To properly settle the administrative disputes and legally examine the changes made by the administrative authority to the alleged specific administrative action and application for withdrawal of an administrative suit in the process of administrative litigation, these Rules have been made in accordance with the Administrative Litigation Law of the People's Republic of China. | |
为妥善化解行政争议，依法审查行政诉讼中行政机关改变被诉具体行政行为及当事人申请撤诉的行为，根据《中华人民共和国行政诉讼法》制定本规定。 |

| Article 1 Where, after examination, the people's court considers that the alleged specific administrative action is illegal or improper, the people's court may suggest the defendant to change its specific administrative action before announcing a judgment or ruling. | | 第一条 人民法院经审查认为被诉具体行政行为违法或者不当，可以在宣告判决或者裁定前，建议被告改变其所作的具体行政行为。 |

| Article 2 Where the defendant changes the alleged specific administrative action and the plaintiff applies for withdrawal of the suit, the people's court shall made a ruling on approval of withdrawal of the suit, provided that the following conditions are satisfied: | | 第二条 被告改变被诉具体行政行为，原告申请撤诉，符合下列条件的，人民法院应当裁定准许： |

| 1. The application for withdrawal of the suit represents the true intention of the plaintiff; | | （一）申请撤诉是当事人真实意思表示； |

2. The changes made by the defendant to the alleged specific administrative action does not violate the prohibitive provisions of the laws and administrative regulations, does not exceed or waive its functions, and does not damage the public interests and legal rights and interests of others;
