Article 1 These Provisions have been formulated in accordance with the Labor Law, the Law on Sino-foreign Equity Joint Enterprises and the Law on Sino-foreign Cooperative Enterprises | | 第一条 为规范中外合资、中外合作职业介绍机构的设立，保障求职者和用人单位的合法权益，根据劳动法、中外合资经营企业法和中外合作经营企业法的有关规定， 制定本规定。 |
| Article 2 These Provisions shall be observed in the establishment of sino-foreign equity joint and sino-foreign cooperative institutions for the purpose of job intermediary activities. | | 第二条 设立从事职业介绍的中外合资、中外合作机构应当按照本规定执行。 |
| Article 3 The administrative departments of labor and social security, the administrative departments of foreign trade and economic relations and the administrations for industry and commerce shall, within their respective functions and duties, be responsible for the approval, registration, administration, supervision and inspection of sino-foreign equity joint and sino-foreign cooperative job intermediary institutions. | | 第三条 劳动保障行政部门、外经贸行政部门和工商行政管理部门在各自职权范围内负责中外合资、中外合作职业介绍机构的审批、登记、管理和监督检查工作。 |
| To set up a Chinese-foreign equity joint venture or Chinese-foreign contractual joint venture job intermediary agency, the approval of the administrative department of labor and social security of the people's government at the provincial level (hereinafter referred to as “labor and social security department at the provincial level”) shall be obtained, after the approval of the administrative department of foreign trade and economic cooperation of the people's government at the provincial level (hereinafter referred to as the “administrative department of foreign trade and economic cooperation at the provincial level”) is obtained and registration is gone through at the local administration for industry and commerce at the place of domicile of the agency to be established that is authorized by the State Administration for Industry and Commerce. | | 设立中外合资、中外合作职业介绍机构应当经省级人民政府外经贸行政部门（以下简称省级外经贸行政部门）批准，到企业住所地国家工商行政管理总局授权的地方工商行政管理局进行登记注册后，由省级人民政府劳动保障行政部门（以下简称省级劳动保障行政部门）批准。 |
| No solely foreign-funded job intermediary institution may be established. | | 不得设立外商独资职业介绍机构。 |
| The representative offices of foreign enterprises in China and the foreign chambers of commerce established in China may not engage in any job intermediary activities. | | 外国企业常驻中国代表机构和在中国成立的外国商会不得在中国从事职业介绍服务。 |
Article 4 The sino-foreign equity joint and sino-foreign cooperative job intermediary institutions shall carry out their business activities on the basis of law, and their lawful business activities shall be subject to the protection of Chinese law.
