| Opinions on Establishing a System for Compulsory Reporting of Cases against Minors (for Trial Implementation) | | 关于建立侵害未成年人案件强制报告制度的意见（试行） |
| Article 1 For the purposes of effectively strengthening the comprehensive judicial protection of minors, and effectively punishing illegal criminal activities against minors in a timely manner, these Opinions are developed according to the Criminal Procedure Law of the People's Republic of China, the Law of the People's Republic of China on the Protection of Minors, the Anti-Domestic Violence Law of the People's Republic of China, the Law of the People's Republic of China on Medical Practitioners, and other relevant laws and regulations, in light of the reality of the protection of minors. | | 第一条 为切实加强对未成年人的全面综合司法保护，及时有效惩治侵害未成年人违法犯罪，根据《中华人民共和国刑事诉讼法》《中华人民共和国未成年人保护法》《中华人民共和国反家庭暴力法》《中华人民共和国执业医师法》及相关法律法规，结合未成年人保护工作实际，制定本意见。 |
| Article 2 Compulsory reporting of cases against minors means that state authorities, various organizations authorized by the laws and regulations to exercise public power, and public officials prescribed by laws, as well as various organizations in close contact with the industry of minors and their practitioners finding in work that minors suffer or are suspected of suffering illegal infringement and are at risk of illegal infringement shall immediately report the cases to or provide tip-off for the public security organs. | | 第二条 侵害未成年人案件强制报告，是指国家机关、法律法规授权行使公权力的各类组织及法律规定的公职人员，密切接触未成年人行业的各类组织及其从业人员，在工作中发现未成年人遭受或者疑似遭受不法侵害以及面临不法侵害危险的，应当立即向公安机关报案或举报。 |
| Article 3 For the purpose of these Opinions, “various organizations in close contact with the industry of minors” means enterprises and public institutions, basic autonomous people's organizations, and social organizations that are responsible for education, nursing, medical treatment, rescue, and guardianship of minors and assume other special duties for minors according to the law, or that assume no special duties but have conditions for close contact with minors, mainly including villagers' (residents') committees; primary and secondary schools, kindergartens, off-campus training institutions, off-campus arenas for minors, and other educational institutions and school bus service providers; nurseries and other nursery service institutions; hospitals, maternal and child health care hospitals, first aid centers, clinics, and other medical institutions; child welfare institutions, relief management institutions, minors' assistance and protection institutions, and social service agencies; as well as inns and hotels, among others. | | 第三条 本意见所称密切接触未成年人行业的各类组织，是指依法对未成年人负有教育、看护、医疗、救助、监护等特殊职责，或者虽不负有特殊职责但具有密切接触未成年人条件的企事业单位、基层群众自治组织、社会组织。主要包括：居（村）民委员会；中小学校、幼儿园、校外培训机构、未成年人校外活动场所等教育机构及校车服务提供者；托儿所等托育服务机构；医院、妇幼保健院、急救中心、诊所等医疗机构；儿童福利机构、救助管理机构、未成年人救助保护机构、社会工作服务机构；旅店、宾馆等。 |
| Article 4 For the purpose of these Opinions, circumstances found in work that minors suffer or are suspected of suffering illegal infringement and are at risk of illegal infringement include: | | 第四条 本意见所称在工作中发现未成年人遭受或者疑似遭受不法侵害以及面临不法侵害危险的情况包括： |
| (1) A minor has suffered or is suspected of having suffered abnormal damage to his or her reproductive organ or private part. | | （一）未成年人的生殖器官或隐私部位遭受或疑似遭受非正常损伤的； |
| (2) A female minor under the age of 14 has suffered or is suspected of having suffered sexual assault, pregnancy or miscarriage. | | （二）不满十四周岁的女性未成年人遭受或疑似遭受性侵害、怀孕、流产的； |
(3) A female minor over the age of 14 has suffered or is suspected of having suffered sexual assault which leads to pregnancy or miscarriage.
