Guiding Opinions on Doing a Good Job in the Trial of Labor Dispute Cases under the Current Situation
 
关于当前形势下做好劳动争议纠纷案件审判工作的指导意见

In the wake of the turmoil of the international financial market and the recession of the world economy, the number of various labor dispute cases triggered by enterprises' operational difficulties, losses, wage arrears and even shutdown has greatly increased, which brings new challenges to the civil trial work. To give full play to the functional role of the people's courts in serving the economic and social development and building a harmonious and stable society, actively cope with the current macroeconomic changes and provide more powerful judicial safeguards for the fundamental goal of “maintaining growth, maintaining the people's livelihood and maintaining stability”, we hereby put forward the following opinions for the people's courts to do a good job in the trial of labor dispute cases under the current situation:
 
受国际金融市场动荡和世界经济衰退的影响,当前,因企业经营困难、亏损、欠薪和关闭等原因引发的各种劳动争议纠纷案件大幅攀升,给民事审判工作带来新的挑战。为充分发挥人民法院服务经济社会发展与社会和谐稳定的职能作用,积极应对宏观经济形势变化,为“保增长、保民生、保稳定”的工作大局提供更加有力的司法保障,现就人民法院在当前形势下做好劳动争议纠纷案件审判工作,提出以下意见。

 
1. Endeavoring to attach equal importance to the protection of legitimate rights and interests of employees and the survival and development of employers. The contradictions existing in the labor relationships of the socialist China is essentially non-antagonistic. Both parties to the contradictions are a unity of opposites and an interest community, as they have a high degree of coherence in fundamental interests and relative differences in specific interests. In the hearing of labor dispute cases, we shall not only protect the legitimate rights and interests of employees but also promote the survival and development of enterprises so as to create a win-win situation, which is of great significance for well handling labor dispute cases under the current situation.   1、努力做到保障劳动者合法权益与维护用人单位的生存发展并重。我国社会主义条件下的劳动关系矛盾本质上是非对抗性的,矛盾双方是对立统一体和利益共同体,具有根本利益的高度一致性和具体利益的相对差异性。在审理劳动争议纠纷案件时,既要依法维护劳动者合法权益,又要促进企业的生存发展,努力做到双方互利共赢,对于在当前形势下妥善处理好劳动争议纠纷案件具有十分重要的意义。

 
2. Maintaining the harmony and stability of labor relationships. In hearing labor dispute cases, we shall do our best to sustain the effectiveness of employment contracts, avoid solving labor disputes simply by rescinding employment contracts, encourage enterprises to voluntarily fulfill obligations and undertake social responsibilities in a well-regulated way, provide guidance for employees to understand the reasonable countermeasures taken by enterprises for overcoming economic difficulties, and guide both employees and enterprise in stabilizing their labor relationships by taking effective measures such as shortening working hours, providing rotation training, taking temporary leaves and negotiating salaries and wages.   2、积极促进劳动关系的和谐稳定。在审理劳动争议纠纷案件时,要尽量维护劳动合同的效力,慎重简单使用解除劳动合同的方法来解决劳动争议纠纷案件。既要鼓励、规范企业自觉履行义务、承担社会责任,又要倡导职工理解企业确因经济困难所采取的合理应对行为。要积极引导职工与企业协商通过缩短工时、轮岗培训、暂时放假、协商薪酬等多种措施,有效稳定劳动关系。

 
3. Correctly understanding laws, regulations and related state policies. In hearing labor dispute cases, we shall not only strictly observe laws and regulations, but also fully consider a range of guidelines and policies promulgated by the state for coping with the international finance crisis; comprehensively and correctly understand the legislative intents and principles of the Employment Contract Law and the Law on the Mediation and Arbitration of Labor Disputes, and give full play to the functional role of the judicial work of the people's courts in serving the overall situation and responding to crisis; and handle the labor issues left from history according to the then-effective laws and regulations as well as state guidelines and policies.   3、准确把握法律法规与国家相关政策。在审理劳动争议纠纷案件时,不仅要严格执行法律、法规,还要充分考虑国家为应对国际金融危机出台的一系列方针政策。要全面、正确理解劳动合同法劳动争议调解仲裁法的立法原意和宗旨,充分发挥人民法院审判工作服务大局、应对危机的职能作用。对于历史遗留的劳动问题,要按照当时的法律法规及国家的方针政策处理。

 
4. Giving full play to the functional role of mediation in litigation. In the whole process of hearing labor dispute cases, we shall seek mediation and conciliation whenever it is possible to find the balancing point of the interests of both parties and make sure that disputes are solved as the cases are closed. At the same time, we shall pay attention to the legitimacy, flexibility and operability of the mediation procedure and try to eliminate the contradictions and hidden problems in labor relationships, so as to give more effective play to the functional role of mediation in litigation and realize the unity of the legal effects and social effects in the handling of cases.

   4、充分发挥诉讼调解的功能作用。在审理劳动争议纠纷案件的全过程中,要尽可能采取调解、和解方法,寻找各方利益平衡点,做到案结事了。同时还要注意调解程序的正当性、灵活性和可操作性,努力化解劳动关系的矛盾和隐患,使诉讼调解的职能作用得到更加有效的发挥,力争案件处理达到法律效果与社会效果的统一。
