The Provisions of the Supreme People's Court on Strictly Regulating the Issues on Extending the Time Limit for Trial and Postponing the Hearing for Civil and Commercial Cases, as adopted at the 1737th session of the Judicial Committee of the Supreme People's Court on April 23, 2018, are hereby issued and shall come into force on April 26, 2018. 《最高人民法院关于严格规范民商事案件延长审限和延期开庭问题的规定》已于2018年4月23日由最高人民法院审判委员会第1737次会议通过,现予公布,自2018年4月26日起施行。

Provisions of the Supreme People's Court on Strictly Regulating the Issues on Extending the Time Limit for Trial and Postponing the Hearing for Civil and Commercial Cases 最高人民法院关于严格规范民商事案件延长审限和延期开庭问题的规定
(Interpretation No. 9 [2018] of the Supreme People's Court, adopted at the 1737th session of the Judicial Committee of the Supreme People's Court on April 23, 2018 and coming into force on April 26, 2018) (2018年4月23日最高人民法院审判委员会第1737次会议通过,自2018年4月26日起施行 法释〔2018〕9号)
For the purposes of safeguarding the lawful rights and interests of litigants, the issues on extending the time limit for trial and postponing the hearing for civil and commercial cases are hereby set out as follows, in accordance with the Civil Procedure Law of the People's Republic of China and other provisions and in light of the actual trial circumstances. 为维护诉讼当事人合法权益,根据《中华人民共和国民事诉讼法》等规定,结合审判实际,现就民商事案件延长审限和延期开庭的有关问题规定如下。
Article 1 When trying civil and commercial cases, the people's courts shall strictly comply with the relevant provisions of the laws and judicial interpretations on the time limit for trial. The time limit for trial of first-instance cases to be heard under normal procedures shall be six months; and the time limit for trial of first-instance cases to be heard under summary procedures shall be three months. The time limit for trial of appellate cases for which judgments are rendered shall be three months; and the time limit for trial of appellate cases for which rulings are rendered shall be thirty days.   第一条 人民法院审理民商事案件时,应当严格遵守法律及司法解释有关审限的规定。适用普通程序审理的第一审案件,审限为六个月;适用简易程序审理的第一审案件,审限为三个月。审理对判决的上诉案件,审限为三个月;审理对裁定的上诉案件,审限为三十日。
Where the time limit for trial needs to be extended under special circumstances as set out in laws, the sole judge or collegial bench shall file an application with the president of the people's court fifteen days prior to the expiration of the time limit, and explain the details and reasons. The president shall make a decision five days prior to the expiration of the time limit. 法律规定有特殊情况需要延长审限的,独任审判员或合议庭应当在期限届满十五日前向本院院长提出申请,并说明详细情况和理由。院长应当在期限届满五日前作出决定。
Where a case is unable to be concluded after the president approves the extension of the time limit for trial and the time limit for trial needs to be extended again, a request shall be submitted to the people's court at a higher level fifteen days prior to the expiration of the time limit. The people's court at a higher level shall make a decision five days prior to the expiration of the time limit. 经本院院长批准延长审限后尚不能结案,需要再次延长的,应当在期限届满十五日前报请上级人民法院批准。上级人民法院应当在审限届满五日前作出决定。
Article 2 A people's court holding court session to hear a civil and commercial case and deeming it necessary to hold court session again shall notify the parties of the time of the next court session according to the law. The interval between two court sessions shall not exceed one month, except due to force majeure or with the consent of the parties.   第二条 人民法院开庭审理民商事案件后,认为需要再次开庭的,应当依法告知当事人下次开庭的时间。两次开庭间隔时间不得超过一个月,但因不可抗力或当事人同意的除外。
Article 3 A sole judge or collegial bench deciding to postpone the hearing under the provisions of item (4) of Article 146北大法宝,版权所有 of the Civil Procedure Law shall report to the president of the court for approval.   第三条 独任审判员或者合议庭适用民事诉讼法一百四十六条第四项规定决定延期开庭的,应当报本院院长批准。
Article 4 The people's courts shall disclose the case filing time and time limit for trial, the deduction, extension and re-calculation of the time limit for trial, the situations of and causes for extending hearing of cases to the parties and their legal representatives and litigation representatives in a timely manner according to the Provisions of the Supreme People's Court on the Publication of Trial Process Information on the Internet by People's Courts. Where parties and their legal representatives or agent at litem raise any objection, they may apply to the court accepting the case for supervision according to the law.   第四条 人民法院应当将案件的立案时间、审理期限,扣除、延长、重新计算审限,延期开庭审理的情况及事由,按照《最高人民法院关于人民法院通过互联网公开审判流程信息的规定》及时向当事人及其法定代理人、诉讼代理人公开。当事人及其法定代理人、诉讼代理人有异议的,可以依法向受理案件的法院申请监督。
Article 5 Those who postpone the handling of any case in deliberate violation of the law, trial discipline or judicial management provisions or who delay the handling of any case due to negligence and have caused serious consequences shall be subject to disciplinary actions in accordance with the provisions of Article 47 of the Regulation on the Disciplinary Actions against Staff Members of the People's Courts.   第五条 故意违反法律、审判纪律、审判管理规定拖延办案,或者因过失延误办案,造成严重后果的,依照《人民法院工作人员处分条例

Article 6 These Provisions shall come into force on April 26, 2018. For any discrepancies between the judicial interpretations and regulatory documents previously issued by the Supreme People's Court and these Provisions, these Provisions shall prevail.   第六条 本规定自2018年4月26日起施行;最高人民法院此前发布的司法解释及规范性文件与本规定不一致的,以本规定为准。
