| Reference Opinions of the Civil Division I of the Beijing High People's Court on the Application of the Extinctive Prescription after the General Provisions of the Civil Law Come into Force | | 北京市高级人民法院民一庭关于《民法总则》施行后适用诉讼时效制度的参考意见 |
| The General Provisions of the Civil Law of the People's Republic of China (hereinafter referred to as the “General Provisions of the Civil Law”) had come into force on October 1, 2017. The General Provisions of the Civil Law have made major adjustments to the system of extinctive prescription on the basis of the General Principles of the Civil Law of the People's Republic of China (hereinafter referred to as the “General Principles of the Civil Law”) and relevant judicial interpretations. In view of the fact that the legislative organ and the Supreme People's Court have not yet issued laws or judicial interpretations to specify the application of laws on the old and new extinctive prescription, to ensure a smooth transition and effective connection between the old and new extinctive prescription, and to ensure the unity of the application of laws by the civil divitions of the courts in this municipality, the following opinions on the specific application of the system of extinctive prescription after the General Provisions of the Civil Law came into force are hereby put forward for reference by the civil divitions of the courts in this municipality. | | 《中华人民共和国民法总则》（以下简称《民法总则》）已于2017年10月1日起施行，《民法总则》在《中华人民共和国民法通则》（以下简称《民法通则》）和相关司法解释的基础上对诉讼时效制度作了重大调整。鉴于立法机关和最高人民法院尚未出台法律和司法解释就新旧诉讼时效的法律适用问题予以明确，为确保新旧诉讼时效期间的平稳过渡和有效衔接，保证全市法院民事审判部门适用法律的统一，现就《民法总则》施行后诉讼时效制度的具体适用提出如下意见，供全市法院民事审判部门参考。 |

| After the General Provisions of the Civil Law came into force, the provisions of the General Provisions of the Civil Law, the General Principles of the Civil Law, and other civil separate laws on extinctive prescription shall co-exist concurrently, and there are conflicts in application of law within a certain scope, mainly including: | | 《民法总则》施行后，《民法总则》、《民法通则》以及其他民事单行法中有关诉讼时效的规定同时并存，在一定范围内存在法律适用上的冲突，主要包括： |
| 1. Principles for conflict in application of the extinctive prescription provided for in the General Provisions of the Civil Law and the ordinary extinctive prescription provided for in the General Principles of the Civil Law | | （一）《民法总则》规定的诉讼时效期间与《民法通则》普通诉讼时效期间的冲突适用原则 |
| The two-year ordinary extinctive prescription provided for in the General Principles of the Civil Law and the three-year ordinary extinctive prescription provided for in the General Provisions of the Civil Law are different provisions set forth on the same matters. Given that the General Principles of the Civil Law and the General Provisions of the Civil Law are both fundamental laws and have the same effectiveness level, the ordinary extinctive prescription shall be three years after the General Provisions of the Civil Law came into force under the principle that new laws prevail over old ones. | | 《民法通则》规定的二年普通诉讼时效期间与《民法总则》规定的三年普通诉讼时效期间属于在相同事项上作出的不同规定，鉴于《民法通则》与《民法总则》均属于基本法，在效力等级上处于同一位阶，故根据新法优于旧法的原则在《民法总则》施行后普通诉讼时效期间应为三年。 |
| 2. Principles for conflict in application of the extinctive prescription provided for in the General Provisions of the Civil Law and the short extinctive prescription provided for in the General Principles of the Civil Law | | （二）《民法总则》规定的诉讼时效期间与《民法通则》短期诉讼时效期间的冲突适用原则 |
The reason why the General Principles of Civil Law are not repealed for the present is that contract, ownership, other property right, civil liability and other specific contents prescribed therein still need to be further planned as a whole and systematically integrated when compiling all chapters of the Civil Code, while the rules on extinctive prescription are provided for in special chapters of the General Principles of the Civil Law and the General Provisions of the Civil Law. The provisions of the General Provisions of the Civil Law on extinctive prescription shall be deemed as having comprehensively replaced the relevant provisions of the General Principles of the Civil Law. The one-year short extinctive prescription provided for in Article 136 of the General Principles of the Civil Law belongs to a clause in the chapter of extinctive prescription, while it is not provided for in the chapter of extinctive prescription in the General Provisions of the Civil Law. It may be deemed that the one-year short extinctive prescription is canceled in the General Provisions of the Civil Law. Therefore, the one-year extinctive prescription provided for in Article 136 of the General Principles of Civil Law will no longer apply after the General Provisions of the Civil Law came into force.
