In order to thoroughly carry out the Decision of the Standing Committee of the National People's Congress on the Administration of Forensic Identification (hereinafter referred to as the “Decision”), further regulate forensic identification activities and enhance the healthy development thereof, the Ministry of Justice has issued the General Rules on the Procedures for Judicial Authentication (hereinafter referred to as the “General Rules”) on August 7, 2007. The General Rules are an important set of rules issued by the Ministry of Justice, after the issuance and implementation of the Measures for the Administration of the Registration of Forensic Identification Institutions and the Measures for the Administration of the Registration of Forensic Experts, supporting the implementation of the Decision. The issuance of the General Rules is another significant step to strengthen the administration of forensic identification and to facilitate the systematic building thereof. 为了深入贯彻《全国人民代表大会常务委员会关于司法鉴定管理问题的决定》，进一步规范司法鉴定活动，推动司法鉴定事业的健康发展，司法部于2007年8月7日发布了《司法鉴定程序通则》（以下简称《通则》）。《通则》是继《司法鉴定机构登记管理办法》和《司法鉴定人登记管理办法》颁布实施之后，司法部出台的又一个与《决定》相配套的重要规章，是加强司法鉴定管理工作、推动司法鉴定制度化建设的又一重大举措。为进一步做好《通则》的贯彻执行工作，现就有关事宜通知如下： |

| I. Profound realization of the significance of implementing the General Rules | | 一、深刻认识贯彻实施《通则》的重要意义 |
The General Rules are made on the basis of the Decision for the purpose of adapting to the forensic identification needs of the judicial work under new circumstances, scientifically understanding the basic laws regarding forensic identification activities, and summarizing the forensic identification experiences over the last several years. Implementing the General Rules is of great significance to regulating forensic identification activities, effectively improving the quality of forensic identification, enhancing standardization and legalization building of forensic identification, and giving full play to the functional role of the forensic identification system in enhancing justice and serving the building of a harmonious society. The judicial organs at all levels shall proceed from the overall situation, fully realize the great significance of the implementation of the General Rules, combine the General Rules with the educational activities on the socialist concept of rule of law, regard the implementation of the General Rules as an important task for forensic identification management over the next two years, and make arrangements to ensure the effective implementation of all provisions of the General Rules. | |
《通则》是依据《全国人民代表大会常务委员会关于司法鉴定管理问题的决定》，适应新形势司法工作对司法鉴定的需要，在科学认识司法鉴定活动的基本规律，总结多年来司法鉴定实践经验的基础上制订的。贯彻执行《通则》，对于规范司法鉴定活动，切实提高司法鉴定质量，推动司法鉴定规范化、法制化建设，充分发挥司法鉴定制度促进司法公正、服务和谐社会的职能作用具有十分重要的意义。各级司法行政机关一定要站在全局的高度，充分认识贯彻执行《通则》的重大意义，结合开展社会主义法治理念教育活动，把贯彻执行《通则》作为今、明两年司法鉴定管理工作的重要任务，认真组织部署，切实抓好落实，确保《通则》的各项规定落到实处。 |

| II. Diligently conduct study and training of forensic identification management officials | | 二、认真做好司法鉴定管理干部的学习培训 |
In order to adapt to the new requirements as imposed by the General Rules for the forensic identification management work, all regions shall, before the end of this year, organize forensic identification management officials to have a systematic study of the General Rules so as to ensure that all officials correctly understand the basic provisions of the General Rules, are familiar with the basic contents of the General Rules and understand the basic requirements for forensic identification activities, and establish a good foundation for implementing the General Rules. We shall, at the time when the General Rules are issued for implementation, actively make reports to the local Party committees and governments, accelerate the building of the forensic identification management bodies under the judicial organs at the provincial and city levels, improve the organizational setup, specify tasks and duties, arrange for sufficient management officials, assume administrative and regulatory duties, and take initiative to adapt to the challenges posed to management work by the development of forensic identification. We shall make more further efforts in organizing study and training activities for management officials, especially new officials, so as to improve the professional quality of the forensic identification management team and to raise forensic identification management capabilities.

适应《通则》对司法鉴定管理工作提出的新要求，各地要在今年年底前，组织司法鉴定管理干部系统学习一遍《通则》，使每个管理干部正确理解《通则》的基本规定，熟悉《通则》的基本内容，掌握司法鉴定活动的基本要求，为贯彻执行《通则》奠定良好的基础。要利用《通则》公布实施之机，积极向当地党委、政府汇报，加快省、市两级司法行政机关司法鉴定管理机构的建设步伐，完善组织机构，明确任务职责，配齐管理干部，切实担负起管理监督的职责，主动适应司法鉴定事业发展对管理工作提出的挑战。加强管理干部特别是新走上司法鉴定管理岗位人员的业务学习和培训，提高司法鉴定管理干部队伍的业务素质，提高司法鉴定管理水平。
