| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 For purposes of strengthening the administration of the news and publication license (hereinafter referred to as the “license”), regulating the order of the news and publication market, and protecting the lawful rights and interests of citizens, legal persons and other organizations, these Measures are developed in accordance with the Administrative Licensing Law of the People's Republic of China, the Publication Management Regulation, the Regulation on the Administration of Audio and Video Recordings, the Regulation on the Administration of the Printing Industry, and other relevant laws and regulations. | | 第一条 为加强新闻出版许可证（以下简称许可证）管理，规范新闻出版市场秩序，维护公民、法人和其他组织的合法权益，根据《中华人民共和国行政许可法》《出版管理条例》《音像制品管理条例》《印刷业管理条例》等相关法律、法规制定本办法。 |
| Article 2 For the purpose of these Measures, “license” means the administrative license issued by the press and publication administrative department upon legal examination based on the application of a citizen, legal person or any other organization, which approves his or its news and publication activities. | | 第二条 本办法所称许可证，是指新闻出版行政部门根据公民、法人或其他组织的申请，经依法审查，准予其从事新闻出版活动的行政许可证件。 |
| These Measures shall apply to the administration of establishment, design, printing, production, issuance, use, replacement, reissuance, modification, and cancellation, among others, of licenses. | | 许可证的设立、设计、印刷、制作、发放、使用、换发、补发、变更、注销等管理适用本办法。 |
| Article 3 Press and publication administrative departments shall observe the principles of legality, openness, standardization and convenience for the people in license administration. | | 第三条 新闻出版行政部门在许可证管理中应当遵循依法、公开、规范、便民的原则。 |
| No relevant fees involving the license shall be collected from administrative counterparts in any name or form without the basis of laws and regulations. | | 无法律法规依据，不得以任何名义和形式向行政相对人收取涉及许可证的相关费用。 |
| Article 4 The SARFT shall be responsible for performing such functions as the supervision and inspection, uniform recordation and information publication of news and publication licenses nationwide; and local press and publication administrative departments shall be responsible for performing the functions of supervision and inspection of licenses within their respective jurisdictions. | | 第四条 国家新闻出版广电总局负责全国新闻出版许可证监督检查、统一备案和信息公示等职责；地方新闻出版行政部门负责本辖区许可证的监督检查职责。 |
| Press and publication administrative departments at all levels shall be responsible for the publication of issued, canceled or revoked licenses on government websites or newspapers approved to be distributed to the public. | | 各级新闻出版行政部门负责对所发放、注销、吊销的许可证在政府网站或经批准公开发行的报纸上进行公示。 |
| Chapter II Establishment, Design, Printing, Production and Issuance of Licenses | | 第二章 许可证的设立、设计、印刷、制作与发放 |
| Article 5 “Establishment of a license” means that a decision is made to issue a license as the licensing certificate for a lawfully determined administrative licensing item. | | 第五条 许可证设立，是指对依法设定的行政许可项目，决定以颁发许可证的形式作为许可证件。 |
| The establishment of a license must be based on an administrative licensing set in accordance with laws and regulations. | | 许可证设立，必须以法律法规设定的行政许可为依据。 |
| Article 6 “Design of a license” means the design of registration items and format of a license. Its validity term shall be provided for when it is designed. | | 第六条 许可证设计，是指对许可证的登记项目和样式进行的设计。设计许可证时须规定其有效期限。 |
| The SARFT shall be responsible for the establishment and design of all types of licenses. | | 国家新闻出版广电总局负责各类许可证的设立与设计。 |
| Article 7 “Printing of a license” means the printing of a paper license excluding registration content or the photocopying of an electronic license without registration content according to the design format of a license. | | 第七条 许可证印刷，是指按照许可证的设计样式，印刷不含登记内容的纸质许可证或复制不含登记内容的电子许可证。 |
| In principle, the press and publication administrative department implementing administrative licensing shall be responsible for the printing of a license, and the press and publication administrative department at a higher level may uniformly print the license according to the actual circumstances. | | 许可证的印刷原则上由实施行政许可的新闻出版行政部门负责，根据实际情况也可由上级新闻出版行政部门统一印刷。 |
| Article 8 “Production of license” means the entry, seal affixing, and sealing, among others, of content on a blank license. | | 第八条 许可证制作，是指空白许可证的内容填写、盖章、封装等。 |
| A license must be produced after the press and publication administrative department makes an administrative licensing approval decision in accordance with the law or undergoes reissuance or replacement formalities according to these Measures and the relevant provisions. | | 许可证须由新闻出版行政部门依法作出行政许可批准决定或按本办法及有关规定履行补发、换发手续后制作。 |
| The content of the licensed registration content of a license must be consistent with the content of an administrative licensing decision. A license shall not be handed to the administrative counterpart for entry of content or be entered by any other institution on behalf of the press and publication administrative department. | | 许可证的许可登记项目内容必须与行政许可决定内容相一致。许可证不得交由行政相对人自行填写或由其他机构代为填写。 |
| In the case of modification of any matter registered in a license, the press and publication administrative department that undergoes modification registration formalities shall affix the special modification seal to the corresponding position of the license. | | 许可证登记事项发生变更的，由办理变更登记的新闻出版行政部门在许可证相应位置加盖变更专用章。 |
| After the official seal or special modification seal of the press and publication administrative department that implements administrative licensing or undergoes modification registration formalities is affixed to a license, the original and the duplicate shall have equal legal force, and no any other department or entity shall affix the official seal to the license. | | 许可证加盖实施行政许可的或办理变更登记的新闻出版行政部门公章或变更专用章后，正本、副本具有同等的法律效力，其他任何部门或单位不得在许可证上加盖公章。 |
| Article 9 “Issuance of a license” means serving a license upon the administrative counterpart. | | 第九条 许可证发放，是指将许可证送达行政相对人。 |
| In principle, a license shall be issued by the press and publication administrative department implementing administrative licensing. For the purpose of providing convenience to the administrative counterpart, it may be issued by the press and publication administrative department at a lower level legally authorized by the press and publication administrative department implementing administrative licensing. | | 许可证原则上由实施行政许可的新闻出版行政部门发放。为方便行政相对人，也可由实施行政许可的新闻出版行政部门依法委托下级新闻出版行政部门代为发放。 |
| The press and publication administrative department shall serve the license upon the administrative counterpart within ten working days as of making an administrative licensing approval decision. | | 新闻出版行政部门应当自作出行政许可批准决定之日起10个工作日内，将许可证送达行政相对人。 |
| Where the press and publication administrative department at the lower level is authorized to issue a license, it shall serve the license upon the administrative counterpart within four working days as of receipt of the administrative licensing approval decision and the license, and shall not require the administrative counterpart to undergo license collection application formalities separately. | | 委托发放许可证的，下级新闻出版行政部门应自收到行政许可批准决定和许可证后4个工作日内送达行政相对人，并不得要求行政相对人另行办理许可证申领手续。 |
