点产业服务布局，强化需求和资源整合对接，延伸维权援助服务网络，加大对“走出去”企业、民营企业、中小微企业、个体工商户等重点对象的维权援助。 |
| Pursuing innovations and strengthening public services: The quality of public services for IPR protection assistance shall be improved by placing more focus on innovations in management, modes, technologies and services, and stepping up the development of a team of talented personnel, service platforms and information technologies. The intellectual property protection system shall be enhanced to ensure equal access to assistance services for all parties. Brands of assistance services that satisfy the needs of the public shall be created. | | 坚持探索创新，强化公益服务。加强管理创新、模式创新、技术创新和服务创新，加强人才队伍、服务平台和信息化建设，切实提高维权援助公益服务水平，加强体系建设，促进维权援助服务均等可及，打造社会满意的维权援助服务品牌。 |
| Supporting collaboration and co-building and promoting cooperation and sharing: The role of IPR protection assistance agencies in compiling governments, universities, scientific research institutes and other resources shall be fully leveraged. Industrial associations and other social organizations shall play a role in providing channels for exchanges so that all relevant parties can cooperate with each other and share valuable resources. As a result, the resources for IPR protection assistance can be allocated and utilized in a more efficient manner. | | 坚持协同共建，促进合作共享。充分发挥维权援助机构桥梁纽带作用，汇聚政府部门、高等院校、科研院所等多方优质资源，发挥行业协会等社会组织渠道作用，形成上下联动、横向协同、合作共享的运行机制，促进维权援助资源优化配置、高效运用。 |
| 3. Working objectives: By 2025, the scope of areas which are covered by assistance in intellectual property protection will be generally balanced, the quality of services for IPR protection assistance will meet needs, the working mechanism and service quality will be notably improved, support and guarantees for assistance in intellectual property protection will be strengthened, the team of talented personnel will be stable and competent, and the level of satisfaction regarding public services will be significantly elevated. | | （三）工作目标。力争到2025年，知识产权维权援助覆盖范围基本合理，服务水平适应需求，工作机制得到健全，服务质量有效提升，支撑保障有力加强，机构队伍稳定壮大，社会服务满意度显著提高。 |
