中国证券投资基金业协会、中国证券业协会关于发布《基金参与融资融券及转融通证券出借业务指引》的通知

各有关单位：
为落实《关于大力推进证券投资基金行业创新发展的意见》，支持基金依法参与融资融券、转融通证券出借业务，中国证券投资基金业协会、中国证券业协会制定了《基金参与融资融券及转融通证券出借业务指引》。经中国证券投资基金业协会第一届理事会、中国证券业协会第五届常务理事会分别表决通过，现予发布。

基金参与融资融券及转融通证券出借业务指引
　　第一条　【法律依据】为规范公开募集证券投资基金（以下简称基金）参与融资融券及转融通证券出借交易的行为，防范投资风险，保护基金份额持有人的合法权益，根据《证券投资基金法》、《公开募集证券投资基金运作管理办法》（证监会令第104号）等法律法规和行业协会相关自律规则，制定本指引。
　　第二条　【业务定义】本指引所称融资融券交易及转融通证券出借交易根据《证券公司融资融券业务管理办法》、《转融通业务监督管理试行办法》定义。
