The people's procuratorates of all provinces, autonomous regions, and municipalities directly under the Central Government; the Military Procuratorate of the People's Liberation Army; and the People's Procuratorate of Xinjiang Production and Construction Corps: 各省、自治区、直辖市人民检察院,解放军军事检察院,新疆生产建设兵团人民检察院:
The Provisions on the Supervision of the Involuntary Medical Treatment Decision Procedures by the People's Procuratorates, as adopted at the 66th session of the Twelfth Procuratorial Committee of the Supreme People's Procuratorate on July 4, 2017, are hereby issued for your diligent compliance and implementation in light of the reality. The important circumstances and problems encountered by all localities in implementation shall be reported to the Supreme People's Procuratorate in a timely manner. 《人民检察院强制医疗决定程序监督工作规定》已经2017年7月4日最高人民检察院第十二届检察委员会第六十六次会议通过。现印发你们,请结合实际,认真贯彻执行。各地在执行中遇到的重要情况和问题,请及时报告最高人民检察院。

Provisions on the Supervision of the Involuntary Medical Treatment Decision Procedures by the People's Procuratorates 人民检察院强制医疗决定程序监督工作规定
(Adopted at the 66th session of the Twelfth Procuratorial Committee of the Supreme People's Procuratorate on July 4, 2017) (2017年7月4日最高人民检察院第十二届检察委员会第六十六次会议通过)
Article 1 For the purposes of regulating the supervision of involuntary medical treatment decision procedures by the people's procuratorates, safeguarding public safety, protecting the lawful rights of litigation participants, and ensuring the correct implementation of the involuntary medical treatment procedures, these Provisions are developed according to the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China and other provisions, in light of the reality of the procuratorial work.   第一条 为了规范人民检察院强制医疗决定程序监督工作,维护公共安全,维护诉讼参与人的合法权利,保障强制医疗程序的正确实施,根据《中华人民共和国刑法》《中华人民共和国刑事诉讼法》等规定,结合检察工作实际,制定本规定。
Article 2 The supervision of the involuntary medical treatment decision procedures shall be in the charge of the public prosecution departments of the people's procuratorates. Where minors are involved, the procuratorial department related to minors shall be in charge thereof.   第二条 强制医疗决定程序的监督,由人民检察院公诉部门负责。涉及未成年人的,由未成年人检察部门负责。
Article 3 The people's procuratorate handling an involuntary medical treatment case transferred by the public security organ shall examine the involuntary medical treatment opinions submitted by the public security organ, as well as the authentication opinions and other evidence materials, and pay attention to discovering and correcting the following illegal circumstances:   第三条 人民检察院办理公安机关移送的强制医疗案件,应当审查公安机关移送的强制医疗意见书,以及鉴定意见等证据材料,并注意发现和纠正以下违法情形,
(1) The authentication procedures for a mental patient involved in a case violate the provisions of the law. (一)对涉案精神病人的鉴定程序违反法律规定的;
(2) The temporary protective restraint measures adopted against a mental patient involved in a case are inappropriate. (二)对涉案精神病人采取临时保护性约束措施不当的;
(3) Other circumstances that violate the provisions of the law. (三)其他违反法律规定的情形。
Article 4 The people's procuratorate handling an involuntary medical treatment case transferred by the public security organ may meet with a mental patient involved in a case, inquire of case-handling personnel and authentication experts, solicit the opinions of the legal representative and litigation representative of the mental patient involved in a case, understand the situations from the doctor in charge, close relatives, neighbors, and other insiders or grassroots organizations, among others, of the mental patient involved in a case, understand the situations from the victim and his or her legal representative and close relatives, among others, entrust the authentication of relevant special technical issues to the authentication institution and authentication experts with legal qualifications, and carry out relevant investigation.   第四条 人民检察院办理公安机关移送的强制医疗案件,可以会见涉案精神病人,询问办案人员、鉴定人,听取涉案精神病人法定代理人、诉讼代理人意见,向涉案精神病人的主治医生、近亲属、邻居、其他知情人员或者基层组织等了解情况,向被害人及其法定代理人、近亲属等了解情况,就有关专门性技术问题委托具有法定资质的鉴定机构、鉴定人进行鉴定,开展相关调查。
Relevant investigations shall be recorded and annexed to the case file. 相关调查情况应当记录并附卷。
Article 5 The people's procuratorate finding that the public security organ should initiate the involuntary medical treatment procedures but fails to do so, may request the public security organ to explain in writing the reasons for not initiating within seven days.   第五条 人民检察院发现公安机关应当启动强制医疗程序而不启动的,可以要求公安机关在七日以内书面说明不启动的理由。
Where the reasons of the public security organ for not initiating are examined to be unfounded, the public security organ shall be notified of initiating the involuntary medical treatment procedures. 经审查,认为公安机关不启动理由不能成立的,应当通知公安机关启动强制医疗程序。
Where the public security organ fails to initiate the involuntary medical treatment procedures as required upon receipt of a notice on initiating the involuntary medical treatment procedures, the people's procuratorate shall put forward the correction opinion to the public security organ. 公安机关收到启动强制医疗程序通知书后,未按要求启动强制医疗程序的,人民检察院应当向公安机关提出纠正意见。
Article 6 The people's procuratorate that handles an involuntary medical treatment case transferred by the public security organ and finds that the procedures of the public security organ for conducting authentication of the mental patient involved in a case fall under one of the following circumstances shall offer correction opinions according to the law:   第六条 人民检察院办理公安机关移送的强制医疗案件,发现公安机关对涉案精神病人进行鉴定的程序有下列情形之一的,应当依法提出纠正意见:
(1) The authentication institution has no legal qualifications, or conducts psychiatric authentication beyond the business scope and technical conditions of the authentication institution. (一)鉴定机构不具备法定资质,或者精神病鉴定超出鉴定机构业务范围、技术条件的;
(2) The authentication expert has no legal qualifications, and conducts psychiatric authentication beyond the business scope of the authentication expert or violates the disqualification provisions. (二)鉴定人不具备法定资质,精神病鉴定超出鉴定人业务范围,或者违反回避规定的;
(3) The authentication procedures violate the law and relevant regulations, and the process and method of authentication violate the specifications and requirements of the relevant profession. (三)鉴定程序违反法律、有关规定,鉴定的过程和方法违反相关专业的规范要求的;
(4) The authentication document does not satisfy the requirements for the statutory form. (四)鉴定文书不符合法定形式要件的;
(5) The relevant personnel are not notified of the authentication opinions in a timely manner according to the law. (五)鉴定意见没有依法及时告知相关人员的;
(6) The authentication expert intentionally makes false authentication. (六)鉴定人故意作虚假鉴定的;
(7) Other circumstances that violate the provisions of the law. (七)其他违反法律规定的情形。
The people's procuratorate supervising the psychiatric authentication procedures may request the public security organ to conduct supplementary authentication or re-conduct authentication, and may, if necessary, inquire of the authentication expert and make transcripts, or entrust an authentication institution with legal qualifications with conducting supplementary authentication or re-conducting authentication. 人民检察院对精神病鉴定程序进行监督,可以要求公安机关补充鉴定或者重新鉴定,必要时,可以询问鉴定人并制作笔录,或者委托具有法定资质的鉴定机构进行补充鉴定或者重新鉴定。
Article 7 The people's procuratorate finding that the public security organ has taken temporary protective restraint measures against a mental patient involved in a case and falls under one of the following circumstances shall offer correction opinions according to the law:
