For the purpose of improving the political quality, business quality and professional ethics of judicial experts, strengthening the construction of the judicial expert team, regulating judicial expert education and training work and enhancing the healthy development of judicial expertise undertaking, the Ministry of Justice, in accordance with the related state laws and regulations, the Measures for the Registration Administration of Judicial Expertise Institutions and the Measures for the Registration Administration of Judicial Experts, formulated the Provisions on Judicial Expertise Education and Training, which are hereby printed and distributed to all regions. If you encounter any problem or have any suggestion in implementing them, please report it to the Ministry of Justice in a timely manner. | |
为了提高司法鉴定人的政治素质、业务素质和职业道德，加强司法鉴定人队伍建设，规范司法鉴定人教育培训工作，促进司法鉴定事业的健康发展，根据国家有关法律、法规和司法部《司法鉴定机构登记管理办法》和《司法鉴定人登记管理办法》，司法部制定了《司法鉴定教育培训规定》，现印发各地。各地在执行中遇到的问题和相关建议，请及时报告给司法部。 |

Article 1 For the purpose of improving the political quality, business quality and professional ethics of judicial experts and guaranteeing judicial expertise quality, these Measures are formulated in accordance with the related state laws and regulations, the Measures for the Registration Administration of Judicial Expertise Institutions | | 第一条 为了提高司法鉴定队伍的政治素质、业务素质和职业道德素质，保障司法鉴定质量，根据国家有关法律、法规和《司法鉴定机构登记管理办法》、《司法鉴定人登记管理办法》等有关规定，制定本规定。 |

| Article 2 These Provisions shall apply to persons applying for or having obtained the certificate to practice judicial expertise. | | 第二条 本规定适用于申请和已取得司法鉴定人执业证书的人员。 |
The term “judicial expertise education and training” as mentioned in these Provisions includes on-the-job training and further education. | |
本规定所称的司法鉴定教育培训包括岗位培训和继续教育。 |

| Article 3 Judicial expertise education and training work shall be carried out by following the state requirements of “accepting training before assuming posts” and lifelong education as well as the principles of planning as a whole, delegating power to different levels, organizing based on the actual needs and implementing in a classified way. | | 第三条 司法鉴定教育培训工作根据国家"先培训后上岗"和终身教育的要求，坚持统筹规划、分级负责、按需组织、分类实施的原则。 |

| Article 4 Judicial experts shall actively participate in education and training to learn political theories and professional knowledge, improve their practicing capability and level and strengthen their professional ethics consciousness. | | 第四条 司法鉴定人应当积极参加教育培训，学习政治理论和业务知识，不断提高执业能力和水平，加强职业道德修养。 |
A judicial expert may not independently practice in the name of a judicial expert until he accepts on-the-job training. Completing the prescribed further education hours is one of the requirements for applying for appraising his competence for the professional or technical title of judicial expert. | |
司法鉴定人接受岗位培训后，方可以司法鉴定人的名义独立进行执业活动；司法鉴定人完成规定的继续教育学时是申报评定司法鉴定专业技术职称任职资格的条件之一。 |

| Article 5 A judicial expertise institution shall organize its judicial experts to participate in education and training in accordance with the requirements of these Provisions. | | 第五条 司法鉴定机构应当按照本规定的要求，组织本机构司法鉴定人参加教育培训。 |
Whether a judicial expertise institution has done the above-mentioned organizing work well will be one of the aspects to be examined in evaluating and assessing its qualification. | |
司法鉴定机构组织教育培训的情况，纳入对其进行资质评估、考核评价的内容。 |

| Article 6 The judicial administrative department shall take charge of planning, organizing and guiding the judicial expertise education and training work, and shall supervise and check the participation by judicial expertise institutions and their judicial experts. | | 第六条 司法行政机关负责对司法鉴定教育培训工作进行规划、组织和指导，对司法鉴定机构及其司法鉴定人参加教育培训的情况进行监督、检查。 |
