Preamble 序  言
The States Parties to this Protocol, 本议定书缔约国,
Aware of the urgent need to prevent, combat and eradicate the illicit manufacturing of and trafficking in firearms, their parts and components and ammunition, owing to the harmful effects of those activities on the security of each State, region and the world as a whole, endangering the well-being of peoples, their social and economic development and their right to live in peace, 意识到迫切需要预防、打击和消除枪支及其零部件和弹药的非法制造和贩运,因为这些活动危害每个国家、区域和整个世界的安全,威胁各民族的幸福及其社会和经济发展与和平生活的权利,
Convinced, therefore, of the necessity for all States to take all appropriate measures to this end, including international cooperation and other measures at the regional and global levels, 因此,深信各国有必要为此目的而采取一切适当的措施,包括在区域和全球开展国际合作和采取其他措施,
Recalling General Assembly resolution 53/111 of 9 December 1998, in which the Assembly decided to establish an open-ended intergovernmental ad hoc committee for the purpose of elaborating a comprehensive international convention against transnational organized crime and of discussing the elaboration of, inter alia, an international instrument combating the illicit manufacturing of and trafficking in firearms, their parts and components and ammunition, 回顾1998年12月9日第53/111号决议,大会在该决议中决定设立一个开放的政府间特设委员会,以拟定一项打击跨国有组织犯罪的全面国际公约,并讨论拟定诸如打击非法制造和贩运枪支及其零部件和弹药的国际文书,
Bearing in mind the principle of equal rights and self-determination of peoples, as enshrined in the Charter of the United Nations and the Declaration on Principles of International Law concerning Friendly Relations and Cooperation among States in accordance with the Charter of the United Nations, 铭记《联合国宪章》和《关于各国依联合国宪章建立友好关系和合作的国际法原则宣言》所庄严载入的人民平等权利和自决原则,
Convinced that supplementing the United Nations Convention against Transnational Organized Crime with an international instrument against the illicit manufacturing of and trafficking in firearms, their parts and components and ammunition will be useful in preventing and combating those crimes, 深信以一项打击非法制造和贩运枪支及其零部件和弹药的国际文书补充《联合国打击跨国有组织犯罪公约》,将会有助于预防和打击这种犯罪,
Have agreed as follows: 兹议定如下:
I.General provisions 一、一般条款
Article 1 第一条
Relation with the United Nations Convention against Transnational Organized Crime 同《联合国打击跨国有组织犯罪公约》的关系
1.This Protocol supplements the United Nations Convention against Transnational Organized Crime. It shall be interpreted together with the Convention. 一、本议定书是对《联合国打击跨国有组织犯罪公约》的补充。本议定书应连同公约一并予以解释。
2.The provisions of the Convention shall apply, mutatis mutandis, to this Protocol unless otherwise provided herein. 二、除非本议定书中另有规定,公约的规定应经适当变通后适用于本议定书。
3.The offences established in accordance with article 5 of this Protocol shall be regarded as offences established in accordance with the Convention. 三、根据本议定书第五条确立的犯罪应视为根据公约确立的犯罪。
Article 2 第二条
Statement of purpose 宗旨声明
The purpose of this Protocol is to promote, facilitate and strengthen cooperation among States Parties in order to prevent, combat and eradicate the illicit manufacturing of and trafficking in firearms, their parts and components and ammunition. 本议定书的宗旨是促进、便利和加强缔约国之间为了预防、打击和消除非法制造和贩运枪支及其零部件和弹药而进行的合作。
Article 3 第三条
Use of terms 术语的使用
For the purposes of this Protocol: 在本议定书中:
(a)“Firearm” shall mean any portable barrelled weapon that expels, is designed to expel or may be readily converted to expel a shot, bullet or projectile by the action of an explosive, excluding antique firearms or their replicas. Antique firearms and their replicas shall be defined in accordance with domestic law. In no case, however, shall antique firearms include firearms manufactured after 1899; (一)“枪支”系指利用爆炸作用的任何发射、设计成可以发射或者稍经改装即可发射弹丸、弹头或抛射物的便携管状武器,但不包括古董枪支及其复制品。古董枪支及其复制品应按照各国本国法律予以界定。但古董枪支无论如何不得包括1899年后制造的枪支;
(b)“Parts and components” shall mean any element or replacement element specifically designed for a firearm and essential to its operation, including a barrel, frame or receiver, slide or cylinder, bolt or breech block, and any device designed or adapted to diminish the sound caused by firing a firearm; (二)“零部件”系指专为枪支设计、而且对枪支操作必不可少的任何部分或更换部分,其中包括枪管、套筒座或机匣、套筒或转轮、枪机或枪闩及为枪支消音而设计或改装的机件;
(c)“Ammunition” shall mean the complete round or its components, including cartridge cases, primers, propellant powder, bullets or projectiles, that are used in a firearm, provided that those components are themselves subject to authorization in the respective State Party; (三)“弹药”系指枪支所用的整发子弹或其组成部分,包括弹壳、底火、发射药、弹头或枪支发射的抛射物,但这些组成部分本身须由各缔约国批准;
(d)“Illicit manufacturing” shall mean the manufacturing or assembly of firearms, their parts and components or ammunition: (四)“非法制造”系指下述情况下的制造或组装枪支、枪支零部件或弹药:
(i)From parts and components illicitly trafficked; 1.利用非法贩运的零部件;
(ii)Without a licence or authorization from a competent authority of the State Party where the manufacture or assembly takes place; or 2.没有制造地或组装地缔约国主管当局签发的执照或许可证;或
(iii)Without marking the firearms at the time of manufacture, in accordance with article 8 of this Protocol; 3.制造时没有根据本议定书第八条的规定在枪支上打上标识;
Licensing or authorization of the manufacture of parts and components shall be in accordance with domestic law; 零部件制造的执照或许可证,应根据本国法律规定签发;
(e)“Illicit trafficking” shall mean the import, export, acquisition, sale, delivery, movement or transfer of firearms, their parts and components and ammunition from or across the territory of one State Party to that of another State Party if any one of the States Parties concerned does not authorize it in accordance with the terms of this Protocol or if the firearms are not marked in accordance with article 8 of this Protocol; (五)“非法贩运”系指从一个缔约国的领土或经过一个缔约国的领土进口、出口、获取、销售、交付、移动或转让枪支及其零部件和弹药而未经任何有关缔约国根据本议定书条款批准或未根据本议定书第八条规定打上标识;
(f)“Tracing” shall mean the systematic tracking of firearms and, where possible, their parts and components and ammunition from manufacturer to purchaser for the purpose of assisting the competent authorities of States Parties in detecting, investigating and analysing illicit manufacturing and illicit trafficking. (六)“追查”系指在从制造商直到购买者的全过程中系统地追查枪支,并在可能情况下追查枪支零部件和弹药,以协助缔约国主管当局侦查、调查和分析非法制造和非法贩运活动。
Article 4 第四条
Scope of application 适用范围
1.This Protocol shall apply, except as otherwise stated herein, to the prevention of illicit manufacturing of and trafficking in firearms, their parts and components and ammunition and to the investigation and prosecution of offences established in accordance with article 5 of this Protocol where those offences are transnational in nature and involve an organized criminal group. 一、除非本议定书中另有规定,本议定书应当适用于预防非法制造和贩运枪支及其零部件和弹药,以及侦查和起诉根据本议定书第五条所确立的带有跨国性质且涉及有组织犯罪集团的犯罪。
2.This Protocol shall not apply to state-to-state transactions or to state transfers in cases where the application of the Protocol would prejudice the right of a State Party to take action in the interest of national security consistent with the Charter of the United Nations. 二、如果适用议定书便会影响缔约国根据《联合国宪章》采取有利于国家安全的行动的权利,本议定书不应适用于国家间交易或国家转让。
Article 5 第五条
Criminalization 刑事定罪
1.Each State Party shall adopt such legislative and other measures as may be necessary to establish as criminal offences the following conduct, when committed intentionally: 一、各缔约国均应采取必要的立法和其他措施将下列故意行为定为刑事犯罪:
(a)Illicit manufacturing of firearms, their parts and components and ammunition; (一)非法制造枪支及其零部件和弹药;
(b)Illicit trafficking in firearms, their parts and components and ammunition; (二)非法贩运枪支及其零部件和弹药;
(c)Falsifying or illicitly obliterating, removing or altering the marking(s) on firearms required by article 8 of this Protocol. (三)伪造或非法擦掉、消除或改动本议定书第八条要求的枪支标识。
2.Each State Party shall also adopt such legislative and other measures as may be necessary to establish as criminal offences the following conduct: 二、各缔约国还应采取必要的立法和其他措施将下列行为定为刑事犯罪:
(a)Subject to the basic concepts of its legal system, attempting to commit or participating as an accomplice in an offence established in accordance with paragraph 1 of this article; and (一)实施根据本条第一款所确立的犯罪未遂或作为同犯参与这种犯罪,但应以本国法律制度基本概念为准;和
(b)Organizing, directing, aiding, abetting, facilitating or counselling the commission of an offence established in accordance with paragraph 1 of this article. (二)组织、指挥、协助、教唆实施根据本条第一款所确立的犯罪,或为此提供便利或参谋。
Article 6 第六条
Confiscation, seizure and disposal 没收、扣押和处置
1.Without prejudice to article 12 of the Convention, States Parties shall adopt, to the greatest extent possible within their domestic legal systems, such measures as may be necessary to enable confiscation of firearms, their parts and components and ammunition that have been illicitly manufactured or trafficked. 一、在不影响公约第十二条的情况下,缔约国应在本国法律制度的范围内尽最大可能采取必要措施,以便能够没收非法制造或贩运的枪支及其零部件和弹药。
2.States Parties shall adopt, within their domestic legal systems, such measures as may be necessary to prevent illicitly manufactured and trafficked firearms, parts and components and ammunition from falling into the hands of unauthorized persons by seizing and destroying such firearms, their parts and components and ammunition unless other disposal has been officially authorized, provided that the firearms have been marked and the methods of disposal of those firearms and ammunition have been recorded. 二、缔约国应在本国法律制度的范围内采取必要措施,通过扣押和销毁非法制造和贩运的枪支及其零部件和弹药等办法,防止其落入未获许可者之手。但经正式批准的其他处置方式除外,不过应给枪支打上标识,并对这些枪支和弹药的处置方式进行登记。
II.Prevention 二、预  防
Article 7 第七条
Record-keeping 保存记录
Each State Party shall ensure the maintenance, for not less than ten years, of information in relation to firearms and, where appropriate and feasible, their parts and components and ammunition that is necessary to trace and identify those firearms and, where appropriate and feasible, their parts and components and ammunition which are illicitly manufactured or trafficked and to prevent and detect such activities. Such information shall include: 各缔约国均应切实保存与枪支有关的必要资料,并在适当和可行的情况下保存与枪支零部件和弹药有关的必要资料,保存期至少为十年,以便识别和追查非法制造或贩运的枪支,而且在适当和可行的情况下识别和追查这些枪支的零部件和弹药,并防止和侦查这类活动。这类资料应包括:
(a)The appropriate markings required by article 8 of this Protocol; (一)本议定书第八条所规定的恰当标识;
(b)In cases involving international transactions in firearms, their parts and components and ammunition, the issuance and expiration dates of the appropriate licences or authorizations, the country of export, the country of import, the transit countries, where appropriate, and the final recipient and the description and quantity of the articles. (二)凡涉及枪支及其零部件和弹药的国际交易,有关执照或许可证的签发日期和到期日期、出口国、进口国、过境国(酌情而定)、最终收货人以及货物的说明和数量。
Article 8 第八条
Marking of firearms 枪支的标识
1.For the purpose of identifying and tracing each firearm, States Parties shall: 一、为了识别和追查每一枪支,缔约国应:
(a)At the time of manufacture of each firearm, either require unique marking providing the name of the manufacturer, the country or place of manufacture and the serial number, or maintain any alternative unique user- friendly marking with simple geometric symbols in combination with a numeric and/or alphanumeric code, permitting ready identification by all States of the country of manufacture;

 (一)在每一枪支制造时,或者要求打上表示制造商名称、制造国或制造地和序号的独特标识,或者沿用由简单几何符号与数字密码和(或)字母数字混合密码组成的任何其他独特的、便于使用的标识,使所有国家即刻便能识别制造国;
