The Interim Provisions on Administrative Sanctions against Violations of the Provisions on the Two-channel Management of the Receipts and Disbursements of Administrative Charges, Fines and Confiscation Income were adopted at the 26th Executive Meeting of the State Council on February 1, 2000, are hereby promulgated and implemented.
 
《违反行政事业性收费和罚没收入收支两条线管理规定行政处分暂行规定》已经2000年2月1日国务院第26次常务会议讨论通过,现予发布施行。

Article 1 These Provisions are formulated in accordance with the laws, administrative regulations and relevant provisions of the State in order to reinforce financial discipline, enhance clean government, implement the “two-channel management of the receipts and disbursements” of admin is trative charges, fines and confiscation income and promote lawful administration.   第一条 为了严肃财经纪律,加强廉政建设,落实行政事业性收费和罚没收入“收支两条线”管理,促进依法行政,根据法律、行政法规和国家有关规定,制定本规定。

 
Article 2 Any civil servant of the State or any staff member of an institution which is authorized by the laws and administrative regulations to exercise the function of collecting administrative charges or imposing fines and confiscation, if committing any act in violation of the provisions on the “two-channel management of the receipts and disbursements”, shall be given administrative sanctions in accordance with these Provisions.   第二条 国家公务员和法律、行政法规授权行使行政事业性收费或者罚没职能的事业单位的工作人员有违反“收支两条线”管理规定行为的,依照本规定给予行政处分。

 
Article 3 The “administrative charges” mentioned in these Provisions refer to the following income that belongs to the finance fund:   第三条 本规定所称“行政事业性收费”,是指下列属于财政性资金的收入:

 
(1) various charges collected according to the laws, the administrative regulations, the relevant provisions of the State Council, or the rules or provisions jointly issued by the finance and planning departments of the State Council, or according to the local regulations, government rules or provisions of the provinces, autonomous regions and municipalities directly under the Central Government, or the provisions jointly issued by the finance and planning (pricing) departments of the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government; (一)依据法律、行政法规、国务院有关规定、国务院财政部门与计划部门共同发布的规章或者规定以及省、自治区、直辖市的地方性法规、政府规章或者规定和省、自治区、直辖市人民政府财政部门与计划(物价)部门共同发布的规定所收取的各项收费;

 
(2) government funds and surcharges prescribed by the laws, the administrative regulations or the provisions of the State Council or authorized by the finance department of the State Council in accordance with the relevant provisions of the State. (二)法律、行政法规和国务院规定的以及国务院财政部门按照国家有关规定批准的政府性基金、附加。

Charges for paid services collected by institutions for providing services do not belong to the administrative charges.
 
事业单位因提供服务收取的经营服务性收费不属于行政事业性收费。

 
Article 4 The “fines and confiscation income” mentioned in these Provisions refer to fines and confiscated money and confiscated goods valued at the market price, which are obtained by the penalty enforcement departments authorized by the laws and administrative regulations when they enforce penalties according to law.   第四条 本规定所称“罚没收入”,是指法律、行政法规授权的执行处罚的部门依法实施处罚取得的罚没款和没收物品的折价收入。

 
Article 5 Where, in violation of the provisions, items for administrative charges or penalty of fines or confiscation are set up without authorization, the person(s) directly in charge and other persons directly responsible shall be demoted or removed from office.   第五条 违反规定,擅自设立行政事业性收费项目或者设置罚没处罚的,对直接负责的主管人员和其他直接责任人员给予降级或者撤职处分。

 
Article 6 Where, in violation of the provisions, the scope or the criteria for administrative charges, fines or confiscation are changed without authorization, the person(s) directly in charge and other persons directly responsible shall be recorded a serious demerit, or shall be demoted or removed from office if the case is serious.   第六条 违反规定,擅自变更行政事业性收费或者罚没范围、标准的,对直接负责的主管人员和其他直接责任人员给予记大过处分;情节严重的,给予降级或者撤职处分。

 
Article 7 Where charges are still collected for the original items or according to the original criteria which are abolished or lowered by order of the authorities in charge of examination and approval of items for administrative charges, the person(s) directly in charge and other persons directly responsible shall be recorded a serious demerit, or shall be demoted or removed from office if the case is serious.

   第七条 对行政事业性收费项目审批机关已经明令取消或者降低标准的收费项目,仍按原定项目或者标准收费的,对直接负责的主管人员和其他直接责任人员给予记大过处分;情节严重的,给予降级或者撤职处分。
