邮政行业安全监督管理办法


(Promulgated by the Ministry of Transport on January 4, 2011, and amended for the Decision of the Ministry of Transport on Amending the Measures for the Supervision and Administration of Security of the Postal Industry by the Order No. 6 [2013] of the Ministry of Transport on April 12, 2013)

Chapter I General Provisions 

第一章 总 则


 
Article 1 To strengthen the supervision and administration of security of the postal industry, maintain the security of postal correspondence and information, protect the legitimate rights and interests of clients, and promote the healthy development of the postal industry, these Measures are formulated in accordance with the Postal Law of the People's Republic of China and other relevant laws and administrative regulations.   第一条 为加强邮政行业安全监督管理,维护邮政通信与信息安全,保护用户合法权益,促进邮政行业健康发展,根据《中华人民共和国邮政法》及有关法律、行政法规,制定本办法。

 
Article 2 These Measures shall apply to the administration, operation and use of postal services, express delivery services and the relevant security activities within the territory of the People's Republic of China.   第二条 在中华人民共和国境内管理、经营和使用邮政服务、快递业务及与此相关的安全活动,适用本办法。

 
Article 3 The supervision and administration of security of the postal industry shall be conducted under the guideline of “security first, giving priority to prevention and comprehensive treatment”, so as to guarantee the smoothness of mail and delivery channels and the security of the mail or delivery of ordinary mails and express mails, and guarantee the work safety of postal enterprises and express delivery enterprises and the personal safety of personnel engaging in the postal industry.   第三条 邮政行业安全监督管理坚持安全第一、预防为主、综合治理的方针,保障寄递渠道畅通和邮件、快件寄递安全,确保邮政企业、快递企业生产安全和邮政行业从业人员人身安全。

 
Article 4 The postal administrative department of the State Council shall be responsible for the supervision and administration of security of the postal industry across the country.   第四条 国务院邮政管理部门负责全国的邮政行业安全监督管理工作。

The postal administrative agencies of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the supervision and administration of security of the postal industry in their respective administrative regions.
 
省、自治区、直辖市邮政管理机构负责本行政区域内的邮政行业安全监督管理工作。

The postal administrative agencies below the provincial level established in accordance with the relevant provisions of the Stat Council shall be responsible for the supervision and administration of security of the postal industry within their respective jurisdictions.
 
按照国务院规定设立的省级以下邮政管理机构负责本辖区的邮政行业安全监督管理工作。

The postal administrative department of the State Council, the postal administrative agencies of provinces, autonomous regions and municipalities directly under the Central Government, and the postal administrative agencies below the provincial level are together referred to as the “postal administrative departments.”
 
国务院邮政管理部门和省、自治区、直辖市邮政管理机构以及省级以下邮政管理机构,统称为邮政管理部门。

 
Article 5 Postal administrative departments shall cooperate with the relevant departments, improve the postal security guarantee mechanism, and strengthen the supervision and administration of postal correspondence and information security.   第五条 邮政管理部门应当与有关部门相互配合,健全邮政安全保障机制,加强对邮政通信与信息安全的监督管理。

 
Article 6 A postal enterprise or an express delivery enterprise shall abide by the provisions of the state on security administration, shall not jeopardize national security, public security, or the legitimate rights and interests of any citizen, legal person or any other organization.   第六条 邮政企业、快递企业应当遵守国家有关安全管理的规定,不得危害国家安全、公共安全和公民、法人、其他组织的合法权益。

 
Article 7 Clients shall, when sending ordinary mails and express mails for mail and delivery, abide by the provisions of the state on the articles prohibited or restricted from mail or delivery, and shall not jeopardize national security, public security, or the legitimate rights and interests of any citizen, legal person or any other organization through mail or delivery channels.   第七条 用户交寄邮件、快件应当遵守国家关于禁止寄递或者限制寄递物品的规定,不得通过寄递渠道危害国家安全、公共安全和公民、法人、其他组织的合法权益。

 
Article 8 No citizen, legal person or other organization may hide, destroy, discard or illegally open ordinary mails and express mails, damage or destroy postal and express delivery service facilities, or affect the normal operation of postal and express delivery service facilities.   第八条 任何公民、法人或者其他组织不得隐匿、毁弃、非法开拆邮件、快件,不得损毁邮政与快递服务设施或者影响邮政与快递服务设施的正常使用。

The relevant citizens, legal persons or other organizations shall cooperate with the postal administrative departments in their supervision and administration of security of the postal industry.
 
有关公民、法人或者其他组织应当配合邮政管理部门实施邮政行业安全监督管理工作。

 
Chapter II Correspondence and Information Security 

第二章 通信与信息安全


 
Article 9 A postal enterprise or an express delivery enterprise shall require a client to truthfully fill out the detailed mail or delivery list, including the names and addresses of the sender and the addressee, the name, category, quantity, etc. of the article sent for mail or delivery, shall verify the information on the sender and addressee, and accurately indicate the weight of and charges for the ordinary mail or express mail. Where the postal administrative department of the State Council requires senders to show their ID certificates, the postal enterprise or express delivery enterprise shall require the client to show his effective ID certificate.   第九条 邮政企业、快递企业应当提示用户如实填写寄递详情单,包括寄件人、收件人名址和寄递物品的名称、类别、数量等,并核对寄件人和收件人信息,准确注明邮件、快件的重量、资费。国务院邮政管理部门规定寄件人出具身份证明的,邮政企业、快递企业应当要求用户出示有效身份证件。

A postal enterprise or an express delivery enterprise shall check the article sent for mail or delivery in the presence of the client, and check whether such article is prohibited or restricted by the state from mail or delivery, and whether the name, category, quantity, etc. of the article are consistent with those filled out in the detailed delivery list. Where the client needs to provide the relevant written certificate according to the relevant provisions of the state, the postal enterprise or express delivery enterprise shall require the client to provide the original certificate, and accept and mail or deliver the relevant article if no mistake is found.
 
邮政企业、快递企业应当在用户在场的情况下,当面验视交寄物品,检查是否属于国家禁止或限制寄递的物品,以及物品的名称、类别、数量等是否与寄递详情单所填写的内容一致。依照国家规定需要用户提供有关书面凭证的,邮政企业、快递企业应当要求用户提供凭证原件,核对无误后,方可收寄。

Where the client refuses to accept the check, refuses to truthfully fill out the detailed delivery list, refuses to provide the relevant written certificate, or refuses to show his effective ID certificate as required, the postal enterprise or express delivery enterprise shall not accept and mail or deliver the relevant article.
 
用户拒绝验视、拒不如实填写寄递详情单、拒不提供相应书面凭证或者不按照规定出示有效身份证件的,邮政企业、快递企业不予收寄。

 
Article 10 Where a postal enterprise or an express delivery enterprise finds during the process of receiving mails for mail or delivery that a client sends any article whose mail or delivery is prohibited by the state, it shall refuse to accept and mail or deliver such article. Where the aforesaid article is found in a ordinary mail or express mail which has been accepted and mailed or delivered, the postal enterprise or express delivery enterprise shall immediately stop forwarding and delivering such article.   第十条 邮政企业、快递企业在收寄过程中发现用户交寄国家禁止寄递的物品的,应当拒绝收寄。已经收寄的邮件、快件中发现有上述物品的,邮政企业、快递企业应当立即停止转发和投递。

Where any article thereof needs to be confiscated or destroyed according to law, the postal enterprise or express delivery enterprise shall immediately report to the relevant department, and cooperate with the relevant department in dealing with such article.
 
对其中依法需要没收或者销毁的物品,应当立即向有关部门报告,并配合有关部门进行处理。

For the article which has been accepted for delivery but does not need to be confiscated or destroyed, or the article other than that prohibited from delivery found together with the latter, the postal enterprise or express delivery enterprise shall contact the sender or the addressee and properly deal with such article.
 
对已经收寄的不需要没收、销毁的禁寄物品以及一同查处的禁寄物品之外的物品,邮政企业、快递企业应当与寄件人或者收件人取得联系,妥善处理。

 
Article 11 No express delivery enterprise shall engage in the correspondence delivery business exclusively operated by postal enterprises, or deliver official documents of state organs.   第十一条 快递企业不得经营由邮政企业专营的信件寄递业务,不得寄递国家机关公文。

No foreign businessman shall invest or engage in the express delivery of correspondence within China.
 
外商不得投资经营信件的国内快递业务。

 
Article 12 A postal enterprise or an express delivery enterprise shall properly deliver ordinary mails and express mails. If the addressee needs to sign to confirm the receipt, the postal enterprise or express delivery enterprise shall directly deliver the mail to the addressee, go through the receipt formalities by signature, or have the mail accepted and signed by another person on behalf of the addressee according to law.   第十二条 邮政企业、快递企业应当妥善投递邮件、快件。需要签收的,邮政企业、快递企业应当直接交付收件人,并办理签收手续,或者依法由他人代为签收。

Organs, enterprises and public institutions, residential area management entities, etc. shall provide conveniences for the delivery of mails by postal enterprises, and guarantee the security of the mails which are signed and accepted on behalf of the addresses.
 
机关、企事业单位、住宅小区管理单位等应当为邮政企业投递邮件提供便利,并保障代收代投邮件的安全。

 
Article 13 A postal enterprise or an express delivery enterprise shall take technical means to monitor the security of mail acceptance, sorting, transport, delivery and other links so as to prevent the missing, loss, damage or destruction of ordinary mails and express mails during the mail or delivery process.   第十三条 邮政企业、快递企业应当采用技术手段,对收寄、分拣、运输、投递等环节实行安全监控,防止邮件、快件在寄递过程中短少、丢失、损毁。

Monitoring equipment shall be operated on a round-the-clock basis every day, and the monitoring data shall be kept for at least 30 days and be submitted according to the requirements of the postal administrative department of the State Council.
 
监控设备应当全天二十四小时运转,监控资料保存时间不得少于三十天,并按照国务院邮政管理部门的要求报送。

 
Article 14 A postal enterprise or an express delivery enterprise shall safeguard the information security and correspondence secrets of clients, and ensure that the information on a client's use of postal services or express delivery services will not be stolen or disclosed. Without specific legal authorization or the written consent of the client, the postal enterprise or express delivery enterprise shall not provide the information on the client's use of postal services or express delivery services to any other organization or individual, unless under the circumstances that a public security organ, national security organ or procuratorial organ performs its functions and powers according to law.   第十四条 邮政企业、快递企业应当保护用户的信息安全和通信秘密,确保所掌握的用户使用邮政服务、快递业务的信息不被窃取、泄露。未经法律明确授权或者用户书面同意,邮政企业、快递企业不得将用户使用邮政服务、快递业务的信息提供给任何组织或者个人,但公安机关、国家安全机关、检察机关依法行使职权的除外。

 
Article 15 A postal enterprise or an express delivery enterprise shall have security inspection equipment in compliance with the national standards, and appoint personnel who have expertise and skills to conduct security inspection of ordinary mails and express mails. The standards for security inspection equipment shall be formulated separately by the postal administrative department of the State Council jointly with the relevant departments.   第十五条 邮政企业、快递企业应当配备符合国家标准的安全检查设备,安排具备专门技术和技能的人员对邮件、快件进行安全检查。安全检查设备的标准由国务院邮政管理部门会同有关部门另行制定。

 
Article 16 A postal enterprise or an express delivery enterprise shall collect, conduct statistics on and analyze operating information according to the items prescribed by the postal administrative department, ensure the authenticity and completeness of the relevant data, and submit them to the postal administrative department on time.   第十六条 邮政企业、快递企业应当按照邮政管理部门规定的项目收集、统计、分析运营信息,确保有关数据的真实、完整,并按时向邮政管理部门报送。

A postal enterprise or an express delivery enterprise shall reserve the corresponding data interface for connecting to the information management system of the postal administrative department, and connect its network with the information management system of the postal administrative department as required.
 
邮政企业、快递企业应当为接入邮政管理部门的信息管理系统预留相应的数据接口,并按规定与邮政管理部门的信息管理系统联网。

 
Article 17 A postal enterprise or an express delivery enterprise shall cooperate with the postal administrative department, public security organ and national security organ in their security supervision and inspection, and provide corresponding conveniences to supervisors and inspectors.   第十七条 邮政企业、快递企业应当配合邮政管理部门、公安机关和国家安全机关的安全监督检查,为监督检查人员提供相应的便利条件。

A postal enterprise or an express delivery enterprise shall design and build ordinary mail or express mail processing centers according to the requirements for the national security organs and customs to perform their functions according to law.
 
邮政企业、快递企业设计和建设邮件、快件处理场所,应当符合国家安全机关、海关依法履行职责的要求。

 
Article 18 A postal enterprise or an express delivery enterprise shall ensure the smoothness of its mail or delivery channels.   第十八条 邮政企业、快递企业应当保障本企业寄递渠道的畅通。

Where any natural disaster, social event, work safety accident, poor business operation, etc. causes or may cause the backlog of ordinary mails or express mails, the postal enterprise or express delivery enterprise shall timely organize and allocate transportation resources to effectively relieve the backlog.
 
因自然灾害、社会事件、生产安全事故、经营不善等造成或者可能造成邮件、快件积压的,邮政企业、快递企业应当及时组织和调配运力,进行有效疏运。

 
Article 19 A postal enterprise or an express delivery enterprise, or any of its branches or employees shall not illegally detain any ordinary mail or express mail.   第十九条 邮政企业、快递企业及其分支机构、从业人员不得非法扣留邮件、快件。

 
Article 20 The postal administrative department shall coordinate the handling of the backlogged or detained ordinary mails or express mails, and when necessary, may organize other postal enterprises or express delivery enterprises to transport and deliver them, and the expenses incurred therefor shall be borne by the postal enterprise or express delivery enterprise which has caused the backlog or detention of ordinary mails or express mails.   第二十条 邮件、快件积压或者被扣留的,邮政管理部门应当协调处理,必要时可以组织邮政企业、快递企业运输、投递,由此产生的费用由邮件、快件积压或者被扣留的邮政企业、快递企业承担。

 
Chapter III Work Safety 

第三章 生产安全


 
Article 21 A postal enterprise or an express delivery enterprise shall abide by these Measures and other relevant provisions on work safety, strengthen work safety administration, establish a sound work safety responsibility system, improve the conditions for work safety, and ensure work safety.   第二十一条 邮政企业、快递企业应当遵守本办法和其他有关安全生产的规定,加强安全生产管理,建立、健全安全生产责任制度,完善安全生产条件,确保生产安全。

 
Article 22 A postal enterprise or an express delivery enterprise shall abide by the laws, regulations and standards of the state on work safety and clarify work safety management responsibilities.
