| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 These Regulations are formulated in accordance with the Electric Power Law of the People's Republic of China for the purpose of strengthening the administration of the supply and use of electric power, safeguarding the lawful rights and interests of power suppliers and users, maintaining the order of power supply and use, and ensuring the safe, economical and rational supply and use of power. | | |
| Article 2 All electric power-supply enterprises (hereinafter referred to as power-supply enterprises), users of electric power (hereinafter referred to as consumers) and all units and individuals involved in power supply and use within the territory of the People's Republic of China shall observe these Regulations. | | 第一条 为了加强电力供应与使用的管理，保障供电、用电双方的合法权益，维护供电、用电秩序，安全、经济、合理地供电和用电，根据《中华人民共和国电力法》制定本条例。 |
| Article 3 The electric power administration department of the State Council shall be responsible for the work of supervision and control of the power supply and use throughout the country. | | |
| The electric power administration departments of the local people's governments at or above the county level shall be responsible for the work of supervision and control of the power supply and use in their respective administrative areas. | | 第二条 在中华人民共和国境内，电力供应企业（以下称供电企业）和电力使用者（以下称用户）以及与电力供应、使用有关的单位和个人，必须遵守本条例。 |
| Article 4 The enterprises that operate power networks shall be responsible for the business of power supply and use in their electric power service areas according to law, and shall be subject to the supervision of the local electric power administration departments. | | |
| Article 5 The State applies the administrative principles of safe, economical and planned supply and use of electric power. | | 第三条 国务院电力管理部门负责全国电力供应与使用的监督管理工作。 |
| Power-supply enterprises and consumers shall both observe the relevant provisions of the State by adopting effective measures to achieve the safe, economical and planned use of power. | | 县级以上地方人民政府电力管理部门负责本行政区域内电力供应与使用的监督管理工作。 |
| Article 6 The power-supply enterprises and consumers shall sign a contract for the supply and use of electric power on the basis of the principles of equality, voluntary participation and agreement reached through consultation. | | |
| Article 7 The electric power administration departments shall strengthen their supervision and administration of power supply and use, and coordinate the relations between power suppliers and consumers, and ban acts that endanger the safe supply and use of power and illegal use of electric energy. | | 第四条 电网经营企业依法负责本供区内的电力供应与使用的业务工作，并接受电力管理部门的监督。 |
| Chapter II Power-supply Service Areas | | |
| Article 8 Power-supply enterprises shall supply electricity to the consumers within their approved power-supply service areas. | | 第五条 国家对电力供应和使用实行安全用电、节约用电、计划用电的管理原则。 |
| In the division of power-supply service areas, factors such as the structure of power networks and the rationality of power supply shall be taken into account. There shall be only one power-supply agency in each power-supply service area. | | 供电企业和用户应当遵守国家有关规定，采取有效措施，做好安全用电、节约用电、计划用电工作。 |
| Article 9 To establish or alter a power-supply service area within the boundaries of a province, autonomous region or municipality directly under the Central Government, the power-supply enterprise shall submit an application to the electric power administration department under the people's government of the province, autonomous region, or municipality directly of the Central Government, which after examining and approving the application jointly with the relevant departments at the same level, shall issue to the enterprise a Power-supply Permit. Establishment or alteration of a power-supply service area spanning different provinces, autonomous regions or municipalities directly under the Central Government shall be examined and approved by the electric power administration department of the State Council, which shall issue a Power-supply Permit. | | |
| The enterprises that operate the power networks shall assist the electric power administration departments in the division of power-supply service areas in line with the structure of power networks and the rationality of power supply. | | 第六条 供电企业和用户应当根据平等自愿、协商一致的原则签订供用电合同。 |
| The measures concerning the administration and division of the power-supply service areas shall be formulated by the electric power administration department of the State Council. | | |
| Article 10 After the operation of a merged power-generating enterprise in line with the merger agreement, the electric power and quantity of electricity it transmits into the power network shall be marketed by the power supply agency in a unified manner. | | 第七条 电力管理部门应当加强对供用电的监督管理，协调供用电各方关系，禁止危害供用电安全和非法侵占电能的行为。 |
| Article 11 Where the electricity capacity of a consumer exceeds the supply capability of the power-supply enterprise within the power-supply service area in which it is located, its electricity shall be supplied by other power-supply enterprises designated by the power administration department at or above the provincial level. | | 第二章 供电营业区 |
| Chapter III Power-supply Facilities | | |
| Article 12 The people's governments at or above the county level shall include the planning for the construction and renovation of the power networks in cities and the countryside in their overall planning for urban and rural construction. The power administration departments at various levels shall, together with the competent administrative authorities and enterprises that operate power networks, work out the planning for the construction and renovation of the power networks in cities and countryside. The power-supply enterprises shall carry out the construction of power-supply facilities and the administration of the operation thereof according to the planning. | | 第八条 供电企业在批准的供电营业区内向用户供电。 |
| Article 13 The local people's governments at various levels shall, according to the overall planning for urban and rural construction, make overall arrangements of land used for the power line corridors, cable channels, regional substations, regional distribution stations and operation centers. | | 供电营业区的划分，应当考虑电网的结构和供电合理性等因素。一个供电营业区内只设立一个供电营业机构。 |
| The power-supply enterprises may, in accordance with the provisions of the State, erect transmission lines, lay cables and build public power-supply facilities along the land approved for line corridors and cable channels, regional substations, regional distribution stations and operation centers. | | |
| Article 14 The people's governments of townships, nationality townships, and towns and the related departments of local people's governments at or above the county level shall be responsible for the construction of road lights for public use, and shall be responsible for their operation and maintenance, and for paying electricity fees. They may entrust the power-supply enterprises with the design, construction, maintenance and administration of highway lighting with compensation. | | 第九条 省、自治区、直辖市范围内的供电营业区的设立、变更，由供电企业提出申请，经省、自治区、直辖市人民政府电力管理部门会同同级有关部门审查批准后，由省、自治区、直辖市人民政府电力管理部门发给《供电营业许可证》。跨省、自治区、直辖市的供电营业区的设立、变更，由国务院电力管理部门审查批准并发给《供电营业许可证》。 |
| Article 15 The design, construction, testing and operation of power-supply and recipient facilities shall meet the State standards or the standards of the power industry. | | 电网经营企业应当根据电网结构和供电合理性的原则协助电力管理部门划分供电营业区。 |
| Article 16 When power-supply enterprises or consumers construct and maintain power-supply and recipient facilities, the units and individuals in the operation zones shall give assistance, and make things easy. Any damage to buildings or crops due to the operations shall be repaired or rationally compensated according to the relevant provisions of laws and administrative regulations. | | 供电营业区的划分和管理办法，由国务院电力管理部门制定。 |
| Article 17 After public power-supply facilities put into operation, the power-supply units shall be responsible for their maintenance and management in a unified manner. With the approval of relevant electric power administration departments, the power-supply enterprises may use, renovate and expand these power-supply facilities. | | |
| The maintenance and management of shared power-supply facilities shall be decided through consultation by the owners of property rights. The property owning units may conduct the maintenance and management by themselves or entrust the work to a power-supply enterprise. | | 第十条 并网运行的电力生产企业按照并网协议运行后，送入电网的电力、电量由供电营业机构统一经销。 |
| After the power-supply facilities exclusively used by consumers put into operation, consumers may conduct the maintenance and management by themselves or entrust the work to a power-supply enterprise. | | |
| Article 18 Where the built power-supply facilities have to be moved, renovated or protective measures have to be taken therefor as necessitated by construction, the construction units shall consult the power-supply facilities management units in advance and cover all the costs arising therefrom. | | 第十一条 用户用电容量超过其所在的供电营业区内供电企业供电能力的，由省级以上电力管理部门指定的其他供电企业供电。 |
| Chapter IV Supply of Electric Power | | 第三章 供电设施 |
| Article 19 The quality of the electricity at the end users shall meet State standards or the standards of the power industry. | | |
| Article 20 The methods for power supply shall, on the basis of the principles of safety, reliability, economy, rationality and easy management, be agreed upon through consultation between the power suppliers and the consumers in accordance with relevant provisions of the State, and with such factors as power networks planning, demands for electricity and local power-supply conditions. | | 第十二条 县级以上各级人民政府应当将城乡电网的建设与改造规划，纳入城市建设和乡村建设的总体规划。各级电力管理部门应当会同有关行政主管部门和电网经营企业做好城乡电网建设和改造的规划。供电企业应当按照规划做好供电设施建设和运行管理工作。 |
| In places which have no public power-supply facilities, the power-supply enterprises may entrust the units that have the capacity to supply electricity with the supply of electricity to such places in their vicinity. No unit may supply electricity to any of such places unless it is entrusted by a power-supply enterprise. | | |
| Article 21 In the event of emergency or disaster, the power-supply enterprise shall, as quickly as possible, make arrangements to supply electricity for rescue and relief work. The expenses for power supply engineering and the fees for the use of electricity shall be paid by relevant departments of relevant local people's governments from the rescue and relief funds; but the electricity fees for drought relief shall be paid by the consumers. | | 第十三条 地方各级人民政府应当按照城市建设和乡村建设的总体规划统筹安排城乡供电线路走廊、电缆通道、区域变电所、区域配电所和营业网点的用地。 |
| Article 22 Where consumers raise special requirements concerning electricity quality, the power-supply enterprise shall satisfy the requirements according to necessity and the possible capacity of the power network. | | 供电企业可以按照国家有关规定在规划的线路走廊、电缆通道、区域变电所、区域配电所和营业网点的用地上，架线、敷设电缆和建设公用供电设施。 |
| Article 23 New electricity consumers, temporary consumers and consumers who wish to have their electric capacity increased, to alter or terminate their use of electricity shall go through the formalities with the power-supply enterprises in their vicinity and pay fees according to relevant provisions of the State; the power-supply enterprises shall supply electricity if it has no justified reason for not supplying electricity. The power-supply enterprise shall make known to the consumers in its service area the procedures, regulations and the rate for use of electricity. | | |
| Article 24 The power-supply enterprises shall involve themselves in the verification of the design drawings of consumers' current-collecting-and-transmitting devices according to State standards or the standards of the power industry, and supervise the construction process of hidden projects of consumers' current-collecting-and-transmitting devices. It shall also examine those projects of the current-collecting-and-transmitting devices after they are completed. Such projects may be put into operation only after they are examined and found to be up to the requirements. | | 第十四条 公用路灯由乡、民族乡、镇人民政府或者县级以上地方人民政府有关部门负责建设，并负责运行维护和交付电费，也可以委托供电企业代为有偿设计、施工和维护管理。 |
| Article 25 The power-supply enterprises shall, in accordance with relevant provisions of the State, institute two systems for fixing electricity rates: one is to set the rates according to different kinds of consumers; the other is to set the rates according to the different period of time that electricity is used. | | |
| Article 26 Consumers shall install electricity meters. The electric power and the quantity used by consumers shall be calculated according to the records of the electricity meters approved by a measurement appraisal institution in conformity with legal provisions. The electricity meters shall be installed at the demarcation point of property rights of the power-supply facilities and the current-collecting facilities. | | 第十五条 供电设施、受电设施的设计、施工、试验和运行，应当符合国家标准或者电力行业标准。 |
| The electricity meters installed at the consumers' sites shall be protected by themselves. | | |
Article 27 Power-supply enterprises shall calculate and collect electricity fees from the consumers according to the electricity rates that have been examined and approved by the State and the records of the electricity meters.
