The organization departments of the Party committees and the personnel departments (bureaus) of the governments of all provinces, autonomous regions and municipalities directly under the Central Government; the cadres (personnel) divisions of all departments and commissions under the CPC Central Committee, all ministries and commissions of the state organs and all people's groups; and the Organization Department of the CPC Committee and the Personnel Bureau of Xinjiang Production and Construction Corps:
 
各省、自治区、直辖市党委组织部、政府人事厅(局),中央和国家机关各部委、各人民团体干部(人事)部门,新疆生产建设兵团党委组织部、人事局:

The Provisions on the Appointment of Civil Servants by Transfer (for Trial Implementation) are hereby issued to you for your earnest compliance and implementation in light of the actual situations. If you have any problem or suggestion in the process of implementation, please report it in a timely manner to the Organization Department of the CPC Central Committee and the Ministry of Personnel.

公务员调任规定(试行)

 
Chapter I General Provisions 

第一章 总则


 
Article 1 To broaden the selection channels for civil servants, optimize the structure of civil servants and regulate the appointment of civil servants by transfer, these Provisions are formulated according to the Civil Servant Law and other relevant laws and regulations.   第一条 为拓宽选人渠道,优化公务员队伍结构,规范公务员调任工作,根据公务员法和有关法律、法规,制定本规定。

 
Article 2 For the purposes of these Provisions, the term “transfer” means that a person who renders public services in a state-owned enterprise, public institution, mass organization or non-governmental group is transferred into a state organ to hold a leading post or a non-leading post at or above the level of associate consultant or any other corresponding post.   第二条 本规定所称调任,是指国有企业事业单位、人民团体和群众团体中从事公务的人员调入机关担任领导职务或者副调研员以上及其他相当职务层次的非领导职务。

Where there are any other provisions on the transfer of the above person to be a member of the leadership, such provisions shall apply.
 
调任领导成员另有规定的,从其规定。

 
Article 3 The transfer must be conducted under the principle of morality and capability of a civil servant meeting his post requirements, by combining organizational arrangements with personal willingness according to the actual needs of work and qualification requirements, under strict control and in the manner of selecting the best.   第三条 调任必须坚持德才素质与职位要求相适应的原则,根据工作需要和资格条件,坚持组织安排与个人意愿相结合,从严掌握,择优任用。

 
Article 4 The transfer must be conducted within the prescribed number of posts and number of holders of a post, and there shall be a corresponding post vacancy for the transfer.   第四条 调任必须在规定的编制限额和职数内进行,并有相应的职位空缺。

 
Article 5 The competent civil servant departments at all levels shall be responsible for the overall administration, supervision and inspection of civil servant transfer according to their respective administrative powers and division of functions.   第五条 各级公务员主管部门按照管理权限和职责分工负责公务员调任工作的综合管理和监督检查。

 
Chapter II Qualification Requirements for Transfer 

第二章 调任资格条件


 
Article 6 A transfer candidate shall meet the following qualification requirements in addition to the requirements prescribed in Article 11 of the Civil Servant Law:   第六条 调任人选应当具备公务员法十一条规定的条件,还应当具备下列资格条件:

 
1. having good political and professional qualities, having a strong working capacity, being devoted to work and having outstanding performance; (一)具有良好的政治、业务素质,工作能力强、勤奋敬业、实绩突出。

 
2. having the work experience and post-holding seniority required by the post which he is to hold by transfer; (二)具有与拟调任职位要求相当的工作经历和任职资历。

 
3. meeting the minimum work seniority requirement necessary for being promoted to the post which he is to hold as required by the Civil Servant Law and other relevant laws; (三)具备公务员法及其配套法规规定的晋升至拟任职务累计所需的最低工作年限。

To hold a post in a state organ, a specialized technician shall have held a deputy senior professional post for two years or more or have already held a senior professional post.
 
专业技术人员调入机关任职的,应当担任副高级专业技术职务2年以上,或者已担任正高级专业技术职务。

 
4. to hold a post in a central or provincial organ, having a bachelor's degree or above; to hold a post in a state organ at or below the municipal (prefecture) level, having an associate degree or above; (四)调入中央机关、省级机关任职的,应当具有大学本科以上文化程度;调入市(地)级以下机关任职的,应当具有大学专科以上文化程度。

 
5. as a general principle, to hold a post at the departmental or bureau level, being not older than 55; to hold a leading post at the county (city) level, being not older than 50; to hold any other post at the divisional level, being not older than 45; and to hold a leading post at the sub-divisional level, being not older than 40; and

 (五)调任厅局级职务的,原则上不超过55周岁;调任县(市)领导班子成员职务的,原则上不超过50周岁,调任其他处级职务的,原则上不超过45周岁;调任科级领导职务的,原则上不超过40周岁。
