| Guiding Opinions of the Supreme People's Court on Further Improving the Mechanism of Designated Mediation | | 最高人民法院关于进一步完善委派调解机制的指导意见 |
| For the purposes of fulfilling the spirit of the Fourth Plenary Session of the 19th CPC Central Committee, promoting the modernization of China's governance system and governance capability, deepening the integrated and comprehensive reform of the judicial system, improving the diversified dispute resolution mechanism, further strengthening and regulating designated mediation services, the following guiding opinions are hereby offered in accordance with the Civil Procedure Law of the People's Republic of China, the Administrative Litigation Law of the People's Republic of China, the Provisions of the Supreme People's Court on Specially Invited Mediation by the People's Courts, and other laws and judicial interpretations and in light of the actual work of the people's courts. | | 为贯彻落实党的十九届四中全会精神，推进国家治理体系和治理能力现代化，深化司法体制综合配套改革，完善多元化纠纷解决机制，进一步加强和规范委派调解工作，根据《中华人民共和国民事诉讼法》《中华人民共和国行政诉讼法》《最高人民法院关于人民法院特邀调解的规定》等法律和司法解释规定，结合人民法院工作实际，提出如下指导意见。 |
| I. Guiding ideology: With Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era as the guidance, efforts shall be made to uphold and develop the “Fengqiao Experience” in the new era, improve the mechanism of resolving disputes at the sources, put the non-litigation dispute resolution mechanism in the first place, and meet the demands of the general public for diversified, efficient and convenient dispute settlement solutions. Designated mediation shall be conducted in accordance with the laws, procedures and principles on a voluntary basis; a social governance system in which party committees play a leading role, governments assume the primary responsibilities, the people's opinions are consulted, social collaboration and public participation are supported, legal guarantees and technical support are provided shall be constantly improved; and a social governance community in which everyone is responsible, dedicated, and shares benefits shall be established. | | 一、指导思想。以习近平新时代中国特色社会主义思想为指导，坚持和发展新时代“枫桥经验”，完善诉源治理机制，切实把非诉讼纠纷解决机制挺在前面，满足广大人民群众多元、高效、便捷的解纷需求。坚持依法、自愿、依程序原则开展委派调解工作，不断推动完善党委领导、政府负责、民主协商、社会协同、公众参与、法治保障、科技支撑的社会治理体系，建设人人有责、人人尽责、人人享有的社会治理共同体。 |
| II. Scope of mediation: For disputes involving people's livelihood and interests, unless they are not suitable for mediation, specially-invited mediation agencies or specially-invited mediators may be designated by the people's courts to provide mediation services. For certain types of disputes in terms of property management, compensation for traffic accidents, protection of consumers' rights and interests, and compensation for medical injuries, the people's courts shall play a demonstrating role in designated mediation, and promote the effective resolution of disputes in batches. | | 二、调解范围。对于涉及民生利益的纠纷，除依法不适宜调解的，人民法院可以委派特邀调解组织或者特邀调解员开展调解。对于物业管理、交通事故赔偿、消费者权益保护、医疗损害赔偿等类型化纠纷，人民法院要发挥委派调解的示范作用，促进批量、有效化解纠纷。 |
III. Professional dispute resolution: The people's courts shall strengthen the cooperation with the relevant authorities, fully bring into play the strengths of administrative organs in the mechanisms for administrative mediation and administrative adjudication, leverage the technical skills of professional mediation agencies in certain industries, maximize the role of notarial offices, authentication institutions, and experts' consultation opinions in the relevant fields, provide professional support for dispute resolution, and improve the professionalism in designated mediation services.
