互联网文化管理暂行规定

(Deliberated and adopted at the executive meeting of the Ministry of Culture on February 11, 2011 and shall come into force on April 1, 2011; and revised in accordance with the Decision of the Ministry of Culture on Repealing and Modifying Some Regulatory Documents (Order No. 57 of the Ministry of Culture) issued on December 15, 2017) (2011年2月11日文化部部务会议审议通过,自2011年4月1日起施行 根据2017年12月15日发布的《文化部关于废止和修改部分部门规章的决定》(文化部令第57号)修订)

Article 1 For the purposes of strengthening the administration of Internet culture, guaranteeing the lawful rights and interests of Internet cultural entities, and promoting the healthy and orderly development of China's Internet culture, these Provisions are developed in accordance with the relevant provisions of the Cybersecurity Law of the People's Republic of China, the Decision of the Standing Committee of the National People's Congress on Safeguarding the Internet Security, the Measures for the Administration of Internet Information Services and other relevant laws and regulations issued by the state.   第一条 为了加强对互联网文化的管理,保障互联网文化单位的合法权益,促进我国互联网文化健康、有序地发展,根据《中华人民共和国网络安全法》、《全国人民代表大会常务委员会关于维护互联网安全的决定》和《互联网信息服务管理办法》等国家法律法规有关规定,制定本规定。
Article 2 The term “Internet cultural products” as mentioned in these Provisions refers to the cultural products produced, disseminated and circulated through the Internet, which mainly include:   第二条 本规定所称互联网文化产品是指通过互联网生产、传播和流通的文化产品,主要包括:
1. Internet cultural products specially produced for the Internet, such as online music entertainment, online games, online shows & plays (programs), online performances, online works of art, online cartoons, etc.; and (一)专门为互联网而生产的网络音乐娱乐、网络游戏、网络演出剧(节)目、网络表演、网络艺术品、网络动漫等互联网文化产品;
2. Internet cultural products produced from such cultural products as music entertainment, games, shows & plays (programs), performances, works of art, cartoons, etc. by certain technical means and reproduced on the Internet for dissemination. (二)将音乐娱乐、游戏、演出剧(节)目、表演、艺术品、动漫等文化产品以一定的技术手段制作、复制到互联网上传播的互联网文化产品。
Article 3 The term “Internet cultural activities” as mentioned in these Provisions refers to the activities of providing Internet cultural products and services, which mainly include:   第三条 本规定所称互联网文化活动是指提供互联网文化产品及其服务的活动,主要包括:
1. The activities of producing, reproducing, importing, publishing or broadcasting Internet cultural products; (一)互联网文化产品的制作、复制、进口、发行、播放等活动;
2. The on-line acts of publishing cultural products on the Internet, or sending cultural products through the Internet, mobile communication network and other information networks to such terminals as computers, fixed telephones, mobile phones, TV sets, game players, etc. and Internet bars and other business places of Internet service for users' browse, appreciation, use or downloading; and (二)将文化产品登载在互联网上,或者通过互联网、移动通信网等信息网络发送到计算机、固定电话机、移动电话机、电视机、游戏机等用户端以及网吧等互联网上网服务营业场所,供用户浏览、欣赏、使用或者下载的在线传播行为;
3. The activities of exhibitions and competitions of Internet cultural products. (三)互联网文化产品的展览、比赛等活动。
Internet cultural activities can be divided into two categories, namely, operational and non-operational. Operational Internet cultural activities refer to the profit-making activities of providing Internet cultural products and services by charging fees from Internet users or by electronic commerce, advertisement, financial supports, etc. Non-operational Internet cultural activities refer to the non-profit-making activities of providing Internet users with Internet cultural products and. 互联网文化活动分为经营性和非经营性两类。经营性互联网文化活动是指以营利为目的,通过向上网用户收费或者以电子商务、广告、赞助等方式获取利益,提供互联网文化产品及其服务的活动。非经营性互联网文化活动是指不以营利为目的向上网用户提供互联网文化产品及其服务的活动。
Article 4 The term “Internet cultural entity” as mentioned in these Provisions refers to an Internet information service provider which is approved by or filed with the cultural administrative department and the administrative organ of telecommunication to engage in Internet cultural activities.   第四条 本规定所称互联网文化单位,是指经文化行政部门和电信管理机构批准或者备案,从事互联网文化活动的互联网信息服务提供者。
Whoever engages in Internet cultural activities within the territory of the People's Republic of China shall abide by these Provisions. 在中华人民共和国境内从事互联网文化活动,适用本规定。
Article 5 People engaged in Internet cultural activities shall abide by the Constitution and the relevant laws and regulations, adhere to the orientation of serving the people and serving socialism, carry forward fine folk culture, disseminate ideas, morals and scientific, technical and cultural knowledge beneficial to improving the public cultural quality, promoting economic development and social progress, and enriching the people's spiritual life.   第五条 从事互联网文化活动应当遵守宪法和有关法律、法规,坚持为人民服务、为社会主义服务的方向,弘扬民族优秀文化,传播有益于提高公众文化素质、推动经济发展、促进社会进步的思想道德、科学技术和文化知识,丰富人民的精神生活。
Article 6 The Ministry of Culture shall be responsible for making guidelines, policies and planning for the development and administration of Internet culture, supervising the Internet cultural activities nationwide.   第六条 文化部负责制定互联网文化发展与管理的方针、政策和规划,监督管理全国互联网文化活动。
The cultural administrative departments of the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government shall examine the entities that apply for engaging in operational Internet cultural activities, and make archival filing on the entities that engage in non-operational Internet cultural activities. 省、自治区、直辖市人民政府文化行政部门对申请从事经营性互联网文化活动的单位进行审批,对从事非经营性互联网文化活动的单位进行备案。
The cultural administrative departments of the people's governments at or above the county level shall be responsible for the supervision and administration of the Internet cultural activities within their respective administrative regions. The cultural administrative departments of the people's governments at or above the county level or the general law enforcement organs of the cultural market shall impose punishments on the illegal Internet cultural activities in violation of the relevant regulations of the state. 县级以上人民政府文化行政部门负责本行政区域内互联网文化活动的监督管理工作。县级以上人民政府文化行政部门或者文化市场综合执法机构对从事互联网文化活动违反国家有关法规的行为实施处罚。
Article 7 Whoever applies for engaging in commercial Internet cultural activities shall comply with the relevant provisions of the Measures for the Administration of Internet Information Services, and shall meet the following conditions:   第七条 申请从事经营性互联网文化活动,应当符合《互联网信息服务管理办法》的有关规定,并具备以下条件:
(1) having the name, domicile, organizational structure and bylaws of an entity; (一)有单位的名称、住所、组织机构和章程;
(2) having a well-defined scope of Internet cultural activities; (二)有确定的互联网文化活动范围;
(3) having the professionals, equipment and workplaces that can satisfy the needs of Internet cultural activities as well as corresponding management and technical measures; (三)有适应互联网文化活动需要的专业人员、设备、工作场所以及相应的经营管理技术措施;
(4) having a well-defined domain name; and (四)有确定的域名;
(5) meeting the conditions as prescribed in laws, administrative regulations and other relevant provisions of the state. (五)符合法律、行政法规和国家有关规定的条件。
Article 8 Whoever applies for engaging in commercial Internet cultural activities shall file the application with the cultural administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government at its locality for examination and approval.   第八条 申请从事经营性互联网文化活动,应当向所在地省、自治区、直辖市人民政府文化行政部门提出申请,由省、自治区、直辖市人民政府文化行政部门审核批准。
Article 9 Whoever applies for engaging in commercial Internet cultural activities shall submit the following documents:   第九条 申请从事经营性互联网文化活动,应当提交下列文件:
(1) an application form; (一)申请表;
(2) its business license and bylaws; (二)营业执照和章程;
(3) the identity certificates of the legal representative or the primary person-in-charge; (三)法定代表人或者主要负责人的身份证明文件;
(4) an explanation on its business scope; (四)业务范围说明;
(5) explanatory materials for professionals, workplaces and corresponding management and technical measures; (五)专业人员、工作场所以及相应经营管理技术措施的说明材料;
(6) the domain name registration certificate; and (六)域名登记证明;
(7) other documents legally required to be submitted. (七)依法需要提交的其他文件。
For an application for engaging in commercial Internet cultural activities, the culture administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government shall, within 20 days of accepting the application, make a decision of approval or disapproval. If it decides to approve the application, it shall issue an Internet Culture Business Permit to the applicant and make an announcement to the public; or if it decides not to approve the application, it shall notify the applicant and state the reasons in writing. 对申请从事经营性互联网文化活动的,省、自治区、直辖市人民政府文化行政部门应当自受理申请之日起20日内做出批准或者不批准的决定。批准的,核发《网络文化经营许可证》,并向社会公告;不批准的,应当书面通知申请人并说明理由。
An Internet Culture Business Permit shall be valid for three years. An entity which needs to continue its business operations after its Internet Culture Business Permit expires shall apply for renewal at least 30 days before its Internet Culture Business Permit expires. 《网络文化经营许可证》有效期为3年。有效期届满,需继续从事经营的,应当于有效期届满30日前申请续办。
Article 10 A non-commercial Internet cultural entity shall, within 60 days as of the day when it is formed, undergo the recordation formalities with the culture administrative department of the local people's government of the province, autonomous region or municipality directly under the Central Government, and submit the following documents:   第十条 非经营性互联网文化单位,应当自设立之日起60日内向所在地省、自治区、直辖市人民政府文化行政部门备案,并提交下列文件:
(1) a recordation form; (一)备案表;
(2) its bylaws; (二)章程;
(3) the identity certificates of the legal representative or primary person-in-charge;
