| Decision to Amend theProvisions on the Administration of Port Operations | | 关于修改《港口经营管理规定》的决定 |
| The Ministry of Transport hereby decides to amend the Provisions on the Administration of Port Operations(Order No. 43 [2016], Ministry of Transport) as follows: | | 交通运输部决定对《港口经营管理规定》（交通运输部令2016年第43号）作如下修改： |
| I. Sub-item (c) of item (1) of Article 3 is amended to read: “engaging in loading and unloading of goods (including lightering), storage, and lightering within a port area,” and sub-items (f) and (g) thereof are deleted. | | 一、将第三条第（一）项第3目修改为“从事货物装卸（含过驳）、仓储、港区内驳运”，并删除第6目、第7目。 |
| II. In paragraph 1 of Article 4, “be responsible for” is replaced with “take charge of”. | | 二、将第四条第一款中的“负责”修改为“主管”。 |
| III. In Article 7, “receiving of vessel pollutants” is replaced with “operation of port tugs”; sub-item (b) of item (2) is amended to read: “Where the operators provide embarking or disembarking services for passengers, they shall have the facilities for waiting for ships and embarking or disembarking that can keep out wind, rain, and snow at a minimum, and be equipped with barrier-free facilities under relevant provisions”; sub-item (c) of item (2) is deleted, and renumbered as paragraph 3 of Article 20; and “and establishing work safety management institutions or being staffed with full-time safety management personnel according to the law” is added to the end of item (4). | | 三、将第七条中的“船舶污染物接收”修改为“港口拖轮经营”；将第（二）项第2目修改为“为旅客提供上、下船服务的，应当具备至少能遮蔽风、雨、雪的候船和上、下船设施，并按相关规定配备无障碍设施；”删除第（二）项第3目，并调整至第二十条，作为第三款；在第（四）项最后增加“依法设置安全生产管理机构或者配备专职安全管理人员。” |
| IV. Article 9 is amended to read: “Whoever engages in the operation of port tugs shall meet the following conditions: | | 四、将第九条修改为：“从事港口拖轮经营，应当具备下列条件： |
(1) It is registered at the location of the port where it applies for operating tugs and has obtained the qualification as an enterprise legal person.
