| Implementing Plan on Cleaning up and Standardizing the Examination and Approval Items for Submitting Investment Projects for Construction Approval | | 清理规范投资项目报建审批事项实施方案 |
| The efforts to clean up and standardize the examination and approval items for submitting investment projects for construction approval are not only important aspects of promoting the reforms of simplification of administrative procedures, decentralization of powers, combination of decentralization with appropriate control, and optimization of services, but also major initiatives to smoothen the "last kilo" before the construction commencement of investment projects, lower transaction costs in terms of regulation and stimulate the vitality of private investment. This Plan is formulated according to the work deployments of the State Council on further simplifying and consolidating the procedures for submitting investment projects for construction approval. | | 清理规范投资项目报建审批事项，既是推进简政放权、放管结合、优化服务改革的重要内容，也是打通投资项目开工前“最后一公里”、降低制度性交易成本、激发社会投资活力的重要举措。按照国务院关于进一步简化、整合投资项目报建手续的工作部署，制定本方案。 |
| 1. Scope and principles of clean-up and standardization | | 一、清理规范的范围和原则 |
| (1) Scope. | | （一）范围。 |
| Examination and approval items for submitting investment projects for construction approval shall refer to the administrative examination and approval items implemented by relevant departments and entities pursuant to laws and regulations with regard to project entities after the application reports or feasibility study reports of their investment projects are approved upon verification or reply but before construction of the investment projects commences. A total of 65 examination and approval items for submitting investment projects for construction approval are included in this round of clean-up and standardization. | | 投资项目报建审批事项，是投资项目申请报告核准或者可行性研究报告批复之后、开工建设之前，由相关部门和单位依据法律法规向项目单位作出的行政审批事项。此次纳入清理规范的投资项目报建审批事项共计65项。 |
| (2) Principles. | | （二）原则。 |
| First, examination and approval items that lack legal basis and are not included in the list of administrative examination and approval items decided to be retained by the State Council shall all be cancelled without exception; | | 一是凡没有法律法规依据、未列入国务院决定保留的行政审批事项目录的，一律取消审批。 |
| Second, examination and approval items that have legal bases but are no longer necessary to be retained shall be cancelled by revising relevant laws; | | 二是虽有法律法规依据，但已没有必要保留的，要通过修法取消审批。 |
| Third, examination and approval items that can be resolved by examination and approval authorities through consulting relevant departments or through follow-up regulatory operations shall all be cancelled without exception; and | | 三是审批机关能够通过征求相关部门意见或者能够通过后续监管解决的事项，一律取消审批。 |
| Fourth, optimization and consolidation efforts shall be step up with regard to examination and approval items that genuinely need to be retained. Multiple examination and approval items that are handled by the same department shall be consolidated into a single examination and approval matter if they are similar in terms of the aspects subject to administration or if they belong to the same processing stage. In addition, a uniform platform shall be adopted to optimize the process, and improve the efficiency, of items that are handled by the same level of local governments. | | 四是对确需保留的审批事项，加大优化整合力度。由同一部门实施的管理内容相近或者属于同一办理阶段的多个审批事项，应整合为一个审批事项。属于同一层级地方政府办理的事项，应通过统一平台优化流程、提高效率。 |
| 2. Details of clean-up and standardization | | 二、清理规范的内容 |
| Of the 65 examination and approval items for submitting investment projects for construction approval: 34 items shall be retained; 24 items shall be consolidated into eight items; and, the remaining seven items shall no longer be listed as administrative examination and approval items, with two of them being changed to solicitation of opinions between departments and the other five items involving mandatory safety assessment. After the clean-up and standardization, the number of examination and approval items for submitting investment projects for construction approval shall be reduced to 42. | | 65项报建审批事项中，保留34项，整合24项为8项；改为部门间征求意见的2项，涉及安全的强制性评估5项，不列入行政审批事项。清理规范后报建审批事项减少为42项。 |

| Five items under departments of housing and urban-rural development: verification and issuance of the construction land planning permit (including temporary land use); verification and issuance of the rural construction planning permit; verification and issuance of the building project construction permit; examination and approval of the anti-seismic designs of high-rise buildings that exceed height limits; and, examination and approval of construction activities within scenic spots. | | 住房城乡建设部门5项：建设用地（含临时用地）规划许可证核发、乡村建设规划许可证核发、建筑工程施工许可证核发、超限高层建筑工程抗震设防审批、风景名胜区内建设活动审批。 |
| Five items under transport departments: review of water transport engineering design documents; examination and approval of highway construction project designs; licensing for the construction of highway construction projects; review of the navigable conditions impact assessment of channels; and, examination and approval of the use of port coastlines. | | 交通运输部门5项：水运工程设计文件审查、公路建设项目设计审批、公路建设项目施工许可、航道通航条件影响评价审核、港口岸线使用审批。 |
| Four items under departments of land and resources: examination and approval of using agricultural land for other purposes; examination and approval of land requisition; examination and approval of land supply plans; and, examination and approval of the locations of construction projects that cover important mineral deposits. | | 国土资源部门4项：农用地转用审批、土地征收审批、供地方案审批、建设项目压覆重要矿床审批。 |
Three items under departments of water resources: written opinions on the impact of agricultural irrigation and drainage; examination and approval of the water and soil conservation plans for production and construction projects; and, examination and approval of the preliminary design documents for water conservancy infrastructure projects.
