The Interpretation of the Supreme People's Court onSeveral Issues concerning the Specific Application of Law in the Trial of Criminal Cases on Illegal or Destructive Mining, as adopted at the 1,270th meeting of the Judicial Committee of the Supreme People's Court on May 16, 2003, is hereby issued, and shall come into force on June 3, 2003. 《最高人民法院关于审理非法采矿、破坏性采矿刑事案件具体应用法律若干问题的解释》已于2003年5月16日由最高人民法院审判委员会第1270次会议通过。现予公布,自2003年6月3日起施行。

Interpretation of the Supreme People's Court onSeveral Issues concerning the Specific Application of Law in the Trial of Criminal Cases on Illegal or Destructive Mining 最高人民法院关于审理非法采矿、破坏性采矿刑事案件具体应用法律若干问题的解释
(Adopted at the 1,270th meeting of the Judicial Committee of the Supreme People's Court on May 16, 2003) (2003年5月16日最高人民法院审判委员会第1270次会议通过)
In order to punishthe criminal activities of illegal and destructive mining, in accordance with the relevant provisions of the Criminal Law, several issues concerning the specific application of law in the trial of such criminal cases are hereby interpreted as follows: 为依法惩处非法采矿、破坏性采矿犯罪活动,根据刑法有关规定,现就审理这类刑事案件具体应用法律的若干问题解释如下:
Article 1 Whoever conducts illegal miningunder any of the following circumstances in violation of the provisions of the Mineral Resources Law and refuses to stop mining after it is ordered to do so, resulting in any damage to mineral resources, shall be convicted and punishedfor the crime ofillegal mining in accordance with the provisions of Paragraph 1, Article 343 of the Criminal Law:   第一条 违反矿产资源法的规定非法采矿,具有下列情形之一,经责令停止开采后拒不停止开采,造成矿产资源破坏的,依照刑法三百四十三条第一款的规定,以非法采矿罪定罪处罚:
(1) Engaging in mining without a mining permit. (一)未取得采矿许可证擅自采矿;
(2) Enteringwithout authorization a mining area under state planning, a mining area of great value to the national economy or a mining area of any other person. (二)擅自进入国家规划矿区、对国民经济具有重要价值的矿区和他人矿区范围采矿;
(3) Engaging without authorization in the mining of a special mineral which is subject to protective excavation as prescribed by the state. (三)擅自开采国家规定实行保护性开采的特定矿种。
Article 2 Any of the following circumstances shall fall within the scope of “engaging in mining without a mining permit” as prescribed in Item (1), Article 1 of this Interpretation:
