| Your Request for Instructions on Issues concerning the Application of Law to a Defense Attorney's Request for Copying the Video Footage of an Investigation Authority's Interrogation (No. 12 [2013], Criminal Division II, HPC, Guangdong) has been received. Upon deliberation, the following apply is hereby made: | | 你院(2013)粤高法刑二终字第12号《关于辩护律师请求复制侦查机关讯问录像法律适用问题的请示》收悉。经研究，答复如下： |
In accordance with Article 38 of the Criminal Procedure Law of the People's Republic of China and Article 47 of the Interpretation of the Supreme People's Court on the Application of the Criminal Procedure Law of the People's Republic of China, from the date when the people's procuratorate begins the examination for prosecution of a case, the defense attorney may consult, excerpt or copy the case files, but shall be obligated to keep relevant information strictly confidential when any state secret or personal privacy is involved. In the case on which you requested instructions, the audio-video records of the investigation authority's interrogation of the defendant have been transferred to the people's court as evidence materials and played in court session, and do not constitute materials which cannot be disclosed in accordance with law. When the defense attorney makes a request for copying the relevant audio-video records, the request shall be granted.
．．．．．． | | 根据《中华人民共和国刑事诉讼法》第三十八条和最高人民法院《关于适用＜中华人民共和国刑事诉讼法＞的解释》第四十七条的规定，自人民检察院对案件审查起诉之日起，辩护律师可以查阅、摘抄、复制案卷材料，但其中涉及国家秘密、个人隐私的，应严格履行保密义务。你院请示的案件，侦查机关对被告人的讯问录音录像已经作为证据材料向人民法院移送并已在庭审中播放，不属于依法不能公开的材料，在辩护律师提出要求复制有关录音录像的情况下，应当准许。
