| Article 1 For the purposes of improving the working mechanisms for connecting the administrative law enforcement with the criminal justice and ensuring the insurance regulatory agencies to timely transfer the suspected criminal cases in the administrative law enforcement, these Provisions have been formulated in accordance with the Provisions on the Transfer of Suspected Criminal Cases by Administrative Law Enforcement Authorities, the Opinions on the Timely Transfer of Suspected Criminal Cases in the Administrative Law Enforcement and the Provisions of the CIRC on the Procedures for Administrative Punishment. | | 第一条 为完善行政执法与刑事司法相衔接工作机制，保证保险监督管理机构在行政执法中及时移送涉嫌犯罪案件，根据《行政执法机关移送涉嫌犯罪案件的规定》、《关于在行政执法中及时移送涉嫌犯罪案件的意见》以及《中国保险监督管理委员会行政处罚程序规定》，制定本规定。 |

| Article 2 Where, in the process of investigating any insurance illegal act, the CIRC or its dispatched office finds that a crime is suspected to have occurred in terms of the value involved in and circumstances and consequences of the illegal act and that it is necessary to investigate the criminal responsibility according to law, the CIRC or its dispatched office shall transfer the case to the judicial authority pursuant to these Provisions. | | 第二条 保监会或者派出机构在依法查处保险违法行为过程中，发现违法事实涉及的金额、违法事实的情节、违法事实造成的后果等，涉嫌构成犯罪，依法需要追究刑事责任的，应当依照本规定向司法机关移送。 |

| Article 3 Where, in the process of investigating any insurance illegal act, the functional department for law enforcement of the CIRC or the dispatched office finds that the person committing the illegal act is suspected to have committed a crime, the department shall take measures to collect and keep evidence according to law. | | 第三条 保监会及派出机构执法职能部门在查处保险违法行为时，发现违法行为人涉嫌构成犯罪的，应当依法采取措施，收集、保存证据。 |
For the captured articles involved in the case, the department shall faithfully make a list of articles involved in the case, and dispose of them pursuant to the relevant state provisions. For articles tending to get rotten, deteriorated and destroyed or other articles which are unfit or hard to be kept, the department shall take necessary measures to take evidence; for articles needing examination or authentication, the department shall have them examined or authenticated by the statutory examination or authentication agency, which shall issue an examination report or authentication conclusion. | |
对查获的涉案物品，应当如实填写涉案物品清单，并按照国家有关规定予以处理。对易腐烂、变质、灭失等不宜或者不易保管的涉案物品，应当采取必要措施，留取证据；对需要进行检验、鉴定的涉案物品，应当由法定检验、鉴定机构进行检验、鉴定，并出具检验报告或者鉴定结论。 |

| Article 4 Where a suspected criminal case shall be transferred to the public security authority, the functional department for law enforcement shall immediately appoint two or more administrative law enforcement officers to form a task force in charge of the transfer, present a written report on the transfer of a suspected criminal case after verifying the facts, made a Paper on the Transfer of a Suspected Criminal Case, hand them, along with the investigative report on the suspected criminal case, list of articles involved in the case, examination report or authentication conclusion and other related materials, to the legal affairs department for countersignature, and report them to the person in charge of the CIRC or its dispatched office for approval. | | 第四条 应当向公安机关移送涉嫌犯罪案件的，执法职能部门应立即指定2名或者2名以上行政执法人员组成专案组专门负责，核实情况后提出移送涉嫌犯罪案件的书面报告，制作《涉嫌犯罪案件移送书》，连同涉嫌犯罪案件情况的调查报告、涉案物品清单、有关检验报告或者鉴定结论以及其他有关涉嫌犯罪的材料交法制部门会签，并报中国保监会负责人或者派出机构负责人批准。 |
The person in charge of the CIRC or its dispatched office shall make a decision on approval or disapproval of transfer within three workdays after receiving the report. | |
中国保监会负责人或者派出机构负责人应当自接到报告之日起3个工作日内作出批准移送或者不批准移送的决定。 |

Article 5 In the case of a decision on approval of transfer, the functional department for law enforcement shall transfer the case to the public security authority which has jurisdiction over the case within 24 hours; or in the case of a decision on disapproval of transfer, the functional department for law enforcement shall put the reasons for disapproval on record.
