公共场所卫生管理条例

(Issued by the State Council on April 1, 1987; revised in accordance with the Decision of the State Council to Amend Certain Administrative Regulations on February 6, 2016, and amended in accordance with the Decision of the State Council to Amend Some Administrative Regulations by Order No. 714 of the State Council on April 23, 2019) (1987年4月1日国务院发布 根据2016年2月6日《国务院关于修改部分行政法规的决定》修订 根据2019年4月23日国务院令第714号《国务院关于修改部分行政法规的决定》修正)

Chapter I General Provisions 

第一章 总  则

Article 1 This Regulation is developed for the purpose of creating good sanitary conditions for public places, preventing diseases, and protecting the health of the public.   第一条 为创造良好的公共场所卫生条件,预防疾病,保障人体健康,制定本条例。
Article 2 This Regulation shall apply to the following public places:   第二条 本条例适用于下列公共场所:
(1) Hotels, restaurants, inns, rest houses, coffee bars, pubs, and tea houses. (一)宾馆、饭馆、旅店、招待所、车马店、咖啡馆、酒吧、茶座;
(2) Public bath rooms, barbershops, and beauty salons. (二)公共浴室、理发店、美容店;
(3) Theaters, video rooms, entertainment halls, ballrooms, and music halls. (三)影剧院、录像厅(室)、游艺厅(室)、舞厅、音乐厅;
(4) Stadiums, swimming pools, and parks. (四)体育场(馆)、游泳场(馆)、公园;
(5) Exhibition halls, museums, galleries, and libraries. (五)展览馆、博物馆、美术馆、图书馆;
(6) Shopping malls (stores) and book stores. (六)商场(店)、书店;
(7) Waiting rooms (at hospitals, bus stations or ports), and public means of transport. (七)候诊室、候车(机、船)室、公共交通工具。
Article 3 The following items of public places shall satisfy relevant national health standards and requirements:   第三条 公共场所的下列项目应符合国家卫生标准和要求:
(1) Air and microclimate (humidity, temperature, and wind speed). (一)空气、微小气候(湿度、温度、风速);
(2) Water quality. (二)水质;
(3) Natural light and illumination. (三)采光、照明;
(4) Noise level. (四)噪音;
(5) Utensils and sanitary fixture. (五)顾客用具和卫生设施。
The health administrative department of the State Council shall be responsible for the development of sanitary standards and requirements for public places. 公共场所的卫生标准和要求,由国务院卫生行政部门负责制定。
Article 4 The state shall apply ‘hygiene permit' system to public places.   第四条 国家对公共场所实行“卫生许可证”制度。
A “sanitary permit” shall be issued by the administrative departments of public health at or above county level. “卫生许可证”由县以上卫生行政部门签发。
Chapter II Sanitation Management 

第二章 卫 生 管 理

Article 5 The competent departments of public places shall establish a sanitation management system, assign full- or part-time sanitation management personnel to conduct regular inspections of the sanitary conditions of their affiliated operating entities (including individual businesses, here and below), and provide necessary conditions.   第五条谁敢欺负我的人 公共场所的主管部门应当建立卫生管理制度,配备专职或者兼职卫生管理人员,对所属经营单位(包括个体经营者,下同)的卫生状况进行经常性检查,并提供必要的条件。
Article 6 An operating entity shall be responsible for the sanitation management of the public places operated by it, establish a sanitation accountability system and conduct training and examination for its employees in respect of the knowledge on sanitation.   第六条 经营单位应当负责所经营的公共场所的卫生管理,建立卫生责任制度,对本单位的从业人员进行卫生知识的培训和考核工作。
Article 7 A person directly serving customers in public places shall assume his or her post only after holding a “health certificate.” Any person who suffers dysentery, typhoid fever, viral hepatitis, active tuberculosis, suppurative or exudative skin disease or other disease that may hinder the public sanitation is not allowed to directly serve customers until he or she has fully recovered.   第七条 公共场所直接为顾客服务的人员,持有“健康合格证”方能从事本职工作。患有痢疾、伤寒、病毒性肝炎、活动期肺结核、化脓性或者渗出性皮肤病以及其他有碍公共卫生的疾病的,治愈前不得从事直接为顾客服务的工作。
Article 8 The operating entities of public places other than parks, stadiums, and means of public transport shall, in a timely manner, apply to the administrative departments of public health for “sanitary permits.” A “sanitary permit” shall be reviewed once every two years.   第八条 除公园、体育场(馆)、公共交通工具外的公共场所,经营单位应当及时向卫生行政部门申请办理“卫生许可证”。“卫生许可证”两年复核一次。
Article 9 Where any accident that is hazardous to public health occurs in a public place due to failure to satisfying the sanitary standards and requirements, the operating entity shall take proper measures and report such an accident to the health and epidemic prevention institution in a timely manner.   第九条 公共场所因不符合卫生标准和要求造成危害健康事故的,经营单位应妥善处理,并及时报告卫生防疫机构。
Chapter III Supervision of Sanitation 

第三章 卫 生 监 督

Article 10 The health and epidemic prevention institutions at all levels shall take charge of the supervision of sanitation in public places within their respective jurisdictions.   第十条 各级卫生防疫机构,负责管辖范围内的公共场所卫生监督工作。
The health and epidemic prevention institutions of civil aviation, railway, transport, factories and mines shall conduct supervision of sanitation in public places within their respective jurisdictions, and accept the professional guidance given by the local health and epidemic prevention institutions. 民航、铁路、交通、厂(场)矿卫生防疫机构对管辖范围内的公共场所,施行卫生监督,并接受当地卫生防疫机构的业务指导。
Article 11 The health and epidemic prevention institutions may set up sanitation supervisors of public places as needed, who shall execute the tasks assigned by the local health and epidemic prevention institutions. The local people's governments at the same level shall issue certificates to the sanitation supervisors of public places.   第十一条
装完逼就跑
 卫生防疫机构根据需要设立公共场所卫生监督员,执行卫生防疫机构交给的任务。公共场所卫生监督员由同级人民政府发给证书。
The competent departments at a higher level of the health and epidemic prevention institutions of civil aviation, railway, transport, factories and mines shall issue certificates to the sanitation supervisors of public places in such institutions. 民航、铁路、交通、工矿企业卫生防疫机构的公共场所卫生监督员,由其上级主管部门发给证书。
Article 12 The responsibility of the health and epidemic prevention institutions for supervision of sanitation in public places shall include:   第十二条 卫生防疫机构对公共场所的卫生监督职责:
(1) Conducting monitoring of sanitation in public places and giving technical guidance to sanitation in public places. (一)对公共场所进行卫生监测和卫生技术指导;
(2) Supervising the physical examination of practitioners, and giving guidance to relevant departments in providing education and training for practitioners in respect of the knowledge on sanitation. (二)监督从业人员健康检查,指导有关部门对从业人员进行卫生知识的教育和培训;
Article 13 Sanitation supervisors shall have the right to conduct on-site inspection of public places and claim for relevant materials, and the operating entities shall not refuse to accept inspection or conceal any information. Sanitation supervisors shall keep confidential of all technical materials provided.   第十三条 卫生监督员有权对公共场所进行现场检查,索取有关资料,经营单位不得拒绝或隐瞒。卫生监督员对所提供的技术资料有保密的责任。
The sanitation supervisors of public places shall wear badges and present certificates when executing tasks. 公共场所卫生监督员在执行任务时,应佩戴证章、出示证件。
Chapter IV Penalty Provisions 

第四章 罚  则

Article 14 For any entity or individual that has any of following acts, the health and epidemic prevention institution shall impose administrative penalties, such as a warning, a fine, suspension of business for rectification or revocation of the “sanitary permit,” based on the seriousness of the case:   第十四条 凡有下列行为之一的单位或者个人,卫生防疫机构可以根据情节轻重,给予警告、罚款、停业整顿、吊销“卫生许可证”的行政处罚:
(1) Continuing to operate where the sanitation quality of the public place fails to meet health standards and requirements. (一)卫生质量不符合国家卫生标准和要求,而继续营业的;
(2) Failing to obtain a “health certificate” but directly serving customers. (二)未获得“健康合格证”,而从事直接为顾客服务的;
(3) Refusing to accept supervision of sanitation. (三)拒绝卫生监督的;
(4) Conducting business operation without obtaining a “sanitary permit.” (四)未取得“卫生许可证”,擅自营业的。
All fines shall be turned over into the state treasury. 罚款一律上交国库。
Article 15 Any entity or individual that, in violation of the provisions of this Regulation, causes an accident that is hazardous to public health or a poisoning accident shall compensate the victim for the loss.   第十五条 违反本条例的规定造成严重危害公民健康的事故或中毒事故的单位或者个人,应当对受害人赔偿损失。
If any entity or individual causes disability or death in violation of this Regulation and is criminally punishable, the directly responsible person shall be held criminally liable by the judicial authority in accordance with the law. 违反本条例致人残疾或者死亡,构成犯罪的,应由司法机关依法追究直接责任人员的刑事责任。
Article 16 Any entity or individual against the administrative penalty such as suspension of business for rectification or revocation of the “sanitary permit” may, within 15 days from the date of receiving the notice on penalties, institute an action at the local people's court; however, the decision on the control of the sanitary quality of the public place shall be enforced immediately. Where the entity or individual neither implements the decision on administrative penalties nor institutes an action within a prescribed time limit, the health and epidemic prevention institution shall apply to the local people's court for enforcement of the decision.   第十六条 对罚款、停业整顿及吊销“卫生许可证”的行政处罚不服的,在接到处罚通知之日起15天内,可以向当地人民法院起诉。但对公共场所卫生质量控制的决定应立即执行。对处罚的决定不履行又逾期不起诉的,由卫生防疫机构向人民法院申请强制执行。
Article 17 The sanitation supervision institutions and sanitation supervisors of public places must exercise due diligence and act in accordance with the law. Whoever neglects duties, abuses power, or accepts bribes, the competent department at a higher level shall take an administrative sanction against the directly responsible person. If it is criminally punishable, the directly responsible person shall be held criminally liable by the judicial authority in accordance with the law.   第十七条 公共场所卫生监督机构和卫生监督员必须尽职尽责,依法办事。对玩忽职守,滥用职权,收取贿赂的,由上级主管部门给予直接责任人员行政处分。构成犯罪的,由司法机关依法追究直接责任人员的刑事责任。
Chapter V Supplementary Provisions 

第五章 附  则

Article 18 The health administrative department of the State Council shall be responsible for the development of the detailed rules for the implementation of this Regulation.   第十八条 本条例的实施细则由国务院卫生行政部门负责制定。
Article 19 This Regulation shall come into force on the date of issuance.
