| Chapter 1. General Provisions | | 第一章 总则 |

| Article 1. In order to strengthen the administration of marks of origin, regulate the use of marks of origin and protect the lawful rights and interests of manufacturers, operators and consumers, these Provisions are formulated according to the provisions of relevant laws and regulations, namely the Law of the People Republic of China on the Inspection of Import and Export Commodities, its Implementation Regulations, and the Rules of the People's Republic of China on Place of Origin of Export Goods, and of international treaties and agreements such as the Agreement on the Rules on Place of Origin of the World Trade Organization, etc. | | 第一条 为加强原产地标记管理工作，规范原产地标记的使用，保护生产者、经营者和消费者的合法权益，根据《中华人民共和国进出口商品检验法》及其实施条例、《中华人民共和国出口货物原产地规则》等有关法律法规和世界贸易组织《原产地规则协议》等国际条约、协议的规定，制定本规定。 |

| Article 2. These provisions apply to the authentication and administration of marks of origin namely the application, assessment and registration of marks of origin. | | 第二条 本规定适用于对原产地标记的申请、评审、注册等原产地标记的认证和管理工作。 |

| Article 3. The State Administration for Entry-Exit Inspection and Quarantine (hereinafter referred to as the State Administration for Inspection and Quarantine) shall administer the management of marks of origin of the whole country uniformly, and shall be responsible for the formulation of administration measures, the organization, coordination, supervision and administration of marks of origin. Local administrations of entry-exit inspection and quarantine set by the State Administration for Inspection and Quarantine shall be responsible for the acceptance of application, the assessment, reporting, registration, supervision and administration of marks of origin within their jurisdictions. | | 第三条 国家出入境检验检疫局（以下简称国家检验检疫局）统一管理全国原产地标记工作，负责原产地标记管理办法的制定、组织协调和监督管理。国家检验检疫局设在各地的出入境检验检疫局（以下简称检验检疫机构）负责其辖区内的原产地标记申请的受理、评审、报送注册和监督管理。 |

| Article 4. Marks of origin used in these Provisions include marks of the country of origin and the geographical indications. Marks of origin are an inseparable composition of the origin management. | | 第四条 本规定所称原产地标记包括原产国标记和地理标志。原产地标记是原产地工作不可分割的组成部分。 |
A mark of origin refers to marks, labels, signs, characters, graphics and various certificates relating to the place of origin that are used to indicate that a product or service originates from the corresponding country or area. | |
原产国标记是指用于指示一项产品或服务来源于某个国家或地区的标记、标签、标志、文字、图案以及与产地有关的各种证书等。 |
A geographical indication refers to the geographical name of a country, area or a certain place and are used to indicate that a product originates from that place, and the quality and characteristics of the product depend completely or mostly on the geographical environment, natural conditions, human culture backgrounds and other factors of that place. | |
地理标志是指一个国家、地区或特定地方的地理名称，用于指示一项产品来源于该地，且该产品的质量特征完全或主要取决于该地的地理环境、自然条件、人文背景等因素。 |

| Article 5. The range of use of marks of origin includes: | | 第五条 原产地标记的使用范围包括： |

| 1) Products marked with “made/produced in China”; | | （一）标有“中国制造／生产”等字样的产品； |
| |
|
| 2) Famous and special products and traditional handicrafts; | | （二）名、特产品和传统的手工艺品； |
| |
|
| 3) Products applying for authentication marks of origin; | | （三）申请原产地认证标记的产品； |
| |
|
| 4) Goods involving security, sanitation, environment protection and anti-fraud acts; | | （四）涉及安全、卫生、环境保护及反欺诈行为的货物； |
| |
|
| 5) Service trade involving marks of origin and commodities bought by the government; | | （五）涉及原产地标记的服务贸易和政府采购的商品； |
| |
|
| 6) Products that must indicate the places of origin according to state provisions. | | （六）根据国家规定须标明来源地的产品。 |

Article 6. Inspection and quarantine agencies will apply the system of registration authentication on marks of origin.
