The Measures for the Administration of Artwork Business, which were adopted at the executive meeting of the Ministry of Culture on June 2, 2004, are hereby promulgated and shall be implemented as of July 1, 2004. | |

| Article 1 The present Measures are formulated for the purposes of strengthening the management of the artwork businesses activities, protecting the legitimate rights and interests of the creators, business operators and consumers and promoting the sound development of artwork market. | | 第一条 为了加强对美术品经营活动的管理，保护创作者、经营者、消费者的合法权益，促进美术品市场的健康发展，制定本办法。 |

| Article 2 The term "artworks" as mentioned in the present Measures refers to works of painting, calligraphy and seal cutting, sculpture and carving, artistic photography, installation art, industrial art and the limited replicas of the aforesaid works. | | 第二条 本办法所称美术品，是指绘画作品、书法篆刻作品、雕塑雕刻作品、艺术摄影作品、装置艺术作品、工艺美术作品等及其上述作品的有限复制品。 |
The term "artwork business activities" as mentioned in the present Measures refers to the activities such as purchase, sale, lease, mounting, brokerage, assessment and consultancy of artworks, and commercial artwork exhibitions and competitions. | |
本办法所称美术品经营活动，是指美术品的收购、销售、租赁、装裱、经纪、评估、咨询以及商业性美术品展览、比赛等活动。 |

| Article 3 The Ministry of Culture shall be responsible for the supervision and management of the artwork business activities of the whole country, formulating the development plan on artwork market and examining and approving the business activities of import and export of artworks. | | 第三条 文化部负责全国美术品经营活动的监督管理工作，制定美术品市场的发展规划，审批美术品进出口经营活动。 |
The culture administrative departments of the people's government at the county level or above shall be responsible for the routine supervision and management of artwork business activities within their respective administrative areas. | |
县级以上地方人民政府文化行政部门负责本行政区域内美术品经营活动的日常监督管理工作。 |

| Article 4 Any one who intends to establish an entity for undertaking artwork business activities shall meet the following conditions: | | 第四条 设立从事美术品经营活动的经营单位，应当符合下列条件： |
| |
|
| (1) Having a business entity name; | | （一）有经营单位的名称； |
| |
|
| (2) Having a fixed business place; | | （二）有固定的经营场所； |
| |
|
| (3) Having funds adequate to its business scale; | | （三）有与其经营规模相适应的资金； |
| |
|
| (4) Having corresponding professionals of artwork business; and | | （四）有相应的美术品经营的专业人员； |
| |
|
| (5) Other conditions as prescribed in the laws or regulations. | | （五）法律、法规规定的其他条件。 |
An applicant who meets the above-mentioned conditions shall apply to the administrative department for industry and commerce at the county level or above where its domicile is located for a business license. It shall, within 15 days from the day when it obtains the business license, go through the record-keeping formalities in the culture administrative department at the county level or above where its domicile is located. | |
符合上述条件的申请人，应当到其住所地县级以上工商行政管理部门申领营业执照，并在领取营业执照之日起15日内，到其住所地县级以上文化行政部门备案。 |

| Article 5 Any one intends to establish an entity for undertaking business activities of import and export of artworks shall meet the following conditions: | | 第五条 设立从事美术品进出口经营活动的单位，应当符合下列条件： |
| |
|
| (1) Having a business entity name; | | （一）有经营单位的名称； |
| |
|
| (2) Having the corresponding organizational structure; | | （二）有相应的组织机构； |
| |
|
| (3) Having a fixed business site; | | （三）有固定的经营场所； |
| |
|
| (4) Having not less than 3 million yuan of registered capital; | | （四）有不少于300万元人民币的注册资金； |
| |
|
| (5) Having corresponding professionals of artwork business; | | （五）有相应的美术品经营的专业人员； |
| |
|
| (6) Having a sound foreign exchange financial and accounting system; | | （六）有健全的外汇财务制度； |
| |
|
| (7) Having the capacity to bear civil liabilities; and | | （七）有独立承担民事责任的能力； |
| |
|
| (8) Other conditions as prescribed in the laws or regulations. | | （八）法律、法规规定的其他条件。 |
An applicant who meets the above mentioned conditions shall go through the formalities in accordance with the relevant provisions of the state on the import and export qualifications, and shall, within 15 days after it obtains the business license, go through the record-keeping formalities in the culture administrative department at the county level or above where its domicile is located. | |
符合上述条件的申请人，应当按照国家关于进出口经营资格的有关规定办理手续，并在领取营业执照之日起15日内，到其住所地县级以上文化行政部门备案。 |

| Article 6 An enterprise or any other business entity that intends to undertake artwork business shall meet the relevant provisions of the present Measures, and shall, within 15 days after it has modified its registration, go through the formalities in the culture administrative department at the county level or above where its domicile is located. | | 第六条 企业或者其他经营单位增设美术品经营业务，应当符合本办法有关规定，并在变更登记之日起15日内到住所地县级以上文化行政部门备案。 |
