| Article 1 For the purposes of regulating the administrative licensing for the relocation and reconstruction of meteorological offices and stations, protecting the legitimate rights and interests of citizens, legal persons and other organizations, and guaranteeing and supervising the effective implementation of administration by the competent departments of meteorology, these Measures are developed in accordance with the Administrative License Law of the People's Republic of China, the Meteorology Law of the People's Republic of China, the Regulation on the Protection of Meteorological Facilities and Meteorological Observation Environment and other relevant laws and regulations. | | 第一条 为规范气象台站迁建行政许可行为，保护公民、法人和其他组织的合法权益，保障和监督气象主管机构有效实施行政管理，根据《中华人民共和国行政许可法》、《中华人民共和国气象法》、《气象设施和气象探测环境保护条例》等有关法律法规，制定本办法。 |
| Article 2 These Measures shall apply to the administrative licensing for the relocation and reconstruction of meteorological offices and stations which are necessary because the construction of key national projects or the changes in the master planning for cities (towns) truly cannot avoid affecting meteorological observation environment and remedial measures cannot be taken. | | 第二条 本办法适用于因国家重点工程建设或者城市（镇）总体规划变化，确实无法避免影响气象探测环境，且无法采取补救措施，需要迁建气象台站的行政许可。 |
| For the purpose of these Measures, “relocation and reconstruction” means the relocation of observation sites, observation facilities and supporting auxiliary facilities and infrastructures, among others, from current sites to new sites. | | 本办法所称迁建，是指将气象台站的观测场所、探测设施及配套的附属和基础设施等从现址迁移到新址的活动。 |
| Article 3 The competent department of meteorology of the State Council shall be responsible for the approval and administration of the administrative licensing for relocation and reconstruction of atmospheric background stations, national reference climate stations, and national basic meteorological stations and for the supervision and administration of the administrative licensing for the relocation and reconstruction of other meteorological offices and stations. | | 第三条 国务院气象主管机构负责大气本底站、国家基准气候站和国家基本气象站迁建行政许可的审批和管理，并对其他气象台站迁建行政许可行为进行监督管理。 |
| The competent departments of meteorology of provinces, autonomous regions, and municipalities directly under the Central Government shall be responsible for the approval and administration of the administrative licensing for the relocation and reconstruction of other meteorological offices and stations within their respective administrative regions and for the preliminary examination and administration of the administrative licensing for the relocation and reconstruction of atmospheric background stations, national reference climate stations and national basic meteorological stations. | | 省、自治区、直辖市气象主管机构负责本行政区域内其他气象台站迁建行政许可的审批和管理，并承担大气本底站、国家基准气候站和国家基本气象站迁建行政许可的初审和管理。 |
| Article 4 Applications for the relocation and reconstruction of meteorological offices and stations shall be filed with the construction employers or the local people's governments at or above the county level with the competent departments of meteorology of these provinces, autonomous regions, and municipalities directly under the Central Government. | | 第四条 申请迁建气象台站的，应当由建设单位或者县级以上地方人民政府向本省、自治区、直辖市气象主管机构提出申请。 |
| Article 5 A new site to which a meteorological office or station is to be relocated shall meet all of the following requirements: | | 第五条 拟迁新址必须同时满足以下要求： |
| (1) It can represent the weather and climate characteristics of the area where the current site is located. | | （一）能够代表现址所在区域的天气气候特征； |
| (2) It conforms to the layout of the national meteorological observation station network. | | （二）符合全国气象观测站网布局； |
| (3) It conforms to the laws, regulations and standards and the technical specifications for and administration provisions on meteorological observation environment issued by the competent department of meteorology of the State Council. | | （三）符合法律、法规、标准和国务院气象主管机构对气象探测环境的技术规范和管理规定； |
| (4) It occupies the land that meets the requirements for construction land, obtains the right to use the land, covers an area that meets the layout requirements for observation sites, observation facilities, business premises and auxiliary houses and supporting facilities, and has reserved the business development space commensurate with the functions of the meteorological office or station. | | （四）土地符合建设用地要求，取得土地使用权，占地面积满足观测场地、探测设施、业务用房和辅助用房以及配套设施的布局要求，并预留与气象台站功能相适应的业务发展空间； |
| (5) It has necessary basic conditions for power supply, water supply, transportation, and communication, among others. | | （五）具备必要的供电、供水、交通、通信等基础条件； |
| (6) It conforms to the relevant provisions of the Regulation of the People's Republic of China on Radio Administration when the radio business is involved. | | （六）涉及无线电业务的，符合《中华人民共和国无线电管理条例》的相关规定。 |
| Article 6 An applicant shall, when filing an application, provide the following materials to the accepting institution: | | 第六条 申请人在提出申请时，应向受理机构提供以下材料： |
| (1) Application form for the relocation and reconstruction of a meteorological office or station. | | （一）气象台站迁建申请表； |
| (2) Meteorological office or station site selection report. | | （二）气象台站选址报告书； |
| (3) Letter of entrustment which shall be issued in case of entrusted agency. | | （三）委托代理的，应出具代理委托函； |
| (4) The applicant's commitment to the authenticity of the materials provided. | | （四）申请人对所提供材料真实性负责的承诺。 |
| Article 7 The applications for the relocation and reconstruction of the meteorological offices and stations shall be accepted by competent departments of meteorology of provinces, autonomous regions, and municipalities directly under the Central Government. | | 第七条 迁建气象台站的申请由省、自治区、直辖市气象主管机构受理。 |
The competent department of meteorology of a province, autonomous region, or municipality directly under the Central Government shall, within five working days from the date of receipt of all application materials, make a written decision on whether to accept the application or not in accordance with the provisions of Article 32 of the Administrative License Law of the People's Republic of China, and issue a written certificate. If the application is not accepted, the reasons therefor shall be given in writing.
