The environmental protection departments (bureaus), the public security departments (bureaus), and the people's procuratorates of all provinces, autonomous regions, and municipalities directly under the Central Government; and the Environmental Protection Bureau, the Public Security Bureau, and the People's Procuratorate of Xinjiang Production and Construction Corps: 各省、自治区、直辖市环境保护厅(局)、公安厅(局)、人民检察院,新疆生产建设兵团环境保护局、公安局、人民检察院:
For the purposes of further improving the mechanism for the coordination work between administrative law enforcement and criminal justice in environment protection, punishing environmental criminal conduct in accordance with the law, practically maintaining public health, and advancing the building of ecological civilization, the Ministry of Environmental Protection, the Ministry of Public Security, and the Supreme People's Procuratorate jointly researched and developed the Measures for Coordination Work between Administrative Law Enforcement and Criminal Justice in Environmental Protection, which are hereby issued for your compliance and implementation. 为进一步健全环境保护行政执法与刑事司法衔接工作机制,依法惩治环境犯罪行为,切实保障公众健康,推进生态文明建设,环境保护部、公安部和最高人民检察院联合研究制定了《环境保护行政执法与刑事司法衔接工作办法》,现予以印发,请遵照执行。

Measures for Coordination Work between Administrative Law Enforcement and Criminal Justice in Environmental Protection 环境保护行政执法与刑事司法衔接工作办法
Chapter I General Provisions 

第一章 总  则

Article 1 For the purposes of further improving the mechanism for the coordination work between administrative law enforcement and criminal justice in environment protection, punishing environmental criminal conduct in accordance with the law, practically maintaining public health, and advancing the building of ecological civilization, these Measures are developed under the Criminal Law, the Criminal Procedure Law, the Environmental Protection Law, the Provisions on Referral of Suspected Criminal Cases by Administrative Law Enforcement Agencies (Order No. 310, State Council), and other laws and regulations and the relevant provisions.   第一条 为进一步健全环境保护行政执法与刑事司法衔接工作机制,依法惩治环境犯罪行为,切实保障公众健康,推进生态文明建设,依据《刑法》《刑事诉讼法》《环境保护法》《行政执法机关移送涉嫌犯罪案件的规定》(国务院令第310号)等法律、法规及有关规定,制定本办法。
Article 2 These Measures shall apply to cases concerning suspected environmental crimes handled by the environmental protection authorities at all levels (hereinafter referred to as the "environmental protection authorities"), public security authorities and the people's procuratorates.   第二条 本办法适用于各级环境保护主管部门(以下简称环保部门)、公安机关和人民检察院办理的涉嫌环境犯罪案件。
Article 3 The environmental protection authorities, public security authorities and the people's procuratorates shall heighten collaboration, unify the application of the law, and continue perfecting notification of leads, referral of cases, resource sharing, information release, and other working mechanisms.   第三条 各级环保部门、公安机关和人民检察院应当加强协作,统一法律适用,不断完善线索通报、案件移送、资源共享和信息发布等工作机制。
Article 4 The people's procuratorates shall conduct legal supervision according to the law of the referral of cases concerning suspected environmental crimes by the environmental protection authorities and the docketing of referred cases by public security authorities.   第四条 人民检察院对环保部门移送涉嫌环境犯罪案件活动和公安机关对移送案件的立案活动,依法实施法律监督。
Chapter II Case Referral and Legal Supervision 

第二章 案件移送与法律监督

Article 5 The environmental protection authorities shall, when discovering cases concerning suspected environmental crimes over the course of investigating and handling violations of environmental law, verify the circumstances and prepare a written report on the referral of cases concerning suspected environmental crimes. The persons in charge of the environmental protection authorities shall, within three days after receiving the report, decide whether or not to make a referral. A case concerning suspected environmental crime referred to the public security authority shall satisfy the following conditions:   第五条 环保部门在查办环境违法案件过程中,发现涉嫌环境犯罪案件,应当核实情况并作出移送涉嫌环境犯罪案件的书面报告。本机关负责人应当自接到报告之日起3日内作出批准移送或者不批准移送的决定。向公安机关移送的涉嫌环境犯罪案件,应当符合下列条件:
(1) The subject of and procedures for administrative law enforcement are lawful. (一)实施行政执法的主体与程序合法。
(2) There is lawful evidence that the suspected environmental crime took place. (二)有合法证据证明有涉嫌环境犯罪的事实发生。
Article 6 The environmental protection authority that is to refer a case concerning suspected environmental crime shall refer the case materials to the public security authority at the same level within 24 hours after deciding to make an referral and sends a copy of the case referral to the people's procuratorate at the same level.   第六条 环保部门移送涉嫌环境犯罪案件,应当自作出移送决定后24小时内向同级公安机关移交案件材料,并将案件移送书抄送同级人民检察院。
The environmental protection authority shall attach the following when referring a case concerning suspected environmental crime to the public security authority: 环保部门向公安机关移送涉嫌环境犯罪案件时,应当附下列材料:
(1) A case referral, specifying the name of the referring authority, suspected crime and main basis, principal person in charge of the case, and contact information, among others. A list of the referred materials shall be attached to the case referral and signed by the referring authority. (一)案件移送书,载明移送机关名称、涉嫌犯罪罪名及主要依据、案件主办人及联系方式等。案件移送书应当附移送材料清单,并加盖移送机关公章。
(2) A case investigation report, specifying the source of the case, investigation and findings, the basic information of the criminal suspect, the facts of suspected crime, evidence and legal basis, and disposition proposals and legal basis, among others. (二)案件调查报告,载明案件来源、查获情况、犯罪嫌疑人基本情况、涉嫌犯罪的事实、证据和法律依据、处理建议和法律依据等。
(3) Crime scene inspection (investigation) records, investigative inquiry records, scene inspection and investigation sketch, and sampling records, among others. (三)现场检查(勘察)笔录、调查询问笔录、现场勘验图、采样记录单等。
(4) A list of case-related things, specifying the names, quantity, characteristics, storage places, and other items of the case-related things already sealed up, seized, or otherwise under compulsory administrative measures, with compulsory administrative measures taken, records made on the scene, and other relevant materials indicating the source of the case-related things attached. (四)涉案物品清单,载明已查封、扣押等采取行政强制措施的涉案物品名称、数量、特征、存放地等事项,并附采取行政强制措施、现场笔录等表明涉案物品来源的相关材料。
(5) Crime scene photos or audio or visual records and the list thereof, specifying facts in issue, photographer, the time photos are taken, and the location photos are taken, among others. (五)现场照片或者录音录像资料及清单,载明需证明的事实对象、拍摄人、拍摄时间、拍摄地点等。
(6) Monitoring and inspection reports, an environmental emergency investigation report, and determination opinions. (六)监测、检验报告、突发环境事件调查报告、认定意见。
(7) Other materials relating the suspected crime. (七)其他有关涉嫌犯罪的材料。
Where an administrative penalty decision has been made against an act violating environmental law, the administrative penalty decision shall be attached. 对环境违法行为已经作出行政处罚决定的,还应当附行政处罚决定书。
Article 7 The public security authority shall accept in accordance with the law a case concerning suspected environmental crime referred by the environmental protection authority and forthwith issue an acknowledgment or sign the acknowledgment in the referral of a case concerning suspected environmental crime.   第七条 对环保部门移送的涉嫌环境犯罪案件,公安机关应当依法接受,并立即出具接受案件回执或者在涉嫌环境犯罪案件移送书的回执上签字。
Article 8 Where the public security authority discovers that the referred materials of a case concerning suspected environmental crime is incomplete, it shall, within 24 hours after accepting the case, notify the referring environmental protection authority in writing of making supplements and corrections within three days. The referred case may not be rejected for reasons of incomplete materials.   第八条 公安机关审查发现移送的涉嫌环境犯罪案件材料不全的,应当在接受案件的24小时内书面告知移送的环保部门在3日内补正。但不得以材料不全为由,不接受移送案件。
Where the public security authority discovers in review that the evidence of a referred case concerning suspected environmental crime is insufficient, it may offer supplementary investigation opinions with regard to the relevant evidence of existence of the facts of the crime and require the environmental protection authority referring the case to make a supplementary investigation. The environmental protection authority shall do so as required and provide the public security authority with the investigation results as feedback in a timely manner. Where supplements and corrections are impossible as a result of objective conditions, the environmental protection authority shall file a written statement with the public security authority. 公安机关审查发现移送的涉嫌环境犯罪案件证据不充分的,可以就证明有犯罪事实的相关证据等提出补充调查意见,由移送案件的环保部门补充调查。环保部门应当按照要求补充调查,并及时将调查结果反馈公安机关。因客观条件所限,无法补正的,环保部门应当向公安机关作出书面说明。
Article 9 The public security authority shall decide whether or not to docket a case concerning suspected environmental crime referred by the environmental protection authority within three days after accepting the case; or, if the clues to the suspected environmental crime need to be investigated and proved, within seven days after accepting the case; or, if the case is significant, difficult and complicated, may, with the approval of the person in charge of the public security authority at or above the county level, make a decision within 30 days after accepting the case. A case over which the public security authorities have jurisdiction but is accepted by the public security authority which does not have jurisdiction shall be referred to the public security authority of jurisdiction within 24 hours after the case is accepted, of which written notification shall be given to the environmental protection authority, with a copy sent to the people's procuratorate at the same level. A case over which the public security authorities have no jurisdiction shall be returned within 24 hours to the environmental protection authority referring the case.   第九条 公安机关对环保部门移送的涉嫌环境犯罪案件,应当自接受案件之日起3日内作出立案或者不予立案的决定;涉嫌环境犯罪线索需要查证的,应当自接受案件之日起7日内作出决定;重大疑难复杂案件,经县级以上公安机关负责人批准,可以自受案之日起30日内作出决定。接受案件后对属于公安机关管辖但不属于本公安机关管辖的案件,应当在24小时内移送有管辖权的公安机关,并书面通知移送案件的环保部门,抄送同级人民检察院。对不属于公安机关管辖的,应当在24小时内退回移送案件的环保部门。
The public security authority shall notify the environmental protection authority in writing within three days after deciding to docket, reject or withdraw the case and send a copy to the people's procuratorate at the same level. The public security authority that decides to reject or withdraw the case shall state the reasons in writing and return the case files and materials to the environmental protection authority. 公安机关作出立案、不予立案、撤销案件决定的,应当自作出决定之日起3日内书面通知环保部门,并抄送同级人民检察院。公安机关作出不予立案或者撤销案件决定的,应当书面说明理由,并将案卷材料退回环保部门。
Article 10 The environmental protection authority shall, within three days, refer the case-related items and other materials relating to the case to the public security authority and undergo the referral formalities.

   第十条 环保部门应当自接到公安机关立案通知书之日起3日内将涉案物品以及与案件有关的其他材料移交公安机关,并办理交接手续。
