| The State Council has approved the Plan for Further Deepening the Reform and Opening-up of China (Shanghai) Pilot Free Trade Zone (hereinafter referred to as the “Plan”), which is hereby issued. | | 国务院批准《进一步深化中国（上海）自由贸易试验区改革开放方案》（以下简称《方案》），现予印发。 |
| I. Further Deepening the reform and opening-up of China (Shanghai) Pilot Free Trade Zone (“SHFTZ”) is an important decision of the CPC Central Committee and the State Council, is a major move to explore new channels and accumulate new experience for the comprehensive deepening of reform and expansion of opening-up under the new situation, and is of great significance in accelerating the transformation of government functions, actively exploring innovative management modes, promoting trade and investment facilitation, giving a new impetus to deepening reforms, and creating new advantages through expanded opening-up. | | 一、进一步深化中国（上海）自由贸易试验区（以下简称自贸试验区）改革开放，是党中央、国务院作出的重大决策，是在新形势下为全面深化改革和扩大开放探索新途径、积累新经验的重要举措，对加快政府职能转变、积极探索管理模式创新、促进贸易和投资便利化、形成深化改革新动力、扩大开放新优势，具有重要意义。 |
| II. After regional expansion, SHFTZ shall duly play its role of a spearhead in the reform and opening-up and a pioneer in innovative development, continue regard institutional innovation as the core in the implementation of national strategies such as the development of the Yangtze River Economic Zone, and take the lead in exploring the potential of reforms and resolving challenging problems encountered in reforms in the building of a new open economic system, exploration of a new model for regional economic cooperation, and establishment of a business environment governed by law. SHFTZ shall actively explore the management mode of pre-establishment national treatment plus a negative list, deepen the reform of the administrative management system, and improve the capability and level of interim and ex post supervision. | | 二、扩展区域后的自贸试验区要当好改革开放排头兵、创新发展先行者，继续以制度创新为核心，贯彻长江经济带发展等国家战略，在构建开放型经济新体制、探索区域经济合作新模式、建设法治化营商环境等方面，率先挖掘改革潜力，破解改革难题。要积极探索外商投资准入前国民待遇加负面清单管理模式，深化行政管理体制改革，提升事中事后监管能力和水平。 |
| III. The Shanghai Municipal People's Government and the relevant departments shall free their minds in reform and innovation, be bold in practice and active in exploration, make overall planning, and strengthen coordination, so as to give support to the pilot programs of SHFTZ. They shall strengthen organization and leadership, specify responsible parties, elaborately organize the implementation of the Plan, and effectively prevent and control various risks. They shall summarize and assess the effects of implementing the pilot programs in a timely manner to provide replicable and widely applicable reform experience, and further play a positive and exemplary role in serving the whole country. | | 三、上海市人民政府和有关部门要解放思想、改革创新，大胆实践、积极探索，统筹谋划、加强协调，支持自贸试验区先行先试。要加强组织领导，明确责任主体，精心组织好《方案》实施工作，有效防控各类风险。要及时总结评估试点实施效果，形成可复制可推广的改革经验，更好地发挥示范引领、服务全国的积极作用。 |
| IV. In accordance with the Decision of the Standing Committee of the National People's Congress on Authorizing the State Council to Temporarily Adjust the Relevant Administrative Approval Items Prescribed in Laws in China (Guangdong) Pilot Free Trade Zone, China (Tianjin) Pilot Free Trade Zone, China (Fujian) Pilot Free Trade Zone, and the Extensions of China (Shanghai) Pilot Free Trade Zone, certain provisions of the relevant administrative regulations and the documents issued by the State Council shall be appropriately adjusted for the time being. Detailed provisions on such adjustments will be additionally issued by the State Council. | | 四、根据《全国人民代表大会常务委员会关于授权国务院在中国（广东）自由贸易试验区、中国（天津）自由贸易试验区、中国（福建）自由贸易试验区以及中国（上海）自由贸易试验区扩展区域暂时调整有关法律规定的行政审批的决定》，相应暂时调整有关行政法规和国务院文件的部分规定。具体由国务院另行印发。 |

| | 自由贸易试验区改革开放方案 |
| | 中国（上海）自由贸易试验区（以下简称自贸试验区）运行以来，围绕加快政府职能转变，推动体制机制创新，营造国际化、市场化、法治化营商环境等积极探索，取得了重要阶段性成果。为贯彻落实党中央、国务院关于进一步深化自贸试验区改革开放的要求，深入推进《中国（上海）自由贸易试验区总体方案》确定的各项任务，制定本方案。 |
| | 一、总体要求 |
| | （一）指导思想。 |
| | 全面贯彻落实党的十八大和十八届二中、三中、四中全会精神，按照党中央、国务院决策部署，紧紧围绕国家战略，进一步解放思想，坚持先行先试，把制度创新作为核心任务，把防控风险作为重要底线，把企业作为重要主体，以开放促改革、促发展，加快政府职能转变，在更广领域和更大空间积极探索以制度创新推动全面深化改革的新路径，率先建立符合国际化、市场化、法治化要求的投资和贸易规则体系，使自贸试验区成为我国进一步融入经济全球化的重要载体，推动“一带一路”建设和长江经济带发展，做好可复制可推广经验总结推广，更好地发挥示范引领、服务全国的积极作用。 |
| | （二）发展目标。 |
| | 按照党中央、国务院对自贸试验区“继续积极大胆闯、大胆试、自主改”、“探索不停步、深耕试验区”的要求，深化完善以负面清单管理为核心的投资管理制度、以贸易便利化为重点的贸易监管制度、以资本项目可兑换和金融服务业开放为目标的金融创新制度、以政府职能转变为核心的事中事后监管制度，形成与国际投资贸易通行规则相衔接的制度创新体系，充分发挥金融贸易、先进制造、科技创新等重点功能承载区的辐射带动作用，力争建设成为开放度最高的投资贸易便利、货币兑换自由、监管高效便捷、法制环境规范的自由贸易园区。 |
| | （三）实施范围。 |
| | 自贸试验区的实施范围120.72平方公里，涵盖上海外高桥保税区、上海外高桥保税物流园区、洋山保税港区、上海浦东机场综合保税区4个海关特殊监管区域（28.78平方公里）以及陆家嘴金融片区（34.26平方公里）、金桥开发片区（20.48平方公里）、张江高科技片区（37.2平方公里）。 |
| | 自贸试验区土地开发利用须遵守土地利用法律法规。浦东新区要加大自主改革力度，加快政府职能转变，加强事中事后监管等管理模式创新，加强与上海国际经济、金融、贸易、航运中心建设的联动机制。 |
| | 二、主要任务和措施 |
| | （一）加快政府职能转变。 |
| | 1.完善负面清单管理模式。推动负面清单制度成为市场准入管理的主要方式，转变以行政审批为主的行政管理方式，制定发布政府权力清单和责任清单，进一步厘清政府和市场的关系。强化事中事后监管，推进监管标准规范制度建设，加快形成行政监管、行业自律、社会监督、公众参与的综合监管体系。 |
| | 2.加强社会信用体系应用。完善公共信用信息目录和公共信用信息应用清单，在市场监管、城市管理、社会治理、公共服务、产业促进等方面，扩大信用信息和信用产品应用，强化政府信用信息公开，探索建立采信第三方信用产品和服务的制度安排。支持信用产品开发，促进征信市场发展。 |
| | 3.加强信息共享和服务平台应用。加快以大数据中心和信息交换枢纽为主要功能的信息共享和服务平台建设，扩大部门间信息交换和应用领域，逐步统一信息标准，加强信息安全保障，推进部门协同管理，为加强事中事后监管提供支撑。
