| The entities leading the building of the social credit system, offices of the guidance commissions on building spiritual civilization, higher people's courts, finance departments (bureaus), human resources and social security departments (bureaus), state taxation bureaus, and local taxation bureaus of all provinces, autonomous regions, municipalities directly under the Central Government, and Xinjiang Production and Construction Corps; all the dispatched offices of the China Securities Regulatory Commission; and rail transport enterprises, the China Academy of Railway Science Corporation Limited, and all railway public security bureaus: | | 各省、自治区、直辖市、新疆生产建设兵团社会信用体系建设牵头单位、文明办、高级人民法院、财政厅（局）、人力资源社会保障厅（局）、国家税务局、地方税务局，中国证监会各派出机构，铁路运输企业、铁科院、各铁路公安局： |
| For the purposes of studying and implementing Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era and the spirit of the 19th CPC National Congress, carrying out the important instructions of General Secretary Xi Jinping on building a big credit punishment pattern of "restrictions everywhere for dishonesty in one place," following the requirements of the Guiding Opinions of the State Council on Establishing and Improving a System of Joint Incentive for Honesty and Joint Punishment for Dishonesty and Accelerating the Advancement of the Development of Social Honesty (No. 33 [2016], State Council), preventing a portion of passengers from having an adverse impact on the safe railway operation through illegal and dishonest conduct, and further increasing the punishment of the seriously illegal and honest conduct in other fields, the following opinions on restricting particular seriously dishonest persons from traveling by train are hereby offered. | | 为深入学习贯彻习近平新时代中国特色社会主义思想和党的十九大精神，落实习近平总书记关于构建“一处失信、处处受限”信用惩戒大格局的重要指示，按照《国务院关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的指导意见》（国发〔2016〕33号）要求，防范部分旅客违法失信行为对铁路运行安全的不利影响，进一步加大对其他领域严重违法失信行为的惩戒力度，现就限制特定严重失信人乘坐火车提出以下意见。 |

| 1. Relevant persons liable for conduct seriously affecting railway operation safety and work safety and punished public security authorities or determined by railway station or train entities | | （一）严重影响铁路运行安全和生产安全有关的行为责任人被公安机关处罚或铁路站车单位认定的 |
| (1) Disturbing the transport order of railway stations or trains, to the detriment of railway safety or having a seriously social impact. | | 1.扰乱铁路站车运输秩序且危及铁路安全、造成严重社会不良影响的； |
| (2) Smoking in a multiple-unit train or in a non-smoking area of any other train. | | 2.在动车组列车上吸烟或者在其他列车的禁烟区域吸烟的； |
| (3) Speculating in train tickets, or making or selling fake tickets, as investigated and punished. | | 3.查处的倒卖车票、制贩假票的； |
| (4) Buying tickets and traveling by train on another person's or a fake or invalid identity document vesting incentives (discounts). | | 4.冒用优惠（待）身份证件、使用伪造或无效优惠（待）身份证件购票乘车的； |
| (5) Traveling by train on a fake, expired or otherwise invalid ticket, or on another person's replacement ticket. | | 5.持伪造、过期等无效车票或冒用挂失补车票乘车的； |
| (6) Traveling by train without a ticket, on a lower-class ticket, or over-riding, and refusing to pay the fare or the excess fare. | | 6.无票乘车、越站（席）乘车且拒不补票的； |
| (7) Administratively punishable according to any relevant law or regulation. | | 7.依据相关法律法规应予以行政处罚的。 |
| A person liable for any of the foregoing shall be restricted from traveling by train. | | 对上述行为责任人限制乘坐火车。 |
| 2. Relevant persons liable for seriously illegal and dishonest conduct in other fields | | （二）其他领域的严重违法失信行为有关责任人 |
| (1) Any party to a significant tax violation case capable of payment but refusing to pay. | | 1.有履行能力但拒不履行的重大税收违法案件当事人； |
| (2) Any person liable for seriously dishonest conduct making falsehood, making misrepresentation or false claims, conducting acquisition by fraud or by illicit exchange, committing retention or misappropriation, or failing to pay mature debts owed to any international organization or foreign government, in the field of management and use of fiscal funds. | | 2.在财政性资金管理使用领域中存在弄虚作假、虚报冒领、骗取套取、截留挪用、拖欠国际金融组织和外国政府到期债务的严重失信行为责任人； |
(3) Any person liable for seriously dishonest conduct under the following circumstances in the social insurance field: an employer fails to participate in social insurance according to the relevant provisions and refuses to take corrective action; an employer fails to report social insurance premiums base faithfully and refuses to take corrective action; though social insurance premiums are required to be paid, and there is capability of payment, it is refused to make payment; social insurance funds are concealed, transferred, embezzled, misappropriated or invested and operated in violation of provisions; social insurance benefits are acquired by fraud, fabricating supporting documents, or any other means; a social insurance service institution breaches the service agreement or relevant provisions; and a social insurance administrative authority is refused assistance in its investigation and verification of the accident or problem.
