| Chapter I General Provisions | | 第一章 总则 |

| Article 1 These Provisions are formulated according to the Criminal Law, the Criminal Procedure Law and other relevant provisions for the purpose of regulating the seizure and freeze of money and property by the people's procuratorates, enhancing the law enforcement level and the case handling quality and protecting the lawful rights and interests of citizens, legal persons and other organizations. | | 第一条 为了规范人民检察院扣押、冻结款物工作，提高执法水平和办案质量，保护公民、法人和其他组织合法权益，根据刑法、刑事诉讼法及其他有关规定，制定本规定。 |

| Article 2 The “seizure and freeze of money and property” as mentioned in these Provisions refers to the illegal proceeds, other money and property and tools for criminal purpose that may be related to the crime and the illegally held contrabands as seized and frozen by the people's procuratorates in exercising their prosecutorial functions according to law. | | 第二条 本规定所称扣押、冻结的款物，是指人民检察院在依法行使检察职权过程中扣押、冻结的违法所得、其他可能与犯罪有关的款物、作案工具、非法持有的违禁品等。 |
The properties and their fruits obtained by criminal suspects and defendants from committing crimes are illegal proceeds. | |
犯罪嫌疑人、被告人实施违法犯罪行为所取得的财物及其孳息属于违法所得。 |

| Article 3 All the money and property illegally obtained shall be recovered, or the compensation shall be made by order. The lawful property of any victim shall be returned to the victim without delay. The contrabands and the money and property for criminal purpose shall be seized, frozen and disposed according to law. | | 第三条 违法所得的一切财物，应当予以追缴或者责令退赔。对被害人的合法财产，应当依法及时返还。违禁品和供犯罪所用的财物，应当予以扣押、冻结，并依法处理。 |
The victims shall include natural persons, legal persons and other organizations. | |
被害人包括自然人、法人和其他组织。 |

| Article 4 The people's procuratorate shall seize, freeze, keep and dispose the money and property involved in the cases in strict accordance with law, and shall not seize or freeze the lawful property irrelevant to the cases in question. | | 第四条 人民检察院扣押、冻结以及保管、处理涉案款物，必须严格依法进行。严禁扣押、冻结与案件无关的合法财产。 |
It is rigorously prohibited to seize or freeze the money and property before a case is put on file. Where any individual or entity carries the money or property involved in the case when he/it confesses his/its crime to the people's procuratorate before the case is put on file, the people's procuratorate may accept the money or property in advance and issue a receipt to the aforesaid individual or entity, and then decide whether to seize or freeze the money or property in light of the conditions on whether to put the case on file. | |
严禁在立案之前扣押、冻结款物。个人或者单位在立案之前向人民检察院自首时携带涉案款物的，人民检察院可以先行接受，并向自首人开具收据，根据立案情况决定是否扣押、冻结。 |

| Article 5 The seizure or freeze of money and property shall be separated from the keeping thereof, and the accounts opened for them shall be in line with the actual situation. | | 第五条 实行扣押、冻结款物与保管款物相分离的原则，帐实必须相符。 |
| |
|
| Article 6 When the people's procuratorate seizes or freezes the money and property, the principle of mutual restrictions between the case handling department and the money and property keeping department shall be implemented. | | 第六条 人民检察院扣押、冻结款物，应当实行办案部门和保管部门相互制约的原则。 |
| |
|
| Article 7 The seizure and freeze of money and property by the people's procuratorates shall be subject to the supervision of the people's overseers according to the relevant provisions. | | 第七条 人民检察院扣押、冻结款物工作，应当依照有关规定接受人民监督员的监督。 |
| |
|
| Article 8 The relevant confidentiality provisions shall be strictly followed for the seizure and freeze of the money and property involving state secrets, business secrets or personal privacy. | | 第八条 扣押、冻结涉及国家秘密、商业秘密、个人隐私的款物，应当严格遵守有关保密规定。 |
| |
|
| Chapter II Procedures for the Seizure and Freeze of Money and Property | | 第二章 扣押、冻结款物的程序 |
| |
|
| Article 9 The statutory formalities shall be handled for the seizure or freeze of money and property involved. | | 第九条 扣押、冻结涉案款物，应当履行法律手续。 |
The seizure or freeze of money and property involved shall be subject to the approval of the chief procurator, and be conducted by two or more persons handling the case. | |
扣押、冻结涉案款物，应当报经检察长批准，由两名以上办案人员进行。 |
Various articles found during the course of search, detention, arrest or investigation at the crime scene that can be used to prove the guiltiness or innocence of a criminal suspect, the illegally held contrabands or the money and property that may be illegally obtained shall be seized. If the aforesaid money or property is not related to the case, it shall not be seized. If whether the aforesaid money or property is related to the case can not be found immediately, it can be seized at first and then be examined and handled according to Article 13 of these Provisions. | |
在搜查、拘留、逮捕、现场勘查过程中发现的可用以证明犯罪嫌疑人有罪或者无罪的各种物品，非法持有的违禁品，可能属于违法所得的款项，应当扣押；与案件无关的，不得扣押。不能立即查明是否与案件有关的可疑款物，可以先行扣押并按照本规定第十三条审查处理。 |
In case the articles carried by a criminal suspect or defendant at the time of entry of appearance need to be seized, they shall be seized according to the provisions in the preceding Paragraph. With respect to the personal articles irrelevant to the case, they shall be registered item by item, and be transferred to the criminal suspect or defendant or returned to the family member thereof. | |
对于犯罪嫌疑人、被告人到案时随身携带的物品需要扣押的，依照前款规定办理。对于与案件无关的个人用品，逐件登记，随人移交，或者退还家属。 |

| Article 10 With respect to the seized money and property, the procurators shall, together with the witnesses on the scene and the holder of the money and property, check the amount and number thereof, issue a list of the seized money and property in quadruplicate on the spot, on which the names, models, specifications, quantity, quality, color, degree of depreciation, package and other main characteristics of the seized money and property shall be indicated and the procurators, the witnesses and the holder shall affix their signatures or seals. If the owner refuses to affix his signature, seal or is not on the scene, it shall be indicated on the aforesaid list. | | 第十条 对于扣押的款物，检察人员应当会同在场见证人和被扣押款物持有人查点清楚，当场开列扣押清单一式四份，注明扣押物品的名称、型号、规格、数量、质量、颜色、新旧程度、包装等主要特征，由检察人员、见证人和持有人签名或者盖章。持有人拒绝签名、盖章或者不在场的，应当在清单上注明。 |

| Article 11 With respect to the articles that shall be seized but can not be picked up conveniently, they shall be sealed up for keeping at the original place after being photographed or videotaped, and a list of the seized (sealed) articles shall be issued in quadruplicate, on which the photographing or videotaping as conducted shall be indicated and the procurators, the witnesses and the owner shall affix their signatures or seals. If the owner refuses to affix his signature, seal or is not on the scene, it shall be indicated on the aforesaid list. | | 第十一条 对于应当扣押但不便提取的物品，经拍照或者录像后原地封存，并且单独开具扣押（原地封存）清单一式四份，注明已经拍照或者录像，由检察人员、见证人和持有人签名或者盖章。持有人拒绝签名、盖章或者不在场的，应当在清单上注明。 |

| Article 12 The following money and property seized or frozen by the case handling department shall be correspondingly handled: | | 第十二条 办案部门扣押、冻结下列款物，应当进行相应的处理： |
| |
|
| (1)With respect to the seized foreign currency, gold, silver, jewelry, cultural relics, valuable calligraphy and painting and other valuable articles, the validity of which is not easy to be distinguished, they shall be sealed up for keeping after being photographed or videotaped, and the procurators, the witnesses and the holder of the seized articles shall affix their signatures or seals on the seal-up documents, and a qualified department shall be timely entrusted to issue an appraisal report according to the requirements for handling the case. The witness or the holder shall be on the scene at the time of removing the seal, and shall also affix his name or seal; | | （一）扣押外币、金银珠宝、文物、名贵字画以及其他不易辨别真伪的贵重物品，应当在拍照或者录像后当场密封，由检察人员、见证人和被扣押物品持有人在密封材料上签名或者盖章，根据办案需要及时委托具有资质的部门出具鉴定报告。启封时应当有见证人或者持有人在场并且签名或者盖章； |

| (2)With respect to the deposit books, credit cards, securities and other payment vouchers as well as the cash that can prove the details of a case, the features, serial numbers, types, par values, number of sheets and the amount thereof shall be indicated, and they shall be sealed up for keeping as the real objects, and the corresponding accounts shall be frozen; | | （二）对存折、信用卡、有价证券等支付凭证和具有一定特征能够证明案情的现金，应当注明特征、编号、种类、面值、张数、金额等，作为实物进行封存，并且冻结相应的帐户； |

(3)With respect to the audio tapes, video tapes, discs, compact discs and other magnetic media and electronic storage devices, the details of the case, contents, specifications, types, applied length, formats, time of manufacture or pick-up, manufacturers or pickers, etc. thereof shall be indicated; and
