| Decision of the Ministry of Commerce to Amend Some Rules | | 商务部关于修改部分规章的决定 |
| For the purposes of further deepening the reform of simplification of administrative procedures, decentralization of powers, combination of decentralization with appropriate control, and optimization of services, according to the requirements of the State Council, the Ministry of Commerce has reviewed relevant rules and hereby decides to: | | 为继续深化简政放权、放管结合、优化服务改革，根据国务院要求，商务部对相关规章进行了清理，现决定： |
| I. Amend the Measures for the Bidding for the Quotas of Export Commodities. | | 一、对《出口商品配额招标办法》予以修改。 |
| 1. In Article 3, “Ministry of Foreign Trade and Economic Cooperation (“MOFTEC”) is replaced with “Ministry of Commerce”. | | （一）将第三条中的“对外贸易经济合作部（以下简称外经贸部）”修改为“商务部”。 |
| In Article 3, one paragraph is added as paragraph 2: “The Ministry of Commerce shall supervise and inspect the application for and use of bidding quotas of export. ” | | 第三条增加一款，作为第二款：“商务部对申请、使用出口招标配额的活动进行监督检查。” |
| 2. In Articles 7, 8, 11, 31, 32, 34, 35, 36, 43, 44 and 45, “MOFTEC” is replaced with “Ministry of Commerce ”. | | （二）将第七条、第八条、第十一条、第三十一条、第三十二条、第三十四条、第三十五条、第三十六条、第四十三条、第四十四条、第四十五条中的“外经贸部”修改为“商务部”。 |
| In Articles 12 and 32, “All local departments of foreign trade” is replaced with “all local commerce departments”. | | 将第十二条、第三十二条中的“各地方外经贸主管部门”修改为“各地方商务主管部门”。 |
| 3. In Article 7, “The Bidding Committee shall be composed of the leaders of the MOFTEC and the personnel of the relevant departments and bureaus” is replaced with “The Bidding Committee shall be composed of the relevant departments and bureaus of the Ministry of Commerce”. | | （三）将第七条中的“招标委员会由外经贸部领导及有关司局的人员组成”修改为：“招标委员会由商务部有关司局组成”。 |
| 4. Item (4) of paragraph 1 of Article 8 is amended to read: “accepting the quotas handed over by enterprises and recordation for the transfer and acceptance of quotas.” | | （四）将第八条第一款第四项修改为：“受理企业上交配额以及配额转受让备案”。 |
| In paragraph 1 of Article 8, one item is added as item (7): “Other matters concerning bidding for export quota.” | | 第八条第一款增加一项，作为第七项：“有关出口配额招标投标的其他事务。” |
| In Article 8, one paragraph is added as paragraph 2: “The Bidding Committee may, according to the work needs, entrust chambers of commerce for import and export, related industry organizations and other relevant entities (hereinafter referred to as “entrusted service entities”) with the matters concerning the bidding services for export quotas.” | | 第八条增加一款，作为第二款：“招标委员会根据工作需要，可以委托进出口商会或相关行业组织等有关单位（以下简称委托服务单位）承担出口配额招标投标服务相关事务。” |
| 5. Articles 9 and 10 are deleted. | | （五）删去第九条、第十条。 |
| 6. Paragraph 2 of Article 11 is amended to read: “Various export enterprises (including foreign-funded enterprises) that have qualifications for import and export business operation, have been registered with the administrative departments for industry and commerce, and have undergone recordation and registration for foreign trade operators, and whose volume of export or amount of export supply of related commodities reaches certain scale, may participate in bidding if they meet the bidding conditions. The specific measures shall be separately prescribed by the Ministry of Commerce.” | | （六）将第十一条第二款修改为：“凡具有进出口经营资格、在工商行政管理部门登记注册、办理对外贸易经营者备案登记、相关商品的出口额或出口供货额达到一定规模的各类出口企业（含外商投资企业），符合招标条件，可参加投标。具体办法由商务部另行规定。” |
| 7. Article 12 is amended to read: “The commerce departments of all provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning, and Xinjiang Production and Construction Corps (hereinafter referred to as the “local commerce departments”) shall be responsible for verifying the qualifications of bidding enterprises in the local areas and submitting relevant materials to the Ministry of Commerce.” | | （七）将第十二条修改为：“各省、自治区、直辖市、计划单列市及新疆生产建设兵团商务主管部门（以下简称地方商务主管部门）负责对本地区投标企业资格进行核查并向商务部报送有关材料。” |
| 8. In Articles 15, 22, 26 and 29, “Bidding Office” is replaced with “Bidding Committee”. | | （八）将第十五条、第二十二条、第二十六条、第二十九条中的“招标办公室”修改为“招标委员会”。 |
| 9. In Article 20, “The total bid winning amount of a foreign-funded enterprise in a whole year shall be limited to the scale of export ratified by the MOFTEC” is deleted. | | （九）删去第二十条中的“外商投资企业全年的中标总量以外经贸部核定的出口规模为限”。 |
| 10. Article 21 is amended to read: “The Ministry of Commerce shall issue bidding announcements according to the provisions.” | | （十）将第二十一条修改为：“商务部按照规定发布招标公告。” |
| 11. In Article 22, “The Bidding Office must, within three working days from the date of issuance, report the preliminary bid winning results to the Bidding Committee for examination and approval” is deleted. | | （十一）删去第二十二条中的“招标办公室须在公布日起3个工作日内将初步中标结果报招标委员会审定”。 |
| 12. Article 23 is amended to read: “After examining and approving the bid winning results, the Bidding Committee shall announce the list of bid winning enterprises.” | | （十二）将第二十三条修改为：“招标委员会审定中标结果后，公布中标企业名单。” |
| 13. In paragraph 1 of Article 24, “Central Fund for Developing Foreign Trade” is replaced with “general public budget for management and be turned over to the State Treasury”, and in Article 43, “Central Fund for Developing Foreign Trade” is replaced with “special funds for the development of foreign trade and economic cooperation”. | | （十三）将第二十四条第一款中的“中央外贸发展基金”修改为“一般公共预算管理并上缴中央国库”，将第四十三条中的“中央外贸发展基金”修改为“外经贸发展专项资金”。 |
| Paragraph 2 of Article 24 is amended to read: “Matters concerning the collection of bid winning margin and bid winning money may be entrusted to the entrusted service entities and the relevant receipts shall be turned over to the State Treasury according to the applicable provisions.” | | 将第二十四条第二款修改为：“收取中标保证金和中标金的有关事务可委托委托服务单位办理，按规定上缴中央国库。” |

Article 26 is amended to read: “The Bidding Committee shall, after receiving the bid winning money paid by an enterprise, issue a bid winning certification document for quotas of export commodities (hereinafter referred to as “bid winning certification document”) to be used for applying for the Export License of the People's Republic of China (hereinafter referred to as the “Export License”) to the enterprise. | | （十四）将第二十六条修改为：“在收到企业交纳的中标金后，招标委员会向企业发放用于申领《中华人民共和国出口许可证》（简称为出口许可证）的出口商品配额招标中标证明文件（以下简称中标证明文件）。” |
| 15. Article 33 is amended to read: “All relevant license-issuing authorities shall verify and issue export licenses according to the applicable provisions and bid winning certification documents.” | | （十五）将第三十三条修改为：“各有关许可证发证机构按照有关规定和中标证明文件核发出口许可证。” |
| II. Amend the Interim Measures for the Administration of Import Tariff Quotas for Fertilizers, with the consent of the General Administration of Customs. | | 二、经商海关总署同意，修改《化肥进口关税配额管理暂行办法》。 |
| 1. In Article 4, “State Economic and Trade Commission (“SETC”)” is replaced with “Ministry of Commerce”. | | （一）将第四条中的“国家经济贸易委员会（以下简称国家经贸委）”修改为“商务部”。 |
| In Articles 5, 6, 9, 11, 12, 14, 17, 22, 23 and 27, “SETC” is replaced with “Ministry of Commerce”. | | 将第五条、第六条、第九条、第十一条、第十二条、第十四条、第十七条、第二十二条、第二十三条、第二十七条中的“国家经贸委”修改为“商务部”。 |
