| To further deepen the reform of the investment system and the administrative approval system, increase efforts in simplifying administrative procedures and decentralizing powers, effectively transform the government's investment administration functions so as to enable the market play a decisive role in the allocation of resources, establish the status of enterprises as investors, give better play to the government's role, and strengthen and improve macro-control, the Catalogue of Investment Projects Subject to Government Confirmation (2014) is hereby issued, and you are hereby notified of the relevant matters as follows: | | 为进一步深化投资体制改革和行政审批制度改革，加大简政放权力度，切实转变政府投资管理职能，使市场在资源配置中起决定性作用，确立企业投资主体地位，更好发挥政府作用，加强和改进宏观调控，现发布《政府核准的投资项目目录（2014年本）》，并就有关事项通知如下： |
| I. To invest in the construction of fixed-asset investment projects listed in the Catalogue, enterprises must report the relevant projects to the project confirmation authorities for confirmation in accordance with the relevant provisions. Where enterprises invest in the construction of projects beyond this Catalogue, such projects shall be subject to recordation administration. The projects invested by public institutions and social organizations, among others, shall be governed by this Catalogue. | | 一、企业投资建设本目录内的固定资产投资项目，须按照规定报送有关项目核准机关核准。企业投资建设本目录外的项目，实行备案管理。事业单位、社会团体等投资建设的项目，按照本目录执行。 |
| Crude oil and natural gas development projects shall be decided by the enterprises with the mining right at their discretion, and be reported to the industry administrative department of the State Council for recordation. The relevant enterprises with the mining right shall, in accordance with the relevant laws and regulations, adhere to overall planning, reasonably develop and utilize resources, and avoid the disorderly mining of resources. | | 原油、天然气开发项目由具有开采权的企业自行决定，并报国务院行业管理部门备案。具有开采权的相关企业应依据相关法律法规，坚持统筹规划，合理开发利用资源，避免资源无序开采。 |
| II. Laws, administrative regulations, and the development plans, industrial policies, total quantity control objectives, technical policies, access standards, land use policies, environmental protection policies, and credit policies, among others, developed by the state are the important basis for enterprises to carry out the preliminary work of the projects, and the basis for project confirmation authorities, land and resources, environmental protection, urban and rural planning, industrial administration and other departments, as well as financial institutions to examine projects. Environmental protection departments shall conduct multilevel and categorized administration of projects based on the extent of their impact on the environment, conduct strict environmental assessment approval of projects with a large impact on environment and high environmental risks, and strengthen interim and post supervision. | | 二、法律、行政法规和国家制定的发展规划、产业政策、总量控制目标、技术政策、准入标准、用地政策、环保政策、信贷政策等是企业开展项目前期工作的重要依据，是项目核准机关和国土资源、环境保护、城乡规划、行业管理等部门以及金融机构对项目进行审查的依据。环境保护部门应根据项目对环境的影响程度实行分级分类管理，对环境影响大、环境风险高的项目严格环评审批，并强化事中事后监管。 |
| III. For projects in the industries with serious overcapacity such as steel, electrolytic aluminum, cement, plate glass and vessels, the Guiding Opinions of the State Council on Resolving the Conflicts of Severe Overcapacity (No. 41 [2013], State Council) shall be strictly implemented, and all localities and departments shall not grant the recordation of new production capacity projects in any other name or form, and all relevant departments and institutions shall not handle the relevant businesses such as the supply of land (sea areas), energy evaluation and environmental assessment and new credit support, and make concerted efforts to promote all kinds of work on resolving the conflicts of serious overcapacity. | | 三、对于钢铁、电解铝、水泥、平板玻璃、船舶等产能严重过剩行业的项目，要严格执行《国务院关于化解产能严重过剩矛盾的指导意见（国发〔2013〕41号），各地方、各部门不得以其他任何名义、任何方式备案新增产能项目，各相关部门和机构不得办理土地（海域）供应、能评、环评审批和新增授信支持等相关业务，并合力推进化解产能严重过剩矛盾各项工作。 |
| IV. Project confirmation authorities shall improve administrative measures, effectively enhance administrative efficiency, conscientiously perform confirmation functions and conduct examination in strict accordance with the prescribed power, procedures, time limit and other requirements. The supervision priority shall be delegated to lower levels together with the confirmation and recordation power, and local governments shall effectively perform the supervision functions. The relevant departments shall closely cooperate with each other, improve administrative measures according to their respective functions, and enhance the supervision of investment activities according to law. For projects that are not in compliance with laws and regulations or not confirmed or reported for recordation according to the prescribed power and procedures, the relevant authorities shall not undergo the relevant formalities, and financial institutions shall not provide credit support. | | 四、项目核准机关要改进完善管理办法，切实提高行政效能，认真履行核准职责，严格按照规定权限、程序和时限等要求进行审查。监管重心要与核准、备案权限同步下移，地方政府要切实履行监管职责。有关部门要密切配合，按照职责分工，相应改进管理办法，依法加强对投资活动的监管。对不符合法律法规规定以及未按规定权限和程序核准或者备案的项目，有关部门不得办理相关手续，金融机构不得提供信贷支持。 |
| V. For the projects subject to confirmation by the State Council in accordance with the relevant provisions, the National Development and Reform Commission shall, after conducting examination, report them to the State Council for confirmation. For the projects reported to the State Council for recordation in accordance with the relevant provisions, the National Development and Reform Commission shall, after conducting confirmation, report them to the State Council for recordation. For the projects reported, upon examination, to the State Council for confirmation, and the projects subject to confirmation by the investment administrative department of the State Council, the opinions of the industry administrative department of the State Council must be solicited in advance. For the projects subject to confirmation by local governments, provincial governments may, in light of their actual local circumstances, divide the specific confirmation power of local governments at each level. For the projects subject to confirmation by provincial governments, the confirmation power shall not be delegated to lower levels. | | 五、按照规定由国务院核准的项目，由发展改革委审核后报国务院核准。按照规定报国务院备案的项目，由发展改革委核准后报国务院备案。核报国务院核准的项目、国务院投资主管部门核准的项目，事前须征求国务院行业管理部门的意见。由地方政府核准的项目，省级政府可以根据本地实际情况具体划分地方各级政府的核准权限。由省级政府核准的项目，核准权限不得下放。 |
| VI. Where there are special provisions of any law, administrative regulation or the state, such provisions shall prevail. The competent commerce department shall, in accordance with the relevant provisions of the state, conduct examination or recordation administration of the establishment and modification of foreign-funded enterprises, and the investment in the formation of enterprises abroad (excluding financial enterprises) by domestic enterprises. | | 六、法律、行政法规和国家有专门规定的，按照有关规定执行。商务主管部门按国家有关规定对外商投资企业的设立和变更、国内企业在境外投资开办企业（金融企业除外）进行审核或备案管理。 |

| Reservoirs: the projects constructed on transboundary rivers or on rivers crossing two or more provinces (autonomous regions or municipalities directly under the Central Government) shall be subject to confirmation by the investment administrative department of the State Council, among which the projects with a storage capacity of one billion cubic meters or more or involving 10,000 migrants or more shall be subject to confirmation by the State Council.
