The Provisions on the Administration of the Employment of Taiwan, Hong Kong and Macao Residents in the Mainland, which have been adopted at the tenth executive meeting of the Ministry of Labor and Social Security on June 2, 2005, are hereby promulgated and shall come into force as of October 1, 2005.
 
《台湾香港澳门居民在内地就业管理规定》已于2005年6月2日经劳动和社会保障部第10次部务会议通过,现予公布,自2005年10月1日起施行。

Provisions on the Administration of the Employment of Taiwan, Hong Kong and Macao Residents in the Mainland
 

台湾香港澳门居民在内地就业管理规定


 
Article 1 These Provisions are formulated in accordance with the Labor Law of the People's Republic of China and other relevant laws and administrative regulations for the purpose of maintaining the lawful rights and interests relating to the employment of Chinese citizens who are Taiwan, Hong Kong and Macao residents in the Mainland (hereinafter referred to as the persons from Taiwan, Hong Kong and Macao) and strengthening the administration of the employment of the persons from Taiwan, Hong Kong and Macao by the employing entities in the Mainland.   第一条 为维护台湾居民、香港和澳门居民中的中国公民(以下简称台、港、澳人员)在内地就业的合法权益,加强内地用人单位聘雇台、港、澳人员的管理,根据《中华人民共和国劳动法》和有关法律、行政法规,制定本规定。

 
Article 2 These Provisions shall be applicable to the persons from Taiwan, Hong Kong and Macao and working in the Mainland, the enterprises, public institutions, individual industrial and commercial households and other legally registered organizations in the Mainland (hereinafter referred to as the employing entities) that hire the persons from Taiwan, Hong Kong and Macao or accept the assigned persons from Taiwan, Hong Kong and Macao.   第二条 本规定适用于在内地就业的台、港、澳人员和聘雇或者接受被派遣台、港、澳人员的内地企业事业单位、个体工商户以及其他依法登记的组织(以下简称用人单位)。

If there are other state provisions on the administration of the employment of experts from the regions of Taiwan, Hong Kong and Macao, such provisions shall prevail.
 
台湾、香港、澳门地区专家在内地就业的管理,国家另有规定的,从其规定。

 
Article 3 The “persons from Taiwan, Hong Kong and Macao and working in the Mainland” as mentioned in these Provisions refers to:   第三条 本规定所称在内地就业的台、港、澳人员,是指:

 
(1)the persons that have established labor relationship with the employing entities; (一)与用人单位建立劳动关系的人员;

 
(2)the persons from Hong Kong and Macao that engage in self-employed businesses in the Mainland; and (二)在内地从事个体经营的香港、澳门人员;

 
(3)the persons who have accumulatively worked in a same employing entity in the Mainland for more than three months within one year (from January 1 to December 31 of the Gregorian calendar year) and are assigned by foreign or Taiwan, Hong Kong and Macao employing entities that have established the labor relationship with the aforesaid employing entity in the Mainland. (三)与境外或台、港、澳地区用人单位建立劳动关系并受其派遣到内地一年内(公历年1月1日起至12月31日止)在同一用人单位累计工作三个月以上的人员。

 
Article 4 The employment of the persons from Taiwan, Hong Kong and Macao in the Mainland shall be subject to the employment permit system. In case an employing entity plans to hire the persons from Taiwan, Hong Kong and Macao or accept the assigned persons from Taiwan, Hong Kong and Macao, it shall apply for Employment Permits for Persons from Taiwan, Hong Kong and Macao (hereinafter referred to the employment permits). Any person from Taiwan, Hong Kong or Macao that engages in the individual industrial and commercial household in the Mainland shall apply for an employment permit by himself. The employment of the persons from Taiwan, Hong Kong and Macao in the Mainland upon authorization and with employment permits is protected by law.   第四条 台、港、澳人员在内地就业实行就业许可制度。用人单位拟聘雇或者接受被派遣台、港、澳人员的,应当为其申请办理《台港澳人员就业证》(以下简称就业证);香港、澳门人员在内地从事个体工商经营的,应当由本人申请办理就业证。经许可并取得就业证的台、港、澳人员在内地就业受法律保护。

An archival filing system shall be implemented if an employing entity hires the persons from Taiwan, Hong Kong and Macao or accepts the assigned persons from Taiwan, Hong Kong and Macao.
 
用人单位聘雇或者接受被派遣台、港、澳人员,实行备案制度。

The Ministry of Labor and Social Security shall uniformly print the employment permits.
 
就业证由劳动保障部统一印制。

 
Article 5 When an employing entity hires persons from Taiwan, Hong Kong and Macao or accepts the assigned persons from Taiwan, Hong Kong and Macao, it shall abide by the state laws and regulations.   第五条 用人单位聘雇或者接受被派遣台、港、澳人员,应当遵守国家的法律、法规。

 
Article 6 In case an employing entity plans to hire persons from Taiwan, Hong Kong and Macao or accept the assigned persons from Taiwan, Hong Kong and Macao, the said persons shall:

   第六条 用人单位拟聘雇或者接受被派遣的台、港、澳人员,应当具备下列条件:
