The Provisional Rules on Antidumping Investigations by Questionnaires were deliberated and adopted at the fifth meeting of the Ministry of Foreign Trade and Economic Cooperation on March 13, 2002. They are hereby promulgated and shall be implemented as of April 15, 2002. | |
《反倾销问卷调查暂行规则》已经于２００２年３月１３日第五次外经贸部部务会议审议通过，现予发布，自２００２年４月１５日起施行。 |

| Chapter I. General Provisions | | 第一章 总则 |

| Article 1 For the purpose of securing antidumping investigations by questionnaires to proceed in a normal and orderly manner, these Rules are formulated in accordance with the Antidumping Regulation of the People's Republic of China. | | 第一条 为了保证反倾销问卷调查规范有序地进行，根据《中华人民共和国反倾销条例》的规定，制定本规则。 |

| Article 2 The Ministry of Foreign Trade and Economic Cooperation designates the Bureau for Fair Trade of Imports and Exports to be responsible for the administration of these Rules. | | 第二条 对外贸易经济合作部（以下简称外经贸部）指定进出口公平贸易局负责实施本规则。 |

| Article 3 These Rules apply to the antidumping investigations by questionnaires, which are done by the MOFTEC for determining the dumping and the margin of dumping. | | 第三条 本规则适用于外经贸部为确定倾销及倾销幅度而通过调查问卷方式进行的反倾销调查。 |

| Article 4 The term "questionnaire" as mentioned in these Rules refers to a written form containing a set of questions, which is distributed by the MOFTEC, during the course of antidumping investigation, to the producers or exporters of the inspected country (region) that apply for responding to the antidumping investigation (hereinafter to the responding companies). | | 第四条 本规则所称的调查问卷是指在反倾销调查中，外经贸部向报名应诉的被调查国家（地区）的生产商或出口商（以下简称应诉公司）发放的书面问题单。 |

| Article 5 A responding company shall, according to the requirements of the MOFTEC, completely and precisely answer the questions as listed in the questionnaires, and shall submit the information and materials as required in the questionnaires. | | 第五条 应诉公司应按照外经贸部的要求，完整而准确地回答调查问卷中所列问题，提交调查问卷中所要求的信息和材料。 |

| Chapter II. Distribution of Questionnaires | | 第二章 问卷发放 |

| Article 6 The producers or exporters of the inspected country (region) shall, within 20 days after the acceptance of a antidumping investigation case, file an application with the MOFTEC for response. | | 第六条 被调查国家（地区）的生产商或出口商应自反倾销立案之日起２０天内，按照立案公告的要求，向外经贸部报名应诉。 |

| Article 7 When a producer or exporter who files an application with the MOFTEC for making a response, it shall submit the following information in simplified Chinese characters of print fonts: | | 第七条 报名应诉的生产商或出口商向外经贸部报名应诉时，应以印刷体简体中文形式提交以下信息： |

| (1)The intention to make a response; | | （一）报名应诉的意思表示； |
| |
|
| (2)The name, address, legal representative, contact information and contact person of the responding company; | | （二）应诉公司的名称、地址、法定代表人、联系方式和联系人； |
| |
|
| (3)Total volume and amount of product under investigation exported to the People's Republic of China within the period under investigation. | | （三）调查期内向中华人民共和国出口被调查产品的总数量、总金额。 |
The application for response shall bear the seal of the responding company or shall be signed by its legal representative. | |
报名应诉文件应有应诉公司的盖章和（或）其法定代表人的签字。 |
If the application is submitted by a practicing attorney of the People's Republic of China upon entrustment, it shall state the name and contact information of the attorney and the name and address of the law firm for which he works, and shall be accompanied by the original power of attorney. | |
应诉公司委托中华人民共和国的执业律师代理呈送的，应列出代理律师的姓名、联系方式、所在的律师事务所及其地址，并附授权委托书原件。 |

| Article 8 The questionnaires shall be distributed to the responding companies within 10 working days as of the deadline for application. | | 第八条 调查问卷应在报名应诉截止之日起１０个工作日内向应诉公司发放。 |
| |

| Article 9 If there are too many responding companies and if the MOFTEC decides to conduct a sampled antidumping investigation, the questionnaires may be only distributed to the responding companies as selected. | | 第九条 如应诉公司数量过多，外经贸部决定采取抽样的方式进行反倾销调查的，调查问卷可以只发放给经抽样选中的应诉公司。 |
For a sampled investigation, the MOFTEC may properly make an extension to the time limit for the distribution of questionnaires. | |
涉及抽样调查的，外经贸部可对发放问卷的期限进行适当延长。 |

| Chapter III Requirements for Questionnaires | | 第三章 答卷要求 |

| Article 10 A responding company shall submit complete and accurate replies to the questionnaires within the prescribed time limit. The questionnaire replies shall include all the information as required in the questionnaires. | | 第十条 应诉公司应在规定时间内提交完整而准确的答卷。答卷应当包括调查问卷所要求的全部信息。 |

Article 11 If a responding company has any question about the questionnaires when it gives replies thereto, it may consult in writing the case investigators as listed in the questionnaires.
