In order to implement the usufructuary right of rural land, give farmers more property rights, deepen the financial reform and innovation in rural areas, effectively revitalize the resources, funds, and assets in rural areas, and provide experience and modes for steadily promoting the reform of the rural land system, it is hereby decided on the 18th session of the Standing Committee of the Twelfth National People's Congress that the State Council shall be authorized to temporarily adjust the implementation of the provisions of the Property Law of the People's Republic of China and the Guarantee Law of the People's Republic of China that the right to use the collectively-owned cultivated land may not be mortgaged in the administrative regions of Daxing District of Beijing Municipality and other 231 pilot counties (cities and districts); and temporarily adjust the implementation of the provisions of the Property Law of the People's Republic of China and the Guarantee Law of the People's Republic of China that the right to use the collectively-owned house sites may not be mortgaged in the administrative regions of Jixian County of Tianjin Municipality and other 58 pilot counties (cities and districts). The aforesaid adjustments shall be implemented on a trial basis by December 31, 2017. The temporarily adjusted implementation of the relevant laws must adhere to not changing the nature of the public ownership of land, not breaking through the red line of cultivated land, and not damaging the interests of farmers and adhere to adjusting measures to local conditions based on the actual circumstances. The State Council and the relevant departments shall improve the supporting systems, strengthen the overall guidance, overall planning and coordination, and supervision and administration for the pilot work, prudently promote the work according to procedures and in a step-by-step manner, prevent various risks, summarize the pilot work experience in a timely manner, and report the situations of the temporarily adjusted implementation of the relevant laws to the Standing Committee of the National People's Congress.
．．．．．． | | 为了落实农村土地的用益物权，赋予农民更多财产权利，深化农村金融改革创新，有效盘活农村资源、资金、资产，为稳步推进农村土地制度改革提供经验和模式，第十二届全国人民代表大会常务委员会第十八次会议决定：授权国务院在北京市大兴区等232个试点县（市、区）行政区域，暂时调整实施《中华人民共和国物权法》、《中华人民共和国担保法》关于集体所有的耕地使用权不得抵押的规定；在天津市蓟县等59个试点县（市、区）行政区域暂时调整实施《中华人民共和国物权法》、《中华人民共和国担保法》关于集体所有的宅基地使用权不得抵押的规定。上述调整在2017年12月31日前试行。暂时调整实施有关法律规定，必须坚守土地公有制性质不改变、耕地红线不突破、农民利益不受损的底线，坚持从实际出发，因地制宜。国务院及其有关部门要完善配套制度，加强对试点工作的整体指导和统筹协调、监督管理，按程序、分步骤审慎稳妥推进，防范各种风险，及时总结试点工作经验，并就暂时调整实施有关法律规定的情况向全国人民代表大会常务委员会作出报告。
