| Decision of the Ministry of Justice on Amending the Measures for the Administration of Representative Offices of Law Firms of the Hong Kong Special Administrative Region and the Macao Special Administrative Region Stationed in the Mainland | | 司法部关于修改《香港、澳门特别行政区律师事务所驻内地代表机构管理办法》的决定 |
| To carry out the requirements of the State Council for promoting the administrative approval system reform, and regulate the administration of law firms of the Hong Kong Special Administrative Region and the Macao Special Administrative Region stationed in the mainland, in accordance with the Decision of the State Council on Canceling or Adjusting a Group of Administrative Approval Items and Other Matters (No. 27 [2014], State Council), the Ministry of Justice hereby decides to amend the Measures for the Administration of Representative Offices of Law Firms of the Hong Kong Special Administrative Region and the Macao Special Administrative Region Stationed in the Mainland (issued by Order No. 70 of the Ministry of Justice on March 13, 2002, and amended by Order No. 84 of the Ministry of Justice on November 30, 2003 and Order No. 104 of the Ministry of Justice on December 22, 2006) as follows: | | 为了贯彻落实国务院关于推进行政审批制度改革的要求，规范对香港、澳门特别行政区律师事务所驻内地代表机构的管理，根据《国务院关于取消和调整一批行政审批项目等事项的决定》（国发[2014]27号），决定对《香港、澳门特别行政区律师事务所驻内地代表机构管理办法》（2002年3月13日司法部令第70号发布，2003年11月30日司法部令第84号、2006年12月22日司法部令第104号修正）作如下修改： |
| I. Paragraph 1 of Article 6 is amended to read: “To form a representative office in or assign a representative to the mainland, a Hong Kong or Macao law firm shall obtain the approval of the department (bureau) of justice of the province, autonomous region or municipality directly under the Central Government.” | | 一、将第六条第一款修改为：“港澳律师事务所在内地设立代表处、派驻代表，应当经省、自治区、直辖市司法厅（局）许可。” |
| II. Article 9 is amended to read: “The department (bureau) of justice of a province, autonomous region or municipality directly under the Central Government shall complete examination and make a decision within six months of receipt of the application documents and materials, issue a practicing license to the representative office approved to be formed, issue practicing certificates to the representatives thereof, and handle registration formalities at the same time; and shall notify the applicant of the reason for disapproval in a written form if it makes a disapproval decision.” | | 二、将第九条修改为：“省、自治区、直辖市司法厅（局）应当自收到申请文件材料之日起6个月内审查完毕并作出决定，对许可设立的代表处发给执业执照，并对其代表发给执业证书，同时办理注册手续；对不予许可的，应当书面告知其理由。” |
| III. Article 10 is amended to read: “A representative office and its representatives shall register once each year. | | 三、将第十条修改为：“代表处及其代表每年应当注册一次。 |
| The department (bureau) of justice of the province, autonomous region or municipality directly under the Central Government shall handle registration formalities within two days of receipt of the registration application.” | | 省、自治区、直辖市司法厅（局）应当自接到注册申请之日起2日内办理注册手续。” |
IV. Article 12 is amended to read: “Where a Hong Kong or Macao law firm needs to modify the name of its representative office or reduce its representatives, it shall submit in advance a written application signed by its principal person in charge and the relevant documents and materials to the department (bureau) of justice of the province, autonomous region or municipality directly under the Central Government at the place of domicile of the representative office, and withdraw the practicing certificate of the person who no longer serves as the representative with the confirmation of the department (bureau) of justice of the province, autonomous region or municipality directly under the Central Government.
．．．．．． | | 四、将第十二条修改为：“港澳律师事务所需要变更代表处名称、减少代表的，应当事先向代表处住所地的省、自治区、直辖市司法厅（局）提交其主要负责人签署的申请书和有关的文件材料，经省、自治区、直辖市司法厅（局）核准，并收回不再担任代表的人员的执业证书。
