The “Provisions of the People's Republic of China on Safety Supervision and Administration of Carriage of Dangerous Goods by Vessels”, which were adopted at the 15th executive meeting on November 21, 2003, are hereby promulgated, and shall come into force on January 1, 2004. | |

| Chapter I General Provisions | | 第一章 总则 |

| Article 1 These Provisions are formulated in accordance with the “Law of the People's Republic of China on Maritime Traffic Safety”, the “Law of the People's Republic of China on Marine Environmental Protection”, the “Law of the People's Republic of China on Ports”, the “Regulation of the People's Republic of China on the Administration of Traffic Safety on Inland Waters”, the “Regulation of the People's Republic of China on the Safety Administration of Dangerous Chemicals” and other relevant international conventions for the purpose of strengthening the supervision and administration of carriage of dangerous goods by vessels, guaranteeing the safety of the lives of people and of the properties on water, and preventing vessels from polluting the environment. | | 第一条 为加强船舶载运危险货物监督管理，保障水上人命、财产安全，防止船舶污染环境，依据《中华人民共和国海上交通安全法》、《中华人民共和国海洋环境保护法》、《中华人民共和国港口法》、《中华人民共和国内河交通安全管理条例》、《中华人民共和国危险化学品安全管理条例》和有关国际公约的规定，制定本规定。 |

| Article 2 These Provisions shall apply to the carriage of dangerous goods by vessels within the water areas under jurisdiction of the People's Republic of China. | | 第二条 本规定适用于船舶在中华人民共和国管辖水域载运危险货物的活动。 |

| Article 3 The Ministry of Communications shall be in charge of the safety administration of carriage of dangerous goods by vessels throughout China. The Maritime Safety Administration of the People's Republic of China shall take charge of safety supervision and administration of carriage of dangerous goods by vessels. | | 第三条 交通部主管全国船舶载运危险货物的安全管理工作。中华人民共和国海事局负责船舶载运危险货物的安全监督管理工作。 |
The maritime administrative institution directly under the Ministry of Communications and the maritime administrative institution at each level under the traffic administrative department of the local people's government shall, in accordance with the relevant laws, regulations and these Provisions, specifically take charge of the safety supervision and administration of carriage of dangerous goods by vessels within their respective jurisdictions. | |
交通部直属和地方人民政府交通主管部门所属的各级海事管理机构依照有关法律、法规和本规定，具体负责本辖区船舶载运危险货物的安全监督管理工作。 |

| Article 4 The carriage of dangerous goods by vessels must conform to the provisions of the state on work safety, on-water traffic safety, and prevention and control of vessel pollution. The vessel concerned shall guarantee the safety of the crew and properties, and prevent damage from being caused to the environment, resources, or other vessels and facilities. | | 第四条 船舶载运危险货物，必须符合国家安全生产、水上交通安全、防治船舶污染的规定，保证船舶人员和财产的安全，防止对环境、资源以及其他船舶和设施造成损害。 |

| Article 5 It is prohibited to make use of the navigation channels such as inland waters or other closed water areas to transport virulent chemicals and other dangerous chemicals prohibited from transportation as prescribed by the Ministry of Communications. | | 第五条 禁止利用内河以及其他封闭水域等航运渠道运输剧毒化学品以及交通部规定禁止运输的其他危险化学品。 |
It is prohibited to secretly carry dangerous goods among ordinary goods, and no one may conceal reporting or falsely report dangerous goods as ordinary goods. | |
禁止在普通货物中夹带危险货物，不得将危险货物匿报或者报为普通货物。 |
A vessel for which the certificate of fitness for the carriage of dangerous goods has not been obtained or a vessel over the service life prescribed by the Ministry of Communications shall be prohibited from carrying dangerous goods. | |
禁止未取得危险货物适装证书的船舶以及超过交通部规定船龄的船舶载运危险货物。 |

| Chapter II Administration of Navigation Safety and of Prevention of Pollution | | 第二章 通航安全和防污染管理 |

| Article 6 Where a vessel carrying dangerous goods navigates, berths or undertakes operations on the water area under the jurisdiction of China, it shall abide by the provisions promulgated by the Ministry of Communications and those legally promulgated by the maritime administrative institution within the scope of powers on water traffic safety and on prevention and control of vessel pollution. | | 第六条 载运危险货物的船舶在中国管辖水域航行、停泊、作业，应当遵守交通部公布的以及海事管理机构在其职权范围内依法公布的水上交通安全和防治船舶污染的规定。 |
The maritime administrative institution shall supervise the vessels which carry dangerous goods and navigate, berth or undertake operations on the water areas under the jurisdiction of China. | |
对在中国管辖水域航行、停泊、作业的载运危险货物的船舶，海事管理机构应当进行监督。 |

| Article 7 A vessel carrying dangerous goods shall select a navigable environment meeting the safety requirements to navigate, berth or undertake operations, and shall take the safety of other vessels navigating, berthing or undertaking operations nearby and of the port or facilities alongshore into consideration, so as to prevent the environment from being polluted. If the maritime administrative institution prescribes any special navigation channel or navigation route for vessels carrying dangerous goods, the vessels carrying dangerous goods shall navigate in accordance with such provisions. | | 第七条 载运危险货物的船舶应当选择符合安全要求的通航环境航行、停泊、作业，并顾及在附近航行、停泊、作业的其他船舶以及港口和近岸设施的安全，防止污染环境。海事管理机构规定危险货物船舶专用航道、航路的，载运危险货物的船舶应当遵守规定航行。 |
Where a vessel carrying dangerous goods passes through a narrow or crowded navigation channel or navigation route, or navigates, berths or undertakes operations under the conditions of abominable climate or stormy waves, the watch shall be strengthened, the vessel shall be operated carefully, and the corresponding safety measures and pollution-prevention measures shall be taken. When necessary, it shall ensure such emergency precautionary measures as having auxiliary vessels wait for precaution instructions, etc. or asking the maritime administrative institution for navigation guidance or protection. | |
载运危险货物的船舶通过狭窄或者拥挤的航道、航路，或者在气候、风浪比较恶劣的条件下航行、停泊、作业，应当加强了望，谨慎操作，采取相应的安全、防污措施。必要时，还应当落实辅助船舶待命防护等应急预防措施，或者向海事管理机构请求导航或者护航。 |
A vessel carrying explosives, radioactive articles, organic peroxides, flammable liquid whose flash point is below 28℃ or liquefied gas shall not be mixed with other barges for towage in a queue. | |
载运爆炸品、放射性物品、有机过氧化物、闪点28℃以下易燃液体和液化气的船，不得与其他驳船混合编队拖带。 |
With respect to the vessels carrying dangerous goods, if their working capacities are restricted, the maritime administrative institution shall direct the flow of traffic, and may, when necessary, practice corresponding traffic control. | |
对操作能力受限制的载运危险货物的船舶，海事管理机构应当疏导交通，必要时可实行相应的交通管制。 |

| Article 8 A vessel carrying dangerous goods shall, when navigating, berthing or undertaking operations, show its signals in accordance with the provisions. | | 第八条 载运危险货物的船舶在航行、停泊、作业时应当按规定显示信号。 |
If another vessel meets with a vessel carrying dangerous goods, it shall pay attention to taking the corresponding action as soon as possible in accordance with the navigation provisions and the rules for preventing collisions. | |
其他船舶与载运危险货物的船舶相遇，应当注意按照航行和避碰规则的规定，尽早采取相应的行动。 |

| Article 9 In a water area controlled by a vessel traffic service (VTS) center, the vessels shall report to the VTS center in accordance with the provisions, and accept the instructions of the law enforcers of this center. | | 第九条 在船舶交通管理（VTS）中心控制的水域，船舶应当按照规定向交通管理（VTS）中心报告，并接受该中心海事执法人员的指令。 |
The maritime administrative institution shall mark and follow the vessels carrying dangerous goods and reporting for entering the water area controlled by the vessel traffic service (VTS) center. If the maritime administrative institution finds that any vessel navigates, berths or undertakes operations in violation of rules, or considers that the vessel might impact the safety of other vessels, it shall send a warning in time, and may, when necessary, take corresponding compulsory measures in accordance with the law. | |
对报告进入船舶交通管理（VTS）中心控制水域的载运危险货物的船舶，海事管理机构应当进行标注和跟踪，发现违规航行、停泊、作业的，或者认为可能影响其他船舶安全的，海事管理机构应当及时发出警告，必要时依法采取相应的强制措施。 |
The vessel traffic service (VTS) center shall provide corresponding information services on water traffic safety to the vessels reporting the carriage of dangerous goods. | |
船舶交通管理（VTS）中心应当为向其报告的载运危险货物的船舶提供相应的水上交通安全信息服务。 |

| Article 10 In a water area where the vessel's routing system is practiced, the vessels carrying dangerous goods shall abide by the provisions of the vessel's routing system, and navigate along the prescribed navigation routes. | | 第十条 在实行船舶定线制的水域，载运危险货物的船舶应当遵守船舶定线制规定，并使用规定的通航分道航行。 |
In a water area where the position report system is practiced, the vessels carrying dangerous goods shall join the position report system in accordance with the provisions of the maritime administrative institution. | |
在实行船位报告制的水域，载运危险货物的船舶应当按照海事管理机构的规定，加入船位报告系统。 |

| Article 11 Where a vessel carrying dangerous goods undertakes lighterage operations on water, it shall conform to the administrative provisions and technical criteria of the state on water traffic safety and on preventing vessels from polluting the environment, select water areas with slow flow of water, easy to be sheltered from wind, and with suitable water depth and bottom characteristics, etc., and try to be far from populated areas, crowded navigable areas, navigation channels, important civil targets or facilities, and military water areas. It shall also formulate safety measures and pollution-prevention measures and the emergency plan, and guarantee the effective implementation thereof. | | 第十一条 载运危险货物的船舶从事水上过驳作业，应当符合国家水上交通安全和防止船舶污染环境的管理规定和技术规范，选择缓流、避风、水深、底质等条件较好的水域，尽量远离人口密集区、船舶通航密集区、航道、重要的民用目标或者设施、军用水域，制定安全和防治污染的措施和应急计划并保证有效实施。 |

| Article 12 Where a vessel carrying dangerous goods undertakes lighterage of dangerous goods within the water area of a port, it shall file an application to the port administrative department in accordance with the relevant provisions of the Ministry of Communications. The port administrative department shall, at the time of examination and approval, get the consent of the maritime administrative institution regarding the water area for the vessel to undertake lighterage operations. | | 第十二条 载运危险货物的船舶在港口水域内从事危险货物过驳作业，应当根据交通部有关规定向港口行政管理部门提出申请。港口行政管理部门在审批时，应当就船舶过驳作业的水域征得海事管理机构的同意。 |
Where a vessel carrying liquid dangerous goods in bulk undertakes maritime lighterage of dangerous goods out of the water area of a port, the vessel or its owner, operator or manager shall legally apply to the maritime administrative institution for approval. | |
载运散装液体危险性货物的船舶在港口水域外从事海上危险货物过驳作业，应当由船舶或者其所有人、经营人或者管理人依法向海事管理机构申请批准。 |
With respect to the water areas for vessels to undertake lighterage of dangerous goods on water, the maritime administrative institution shall publish and promulgate navigation warnings or navigation circulars. | |
船舶从事水上危险货物过驳作业的水域，由海事管理机构发布航行警告或者航行通告予以公布。 |

Article 13 To apply for engaging in maritime lighterage of dangerous goods by single voyage out of the water area of a port, the applicant shall file the application to the maritime administrative institution 24 hours in advance; while to apply for engaging in multi-voyage lighterage of dangerous goods in a certain sea area out of the water area of the port, the applicant shall file a written application to the maritime administrative institution 7 days in advance.
