The Draft Version of the Law of the People's Republic of China on People's Assessors has been deliberated at the 31st Session of the Standing Committee of the Twelfth National People's Congress. The Draft Version of the Law of the People's Republic of China on People's Assessors is hereby issued on www.npc.gov.cn. The general public may directly log onto the website www.npc.gov.cn to make comments or send the comments to the Legislative Affairs Commission of the Standing Committee of the National People's Congress (located in No. 1 Qianmen West Street, Xicheng District, Beijing Municipality. Post Code: 100805. Please indicate “Requesting Comments on the Draft Version of the Law on People's Assessors” on the envelope.) The deadline for requesting comments is January 27, 2018.
 
第十二届全国人大常委会第三十一次会议对《中华人民共和国人民陪审员法(草案)》进行了审议。现将《中华人民共和国人民陪审员法(草案)》在中国人大网公布,社会公众可以直接登录中国人大网(www.npc.gov.cn)提出意见,也可以将意见寄送全国人大常委会法制工作委员会(北京市西城区前门西大街1号,邮编:100805。信封上请注明人民陪审员法草案征求意见)。征求意见截止日期:2018年1月27日。

Draft Version of the Law of the People's Republic of China on People's Assessors
 
中华人民共和国人民陪审员法(草案)

 
Article 1 This Law is developed for purposes of safeguarding citizens' participation in trial activities according to the law, carrying forward judicial democracy, promoting judicial justice, and improving judicial credibility.   第一条 为了保障公民依法参加审判活动,推进司法民主,促进司法公正,提升司法公信,制定本法。

 
Article 2 Any citizen has the right and obligation of serving as a people's assessor according to the law.   第二条 公民有依法担任人民陪审员的权利和义务。

A people's assessor shall be generated in accordance with this Law and he or she shall enjoy such rights as participating in trial activities, independently making comments, and obtaining guarantee for the performance of functions.
 
人民陪审员依照本法产生,依法享有参加审判活动、独立发表意见、获得履职保障等权利。

A people's assessor shall faithfully perform the obligations as an assessor, keep trial secrets, pay attention to judicial etiquette, and maintain judicial image.
 
人民陪审员应当忠实履行陪审义务,保守审判秘密、注重司法礼仪、维护司法形象。

 
Article 3 The people's assessors shall be protected by law when participating in trial activities according to the law.   第三条 人民陪审员依法参加审判活动,受法律保护。

The people's courts shall safeguard the people's assessors' participation in trial activities according to the law.
 
人民法院应当依法保障人民陪审员参加审判活动。

The employers of people's assessors or the basic-level organizations at the place of people's assessor's registered permanent residence or habitual residence shall safeguard the participation of people's assessors in trial activities according to the law.
 
人民陪审员所在单位、户籍所在地或者经常居住地的基层组织应当依法保障人民陪审员参加审判活动。

 
Article 4 To serve as a people's assessor, a citizen shall satisfy the following conditions:   第四条 公民担任人民陪审员,应当具备下列条件:

 
(1) upholds the Constitution of the People's Republic of China; (一)拥护中华人民共和国宪法

 
(2) has reached the age of 28; (二)年满二十八周岁;

 
(3) has good ethics and is impartial and upright; and (三)品行良好、公道正派;

 
(4) is in a proper health state to perform his or her functions and duties normally. (四)具有正常履行职责的身体条件。

To serve as a people's assessor, a citizen shall have the educational background of a senior high school or above.
 
担任人民陪审员,一般应当具有高中以上文化程度。

 
Article 5 Any of the following personnel may not serve as a people's assessor:   第五条 下列人员不能担任人民陪审员:

 
(1) members of the Standing Committee of the National People's Congress or staff members of the supervisory committees, people's courts, people's procuratorates, public security organs, state safety organs, and judicial administrative organs; (一)人民代表大会常务委员会组成人员,监察委员会、人民法院、人民检察院、公安机关、国家安全机关、司法行政机关的工作人员;

 
(2) practicing lawyers, basic legal service workers, or other personnel engaging in legal services; and (二)执业律师、基层法律服务工作者等从事法律服务工作的人员;

 
(3) personnel that are inappropriate to serve as people's assessors due to other reasons. (三)因其他原因不适宜担任人民陪审员的人员。

 
Article 6 Any of the following personnel is not allowed to serve as a people's assessor:   第六条 下列人员不得担任人民陪审员:

 
(1) has been given a criminal penalty due to committing a crime; (一)因犯罪受过刑事处罚的;

 
(2) is dismissed from public office; and (二)被开除公职的;

 
(3) is removed from the post of a people's assessor due to punishment. (三)因受惩戒被免除人民陪审员职务的。

 
Article 7 The quota of people's assessors shall be submitted by the basic-level people's court to the standing committee of the people's congress at the same level for determination.   第七条 人民陪审员的名额,由基层人民法院提请同级人民代表大会常务委员会确定。

The quota of people's assessors may not be lower than three times of that of judges of the people's courts.
 
人民陪审员的名额数不低于本院法官员额数的三倍。

 
Article 8 The people's assessors of the basic-level people's courts shall be randomly selected from the list of eligible local permanent residents.   第八条 基层人民法院的人民陪审员从符合条件的当地常住居民名单中随机抽选产生。

Due to needs of trial activities, a certain proportion of people's assessors may be generated by means of applications filed by individuals or recommendation by the employers or basic-level organizations at the place of registered permanent residence or habitual residence. The specific measures shall be developed by the Supreme People's Court.
 
因审判活动需要,一定比例的人民陪审员可以通过个人申请和所在单位、户籍所在地或者经常居住地的基层组织推荐的方式产生。具体办法由最高人民法院制定。

 
Article 9 The basic-level people's court shall, once every five years, randomly select personnel that are more than five times the number of judges of local courts from the list of eligible local permanent residents as candidates of people's assessors and establish an information database of candidates of people's assessors.   第九条 基层人民法院每五年从符合条件的常住居民名单中,随机抽选当地法院法官员额数五倍以上的人员作为人民陪审员候选人,建立人民陪审员候选人信息库。

The public security organ shall provide the basic-level people's court with the list of local permanent residents and on the basis of information on criminal records it grasps, examine whether such local permanent residents have criminal records.
 
公安机关应当向基层人民法院提供当地常住居民名单,并根据其掌握的犯罪记录信息对有无犯罪记录进行审核。

 
Article 10 The basic-level people's court shall, jointly with the judicial administrative organ at the same level, conduct qualification examination of candidates of people's assessors, solicit opinions from such candidates, and randomly select and determine people's assessors from the list of candidates who have passed the examination. The president of the basic-level people's court shall request the standing committee of the people's congress at the same level to appoint such people's assessors.

   第十条 基层人民法院会同同级司法行政机关对人民陪审员候选人进行资格审查,征求候选人意见,并从审核通过的候选人名单中随机抽选确定人民陪审员人选,由院长提请同级人民代表大会常务委员会任命。
