如何适用国务院《食盐专营办法》第二十五条规定与
《河南省盐业管理条例》第三十条第一款规定问题的答复
（2003年4月29日法行[2000]36号）

河南省高级人民法院：
你院豫高法行请〔2000〕4号《关于〈河南省盐业管理条例〉第三十条第一款与国务院〈食盐专营办法〉第二十五条规定是否一致问题的请示》收悉。经研究，答复如下：
根据《中华人民共和国行政处罚法》第十一条第二款关于“法律、行政法规对违法行为已经作出行政处罚规定，地方性法规需要作出具体规定的，必须在法律、行政法规规定的给予行政处罚的行为、种类和幅度的范围内规定”的规定，《河南省盐业管理条例》第三十条第一款关于对承运人罚款基准为“盐产品价值”及对货主及承运人罚款幅度为“1倍以上3倍以下”的规定，与国务院《食盐专营办法》第二十五条规定不一致。人民法院在审理有关行政案件时，应根据《中华人民共和国立法法》第六十四条第二款、第七十九条第二款规定的精神进行选择适用。
