| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 For purposes of strengthening and regulating the procuratorial supervision of execution of involuntary medical treatment, these Measures are developed in accordance with the provisions of the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China and other laws, and in light of the actual circumstances of procuratorial work. | | 第一条 为了加强和规范强制医疗执行检察工作，根据《中华人民共和国刑法》、《中华人民共和国刑事诉讼法》等法律规定，结合检察工作实际，制定本办法。 |
| Article 2 The task of people's procuratorates' procuratorial supervision of execution of involuntary medical treatment is to ensure the correct implementation of the state's laws and regulations in the execution of involuntary medical treatment, protect the lawful rights of personnel subject to involuntary medical treatment, and guarantee the execution of involuntary medical treatment in accordance with the law. | | 第二条 人民检察院强制医疗执行检察的任务，是保证国家法律法规在强制医疗执行活动中正确实施，维护被强制医疗人的合法权利，保障强制医疗执行活动依法进行。 |
| Article 3 The functions of people's procuratorates in the procuratorial supervision of execution of involuntary medical treatment are: | | 第三条 人民检察院强制医疗执行检察的职责是： |
| (1) Conducting supervision whether the delivery execution of people's courts and public security authorities are legal. | | （一）对人民法院、公安机关的交付执行活动是否合法实行监督； |
| (2) Conducting supervision whether the receipt and treatment, medical treatment, supervision and other activities of involuntary medical treatment institutions are legal. | | （二）对强制医疗机构的收治、医疗、监管等活动是否合法实行监督； |
| (3) Investigating duty-related crimes occurred in the execution of involuntary medical treatment, and preventing duty-related crimes. | | （三）对强制医疗执行活动中发生的职务犯罪案件进行侦查，开展职务犯罪预防工作； |
| (4) Accepting the accusations, reports and appeals filed by the personnel subject to involuntary medical treatment and their legal representatives and close relatives. | | （四）受理被强制医疗人及其法定代理人、近亲属的控告、举报和申诉； |
| (5) Other supervision functions that shall be performed in accordance with the law. | | （五）其他依法应当履行的监督职责。 |
| Article 4 The people's procuratorate at the same level shall be responsible for the supervision of delivery execution activities of people's courts and public security authorities. | | 第四条 对人民法院、公安机关交付执行活动的监督，由同级人民检察院负责。 |
| The criminal execution procuratorial department of the people's procuratorate shall be responsible for the supervision of execution of involuntary medical treatment. | | 对强制医疗执行活动的监督，由人民检察院刑事执行检察部门负责。 |
| Article 5 The case management department of the people's procuratorate shall, after receiving the duplicate of the involuntary medical treatment decision of the people's court, transfer it to the criminal execution procuratorial department of the court within one working day. The criminal execution procuratorial department shall fill out the Notification of Delivery Execution of Involuntary Medical Treatment in a timely manner, and serve it together with the photocopy of the involuntary medical treatment decision upon the criminal execution procuratorial department of the people's procuratorate that undertakes the procuratorial supervision of involuntary medical treatment institutions. | | 第五条 人民检察院案件管理部门收到人民法院的强制医疗决定书副本后，应当在一个工作日内移送本院刑事执行检察部门。刑事执行检察部门应当及时填写《强制医疗交付执行告知表》，连同强制医疗决定书复印件一并送达承担强制医疗机构检察任务的人民检察院刑事执行检察部门。 |
| Article 6 The people's procuratorate may dispatch personnel to conduct the procuratorial supervision or conduct patrol procuratorial supervision of execution of involuntary medical treatment by involuntary medical treatment clinics. The people's procuratorate shall conduct patrol procuratorial supervision of execution of involuntary medical treatment by mental health medical institutions designated by governments to temporarily perform involuntary medical treatment functions. | | 第六条 对强制医疗所的强制医疗执行活动，人民检察院可以实行派驻检察或者巡回检察。对受政府指定临时履行强制医疗职能的精神卫生医疗机构的强制医疗执行活动，人民检察院应当实行巡回检察。 |
| There shall be not less than two procuratorial personnel who conduct procuratorial supervision of execution of involuntary medical treatment, among whom at least one shall be the chief procurator. | | 检察强制医疗执行活动时，检察人员不得少于二人，其中至少一人应当为检察官。 |
| Chapter II Procuratorial Supervision of Delivery Execution | | 第二章 交付执行检察 |
| Article 7 After the people's court makes an involuntary medical treatment decision, the people's procuratorate shall conduct supervision of the following delivery execution activities for involuntary medical treatment: | | 第七条 人民法院作出强制医疗决定后，人民检察院应当对下列强制医疗交付执行活动实行监督： |
| (1) Whether the delivery execution activities of the people's court comply with the relevant legal provisions. | | （一）人民法院的交付执行活动是否符合有关法律规定； |
| (2) Whether the public security authority legally sends the person on whom an involuntary medical treatment decision is made to the involuntary medical treatment institution for execution. | | （二）公安机关是否依法将被决定强制医疗的人送交强制医疗机构执行； |
| (3) Whether the involuntary medical treatment institution receives and treats the person on whom an involuntary medical treatment decision is made in accordance with the law. | | （三）强制医疗机构是否依法收治被决定强制医疗的人； |
| (4) Other content that shall be subject to procuratorial supervision. | | （四）其他应当检察的内容。 |
| Article 8 The methods of procuratorial supervision of delivery execution are: | | 第八条 交付执行检察的方法： |
| (1) Conducting on-spot procuratorial supervision. | | （一）赴现场进行实地检察； |
| (2) Examining the involuntary medical treatment decision, the notice on execution of involuntary medical treatment, the verified written opinion proving that the person subject to involuntary medical treatment has no criminal capacity and other relevant legal documents. | | （二）审查强制医疗决定书、强制医疗执行通知书、证明被强制医疗人无刑事责任能力的鉴定意见书等相关法律文书； |
| (3) Holding talks with the relevant personnel. | | （三）与有关人员谈话； |
| (4) Other methods. | | （四）其他方法。 |
| Article 9 Where the people's court, public security authority or involuntary medical treatment institution falls under any of the following circumstances in delivery execution, the people's procuratorate shall offer the correction opinion in a timely manner in accordance with the law: | | 第九条 人民法院、公安机关、强制医疗机构在交付执行活动中有下列情形之一的，人民检察院应当依法及时提出纠正意见： |
| (1) The people's court fails to serve the involuntary medical treatment decision and notice on execution of involuntary medical treatment upon the public security authority within five days after making the involuntary medical treatment decision. | | （一）人民法院在作出强制医疗决定后五日以内未向公安机关送达强制医疗决定书和强制医疗执行通知书的； |
| (2) The public security authority fails to legally send the person on whom an involuntary medical treatment decision is made to the involuntary medical treatment institution for execution. | | （二）公安机关没有依法将被决定强制医疗的人送交强制医疗机构执行的； |
| (3) The relevant legal documents delivered for execution and other formalities are incomplete. | | （三）交付执行的相关法律文书及其他手续不完备的； |
| (4) The involuntary medical treatment institution refuses to receive and treat the person on whom an involuntary medical treatment decision is made. | | （四）强制医疗机构对被决定强制医疗的人拒绝收治的； |
| (5) The involuntary medical treatment institution receives and treats the person on whom the people's court does not make an involuntary medical treatment decision. | | （五）强制医疗机构收治未被人民法院决定强制医疗的人的； |
| (6) Any other violation of law. | | （六）其他违法情形。 |
| Chapter III Procuratorial Supervision of Medical and Supervisory Activities | | 第三章 医疗、监管活动检察 |
| Article 10 The procuratorial supervision of medical and supervisory activities covers: | | 第十条 医疗、监管活动检察的内容： |
| (1) Whether the medical and supervisory activities of the involuntary medical treatment institution comply with the relevant provisions. | | （一）强制医疗机构的医疗、监管活动是否符合有关规定； |
| (2) Whether the involuntary medical treatment institution conducts diagnostic assessment or any other relevant work in accordance with the law. | | （二）强制医疗机构是否依法开展诊断评估等相关工作； |
| (3) Whether the lawful rights of the personnel subject to involuntary medical treatment are guaranteed. | | （三）被强制医疗人的合法权利是否得到保障； |
| (4) Other content that shall be subject to procuratorial supervision. | | （四）其他应当检察的内容。 |
