| Promoting the national standards for regulating intellectual property rights (“IPR”) management of enterprises, higher education institutions, and scientific research organizations, and strengthening the construction of an IPR management system is an effective means of continuously improving IPR protection capability and enhancing core competitiveness. In recent years, all local authorities have earnestly implemented the Guiding Opinions on Comprehensively Promoting the National Standards of the Specifications for the Administration of Intellectual Property Rights of Enterprises (No. 44 [2015], the Administration of Intellectual Property Rights), establish and improve policies and systems, adopt such supporting measures as incentives and subsidies, guide enterprises in continuously improving the IPR management system, and effectively promote the standard implementation work through third-party certification. Currently, there are 26,000 enterprises certified by the Standards on Enterprises' Intellectual Property Rights Management (GB/T 29490-2013) nationwide; and nearly 60% of the certified enterprises believe the IPR management system has improved the enterprises' innovation capability, competitive strengths, and market benefits. The standard implementation certification work based on the Standards of Administration of Intellectual Property of Scientific Research Organizations (GB/T 33250-2016) and the Standards of Administration of Intellectual Property of Universities (GB/T33251-2016) is moving forward in an orderly way, and has made initial achievements. | | 推行企业、高等学校、科研组织知识产权管理规范国家标准，加强创新主体知识产权管理体系建设，是持续提升知识产权能力、增强核心竞争力的有效手段。近年来，各地认真贯彻落实《关于全面推行〈企业知识产权管理规范〉国家标准的指导意见》（国知发管字〔2015〕44号），建立健全政策体系，采取奖励补贴等扶持措施，指导企业持续改进知识产权管理体系，并通过引入第三方认证切实推进贯标工作落地见效。目前，全国通过《企业知识产权管理规范》（GB/T 29490-2013）的认证企业达2.6万家，近60%的获证企业认为建立知识产权管理体系提升了企业创新能力、竞争优势和市场收益。《科研组织知识产权管理规范》（GB/T 33250-2016）、《高等学校知识产权管理规范》（GB/T33251-2016）贯标认证工作正在有序推进，取得了初步成效。 |
| Though more and more innovation entities identify and recognize the standard implementation certification of the IPR management system, there are still some prominent problems to be resolved: On one hand, the standard implementation certification fails to completely comply with the enterprises' actual conditions; the IPR management system fails to take shape in the operation of enterprises; the standard implementation process and the certification rules apply mechanically without notable industrial and professional characteristics; the consulting and training services for standard implementation are far from being standardized; and the expertise of certification auditors fails to meet the actual demands of enterprises. On the other hand, some local supporting policies for standard implementation certification are not precise enough, resulting in arbitrage in violation of laws and regulations and even “double-standard” certification in which “consulting institutions prepare documents, and certification institutions affix seals”. | | 在越来越多的创新主体认同认可知识产权管理体系贯标认证工作的同时，也存在一些亟待解决的突出问题：一方面，贯标认证与企业实际融合不够，知识产权管理体系尚未在企业运行中“生根开花”；贯标流程和认证规则“生搬硬套”，缺乏行业和专业特色；贯标认证辅导咨询和培训服务还不规范，认证审核人员专业能力离企业的实际需求有较大差距。另一方面，部分地方贯标认证扶持政策导向不够精准，导致出现违规套利情况，甚至出现了“咨询机构编本子、认证机构盖章子”的“两张皮”现象。 |
| For the purposes of implementing the general requirements of “staying true to the initial mission”, deepening the reform of “simplification of administrative procedures, devolution of powers, combination of devolution and regulation, and optimization of services”, accelerating the work of regulating the standard implementation certification of the IPR management system, correcting the problems immediately after discovering them, promoting the high-quality operation of the IPR management system, and upholding the initial purpose and bottom line of IPR standard implementation certification, the relevant requirements are notified as follows: | | 为认真落实“不忘初心、牢记使命”主题教育总体要求，深化知识产权领域“放管服”改革，加快规范知识产权管理体系贯标认证工作，对发现的问题立行立改，推动知识产权管理体系高质量运行，坚守做好知识产权贯标认证工作的初心和底线。现就有关要求通知如下。 |
