| Chapter I General Provisions | | 第一章 总则 |
Article 1 In order to regulate the administration of tobacco monopoly licenses and protect the lawful rights and interests of the citizens, legal persons and other organizations, these Measures are developed in accordance with the provisions of the Law of the People's Republic of China on Tobacco Monopoly, the Administrative License Law of the People's Republic of China, the Regulation on the Implementation of the Law of the People's Republic of China on Tobacco Monopoly | | 第一条 为了规范烟草专卖许可证管理，保护公民、法人和其他组织的合法权益，根据《中华人民共和国烟草专卖法》、《中华人民共和国行政许可法》、《中华人民共和国烟草专卖法实施条例》及相关法律、行政法规的规定，制定本办法。 |
| Article 2 These Measures shall apply to the administration of tobacco monopoly licenses within the territory of the People's Republic of China. | | 第二条 本办法适用于中华人民共和国境内烟草专卖许可证的管理。 |
| Article 3 Tobacco monopoly administrations shall, according to their statutory power, scope, conditions and procedures, examine and approve and issue tobacco monopoly licenses, and carry out effective supervision and administration. | | 第三条 烟草专卖局应当依照法定的权限、范围、条件和程序审批、发放烟草专卖许可证，并进行有效的监督管理。 |
| Article 4 Citizens, legal persons or other organizations may have the right of statement and the right of defense regarding tobacco monopoly licenses issued by tobacco monopoly administrations; and have the right to apply for administrative reconsideration or institute an administrative action. If their lawful rights and interests are impaired due to the illegal issuance of tobacco monopoly licenses by tobacco monopoly administrations, they have the right to claim compensations according to the law. | | 第四条 公民、法人或者其他组织对烟草专卖局发放的烟草专卖许可证，享有陈述权、申辩权；有权依法申请行政复议或者提起行政诉讼。其合法权益因烟草专卖局违法发放烟草专卖许可证受到损害的，有权依法要求赔偿。 |
| Article 5 The tobacco monopoly licenses which the citizens, legal persons or other organizations have obtained according to the law shall be protected by law. | | 第五条 公民、法人或者其他组织依法取得的烟草专卖许可证受法律保护。 |
| Where any law, regulation or rule on which the tobacco monopoly licenses are based is amended or repealed or there is any material change in the objective conditions on which the granting of tobacco monopoly licenses are based, for the sake of public interests, the State Tobacco Monopoly Administration may modify or withdraw the tobacco monopoly licenses which have already taken affect. | | 烟草专卖许可证所依据的法律、法规、规章修改、废止，或者办理烟草专卖许可证所依据的客观情况发生重大变化的，为了公共利益的需要，烟草专卖局可以依法变更或者撤回已经生效的烟草专卖许可证。 |
| Article 6 For the purpose of these Measures, “tobacco monopoly licenses” are classified into three categories, namely, the tobacco monopoly license for production enterprises, the tobacco monopoly license for wholesale enterprises, and the tobacco monopoly license for retail trade. | | 第六条 本办法所称的烟草专卖许可证，包括烟草专卖生产企业许可证、烟草专卖批发企业许可证、烟草专卖零售许可证三类。 |
| Article 7 Tobacco monopoly administrations shall examine and approve, issue and administer the tobacco monopoly licenses according to the law. | | 第七条 烟草专卖局依法审批发放和管理烟草专卖许可证。 |
| Chapter II Application and Acceptance | | 第二章 申请与受理 |
| Article 8 To engage in the production, wholesale, retail, import and export of tobacco monopoly products and other related business, the citizens, legal persons or other organizations shall apply to tobacco monopoly administrations for a tobacco monopoly license. | | 第八条 公民、法人或者其他组织从事烟草专卖品的生产、批发、零售、进出口等业务的，应当依法向烟草专卖局申请领取烟草专卖许可证。 |
| If an entity without the legal person status under a legal person intends to separately obtain a tobacco monopoly license for production enterprises or a tobacco monopoly license for wholesale enterprises, the entity with the legal person status shall file an application with the relevant tobacco monopoly administration and submit the relevant application materials. | | 法人所属的不具备法人资格的单位单独领取烟草专卖生产企业许可证或者烟草专卖批发企业许可证的，其所属法人单位应当向相关的烟草专卖局提出申请，并提交有关申请材料。 |
| Article 9 An application shall be generally filed by an applicant in written form, but it may also be filed by letter, telegraph, fax, exchange of electronic data or emails or other means, and the standard text shall be completed according to the requirements of the tobacco monopoly administration. | | 第九条 申请人一般以书面方式提出申请，也可以通过信函、电报、传真、电子数据交换和电子邮件等方式提出申请，并按烟草专卖局要求填报格式文本。 |
| An applicant may authorize an agent to file an application. If the agent files an application, the letter of authorization of the principal and the identity certification of the agent shall be provided. | | 申请人可以委托代理人提出申请。委托代理人提出申请的，应当提供委托人的授权委托书及代理人的身份证明。 |
| Article 10 Tobacco monopoly administrations shall, according to the different items for which the applicants apply, determine the application types and require the applicants to provide corresponding application materials. | | 第十条 烟草专卖局应当根据申请人申请的不同事项确定申请类型，并要求提供相应的申请材料。 |
| The types of applications for tobacco monopoly licenses include initial applications, and applications for renewal, modification, suspension of business, resumption of business and closure of business, among others. | | 烟草专卖许可证申请类型包括新办申请、延续申请、变更申请、停业申请、恢复营业申请、歇业申请等。 |
| Article 11 To apply for a tobacco monopoly license for a production enterprise, the applicant shall satisfy the following conditions: | | 第十一条 申请烟草专卖生产企业许可证，应当具备下列条件： |
| (1) Having funds which can meet the needs of production of tobacco monopoly products. | | （一）有与生产烟草专卖品相适应的资金； |
| (2) Having technologies and equipment which can meet the needs of production of tobacco monopoly products. | | （二）有生产烟草专卖品所需要的技术、设备条件； |
| (3) Conforming to the industrial policies of the national tobacco industry and the needs enterprises in terms of structural adjustment. | | （三）符合国家烟草行业的产业政策要求及企业组织结构调整的需要； |
| (4) Other conditions as prescribed by the State Tobacco Monopoly Administration. | | （四）国家烟草专卖局规定的其他条件。 |
| Article 12 To apply for a tobacco monopoly license for a wholesale enterprise, the applicant shall satisfy the following conditions: | | 第十二条 申请烟草专卖批发企业许可证，应当具备下列条件： |
| (1) Having funds which can meet the needs of engaging in the wholesale business of tobacco products. | | （一）有与经营烟草制品批发业务相适应的资金； |
| (2) Having fixed business premises and necessary professionals. | | （二）有固定的经营场所和必要的专业人员； |
| (3) Satisfying the requirements for the reasonable layout of tobacco monopoly wholesale enterprises. | | （三）符合烟草专卖批发企业合理布局的要求； |
| (4) Other conditions as prescribed by the State Tobacco Monopoly Administration. | | （四）国家烟草专卖局规定的其他条件。 |
| Article 13 To apply for a tobacco monopoly license for retail trade, the applicant shall meet the following conditions: | | 第十三条 申请烟草专卖零售许可证，应当具备下列条件： |
| (1) Having funds which can meet the needs of engaging in the business of retail trade of monopoly products. | | （一）有与经营烟草制品零售业务相适应的资金； |
| (2) Having fixed business premises independent of his or her domicile. | | （二）有与住所相独立的固定经营场所； |
| (3) Satisfying the requirements for the reasonable layout of the local retail outlets of tobacco products. | | （三）符合当地烟草制品零售点合理布局的要求； |
| (4) Other conditions as prescribed by the State Tobacco Monopoly Administration. | | （四）国家烟草专卖局规定的其他条件。 |
| Article 14 Other conditions as prescribed by the State Tobacco Monopoly Administration as mentioned in Articles 11, 12 and 13 of these Measures shall be announced before these Measures come into force. | | 第十四条 本办法第十一条、第十二条、第十三条所规定的国家烟草专卖局规定的其他条件，在实施前应当公布。 |
| Article 15 When developing a plan for the reasonable layout of retail outlets of tobacco products, a tobacco monopoly administration shall, based on the population, transport, economic development level, consumption capacity and other factors within its jurisdiction, determine the reasonable layout of the retail outlets after a hearing. | | 第十五条 制订烟草制品零售点合理布局规划时，应当根据辖区内的人口数量、交通状况、经济发展水平、消费能力等因素，在举行听证后确定零售点的合理布局。 |
| The reasonable layout plan, capital requirements and business premises requirements for the retail outlets of tobacco products shall be developed by the tobacco monopoly administration at or above the county level and shall be submitted to the tobacco monopoly administration at the next higher level for recordation. | | 烟草制品零售点合理布局规划、经营资金要求和经营场所条件，由县级以上烟草专卖局制定，并报上一级烟草专卖局备案。 |
| Article 16 When a chain enterprise applies for a tobacco monopoly license for retail trade, each of its branch stores shall file an application with the local tobacco monopoly administration. | | 第十六条 连锁经营企业在申请烟草专卖零售许可证时，应当由各个分店分别向所在地烟草专卖局提出申请。 |
| Article 17 No foreign-funded commercial enterprise or no individual industrial and commercial household may engage in the wholesale or retail business of tobacco monopoly products, or do so in any disguised form such as franchise, taking in the franchisees or other forms of re-investments. | | 第十七条 外商投资的商业企业或者个体工商户不得从事烟草专卖品批发或者零售业务，不得以特许、吸纳加盟店及其他再投资等形式变相从事烟草专卖品经营业务。 |
| Article 18 A tobacco monopoly administration shall, by such means as the announcement column, the electronic inquiry system or the Internet, announce the conditions, requirements, procedures, time limit, and other contents necessary to be announced, for handling tobacco monopoly licenses. | | 第十八条 烟草专卖局应当将办理烟草专卖许可证的条件、要求、程序、时限等需公示的内容通过公示栏、电子查询系统或者互联网等方式予以公示。 |
| Article 19 The following contents shall be published at a place for handling tobacco monopoly licenses: | | 第十九条 办理烟草专卖许可证的场所应当公示下列内容： |
| (1) The name of the tobacco monopoly licenses. | | （一）烟草专卖许可证名称； |
| (2) The laws, regulations and rules on which tobacco monopoly licenses are based. | | （二）办理烟草专卖许可证所依据的法律、法规、规章； |
| (3) The approval authority of tobacco monopoly licenses. | | （三）各类烟草专卖许可证的审批机关； |
| (4) The conditions for applying for tobacco monopoly licenses. | | （四）申请烟草专卖许可证的条件； |
| (5) The list of all materials which an applicant is required to submit. | | （五）申请人需要提交的全部材料目录； |
| (6) Procedures for applying for tobacco monopoly licenses. | | （六）烟草专卖许可证申请的方式、途径； |
| (7) The procedures and time limit for the approval of tobacco monopoly licenses. | | （七）烟草专卖许可证审批程序、时限； |
| (8) The exact address and contact information of the business premises for handling tobacco monopoly licenses. | | （八）办理烟草专卖许可证的办公场所准确地址、联系方式； |
| (9) Other contents necessary to be publicized. | | （九）其他需要公示的内容。 |
| Article 20 Where an applicant requires the tobacco monopoly administration to give an account of or an explanation for any content of publication, the tobacco monopoly administration shall do so and provide accurate and reliable information. | | 第二十条 申请人要求烟草专卖局对公示内容予以说明、解释的，烟草专卖局应当予以说明、解释，提供准确、可靠的信息。 |
| Article 21 A tobacco monopoly administration shall handle the applications filed by applicants respectively according to different circumstances as follows: | | 第二十一条 烟草专卖局对申请人提出的申请，应当根据下列情况分别作出处理： |
| (1) If the item applied for is not subject to a tobacco monopoly administrative license, it shall inform the applicant of non-acceptance immediately. | | （一）申请事项依法不需要取得烟草专卖许可证的，应当即时告知申请人不受理； |
| (2) If the item applied for does not fall within the scope of statutory functions of the tobacco monopoly administration, it shall immediately make a decision of rejection and advise the applicant to file an application with the relevant administrative organ. | | （二）申请事项不属于本烟草专卖局法定职权范围的，应当即时作出不予受理的决定，并告知申请人向有关行政机关申请； |
| (3) Where there is any error that can be corrected on the spot in the application materials submitted by an applicant, it shall allow the applicant to correct it on the spot. | | （三）申请材料存在可以当场更正的错误的，应当允许申请人当场更正； |
(4) Where the application materials are incomplete or inconsistent with the statutory forms, it shall, on the spot or within five days, notify the applicant of all necessary supplements and corrections at one time. If it fails to notify the applicant of the aforesaid contents within the prescribed time limit, the application shall be deemed to have been accepted from the date of receipt of the application materials.
