Plan for Further Deepening the Reform and Opening up of China (Tianjin) Pilot Free Trade Zone 进一步深化中国(天津)自由贸易试验区改革开放方案
Building pilot free trade zones is a strategic measure of the CPC Central Committee and the State Council to comprehensively deepen reform and further open up under new conditions. Since the launch of China (Tianjin) Pilot Free Trade Zone (hereinafter referred to as the “FTZ”), process achievements have been made in the building, and expected objectives have been generally accomplished. For the purposes of implementing the decisions and arrangements of the CPC Central Committee and the State Council, further deepening the reform and opening up of the FTZ, and promoting the coordinated development of Beijing, Tianjin and Hebei province in depth, this Plan was developed. 建设自由贸易试验区是党中央、国务院在新形势下全面深化改革和扩大开放的战略举措。中国(天津)自由贸易试验区(以下简称自贸试验区)运行以来,建设取得阶段性成果,总体达到预期目标。为贯彻落实党中央、国务院决策部署,进一步深化自贸试验区改革开放,深入推动京津冀协同发展,制定本方案。
I. General requirements   一、总体要求
1. Guiding ideology. The great banner of socialism with Chinese characteristics shall be held high, the spirit of the 19th CPC National Congress shall be fully implemented, Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era shall be regarded as guidance, the decisions and arrangements of the CPC Central Committee and the State Council shall be carried out, the overall advancement of the overall layout for "economic, political, cultural, social, and ecological progress" and the coordinated advancement of the Four-Pronged Comprehensive Strategy shall be conducted, the general work keynote of seeking progress while keeping performance stable shall be adhered to, the new development concept shall be firmly practiced, the supply-side structural reform shall be adhered to as the main line, system innovation shall be used as the core, risk prevention and control shall be taken as the bottom line, the mind shall continue to be liberated, pilot programs shall be conducted, international advanced rules shall be benchmarked against, the FTZ shall be given greater autonomy in the reform, reform, development, and innovation shall be promoted by opening up, and the establishment of a new pattern of opening up shall be boosted. New paths and modes for comprehensively deepening the reform and further opening up shall be explored in broader fields and higher levels, the relationship between the government and the market shall be further clarified, particular attention shall be paid to establishing a high-standard system of investment and trading rules in line with international standards, the bottom line of risk prevention and control shall be strictly held, and an endeavor shall be made to build the FTZ into a high-level opening up platform serving the Belt and Road Initiative and the coordinated development of Beijing, Tianjin, and Hebei province and make more system innovations susceptible to replication and promotion. (一)指导思想。高举中国特色社会主义伟大旗帜,全面贯彻党的十九大精神,以习近平新时代中国特色社会主义思想为指导,贯彻落实党中央、国务院决策部署,统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局,坚持稳中求进工作总基调,坚定践行新发展理念,坚持以供给侧结构性改革为主线,以制度创新为核心,以风险防控为底线,继续解放思想、先行先试,对标国际先进规则,赋予自贸试验区更大改革自主权,以开放促改革、促发展、促创新,推动形成全面开放新格局。在更广领域和更高层次探索全面深化改革、扩大开放的新路径、新模式,进一步厘清政府与市场的关系,着力构建与国际接轨的高标准投资贸易规则体系,严守风险防控底线,努力将自贸试验区打造成为服务“一带一路”建设和京津冀协同发展的高水平对外开放平台,取得更多可复制可推广的制度创新成果。
2. Building objectives. By 2020, a regime system connected with generally accepted international investment and trade rules will have been first established, a law-oriented, internationalized, and facilitating business environment will have been created, a new open economic system will have been established with efforts, new advantages in international competition will have been gained, and a Beijing-Tianjin-Hebei coordinated development demonstration area will have been constructed. The interaction between the reform in the FTZ and that in Tianjin will have been enhanced, and all tasks of the reform pilot programs with good conditions will have been comprehensively implemented in Binhai New Area or promoted on a trial basis in Tianjin. (二)建设目标。到2020年,率先建立同国际投资和贸易通行规则相衔接的制度体系,形成法治化、国际化、便利化营商环境,努力构筑开放型经济新体制,增创国际竞争新优势,建设京津冀协同发展示范区。强化自贸试验区改革与天津市改革的联动,各项改革试点任务具备条件的在滨海新区范围内全面实施,或在天津市推广试验。
II. Benchmarking against international advanced rules and building a new open economic system   二、对标国际先进规则,构筑开放型经济新体制
3. Advancing in depth the optimization of the duties and process of administrative approval. The pilot program of reform of "separation of business license and certificates" shall be conducted. The access procedures for investment projects shall be simplified, and the development of a new mode of "integrating assessments into one and unifying assessments" shall be explored. The formalities of the application for the construction of investment projects shall be simplified and integrated, and an administration mode of construction first and then inspection shall be explored and implemented. The joint acceptance of construction projects shall be put into practice, "one-window acceptance" and "two-time inspection and final inspection" shall be achieved, and reforms such as "combination of letters and evidence" and "tolerance for incompleteness and supplements" shall be promoted. The implementation of "one address for multiple business licenses" shall be explored. The implementation of "one production permit for one enterprise" shall be explored. The achievement of the application of the unified social credit codes in all permitting administration links shall be boosted. The standardization of administrative approval and administrative services shall be comprehensively advanced. The administration of whole-process electronic registration and electronic business licenses shall be implemented. The urban maintenance and construction tax and educational surtax levied along with VAT and consumption tax are not required for zero-tax filing. The permitting approval items with respect to international express delivery business (agency) shall be devolved to the Tianjin Post Bureau. (三)深入推进行政审批职能与流程优化。开展“证照分离”改革试点。精简投资项目准入手续,探索建立“多评合一、统一评审”新模式。简化整合投资项目报建手续,探索实行先建后验管理模式。实行建设项目联合验收,实现“一口受理”、“两验终验”,推行“函证结合”、“容缺后补”等改革。探索实行“一址多证”。探索实施生产许可“一企一证”。推动实现统一社会信用代码在各许可管理环节的“一码贯通”。全面推进行政审批和行政服务标准化。实施全程电子化登记和电子营业执照管理。随增值税、消费税附征的城市维护建设税、教育费附加免于零申报。将国际快递业务(代理)经营许可审批事项下放至天津市邮政管理局。
4. Establishing a more open and transparent market access management mode. The pre-access national treatment plus negative list administration system for foreign investment shall be further improved, market access shall be greatly relaxed, the service sector shall be further opened up, the openness and transparency of the foreign investment negative list of the FTZ shall be enhanced, and priority shall be given to establishing an interim and ex-post regulation system commensurate with the negative list administrative mode. Except special fields, the particular administration requirements for the period of business operation of foreign-funded enterprises shall be canceled. The connection with post-access administrative measures shall be promoted, a fair competition review system shall be carried out, and differentiated treatment in the aspects such as qualification attainment, bidding and protection of rights and interests shall be reviewed and canceled, so as to enable various market participants to lawfully and equally access related industries, fields and business. (四)建立更加开放透明的市场准入管理模式。进一步完善外商投资准入前国民待遇加负面清单管理制度,大幅度放宽市场准入,扩大服务业对外开放,提高自贸试验区外商投资负面清单开放度和透明度,着力构建与负面清单管理方式相适应的事中事后监管制度。除特殊领域外,取消对外商投资企业经营期限的特别管理要求。推动衔接准入后管理措施,实施公平竞争审查制度,清理和取消资质资格获取、招投标、权益保护等方面的差别化待遇,实现各类市场主体依法平等准入相关行业、领域和业务。
5. Further deepening the opening up of finance and regulatory innovation. The Guiding Opinions of the People's Bank of China on Providing Financial Support for the Construction of China (Tianjin) Pilot Free Trade Zone shall be implemented in an active and orderly manner. Qualified banking institutions shall be encouraged to continue developing offshore financial services on the premise of compliance and effective risk control. A regulatory list of reporting items of access to banking markets shall be released to harmonize and standardize the regulatory requirements for the reporting items of foreign-funded and Chinese-funded banks. Subject to compliance, foreign-funded financial institutions shall be allowed to set up foreign-funded banks in the FTZ, and private capital and foreign-funded financial institutions shall be allowed to jointly establish Chinese-foreign equity joint venture banks in the FTZ. Fund products from the FTZ satisfying conditions for mutual recognition shall be supported in participating in mutual recognition of fund products from Chinese mainland and Hong Kong. Private equity investment funds shall be supported in transacting cross-border investment and financing business. The intellectual property right securitization business shall be explored. The financial regulatory system shall be refined, and the bottom line of non-occurrence of systematic financial risks shall be held. Cross-border fund monitoring systems and mechanisms shall be bettered, the anti-money laundering, anti-terrorist financing, and anti-tax evasion work shall be tightened, cross-border money laundering and terrorist financing risks shall be discovered in a timely manner, and the use of cross-border trade to engage in the criminal activities of money laundering shall be prevented. The launch of the pilot program of comprehensive financial regulation in the Central Business District of the Binhai New Area shall be explored, and the reform of comprehensive financial regulation with a focus on small loans, private equity funds, security, and asset management, among others, and supported by cooperative regulation and coordinated regulation shall be conducted in accordance with the laws and regulations. Local governments shall strengthen the territorial responsibility for risk disposition in accordance with the unified rules of the Central Government on the premise that financial administration is mainly the power of the Central Government. (五)进一步深化金融开放和监管创新。积极有序实施《中国人民银行关于金融支持中国(天津)自由贸易试验区建设的指导意见》。鼓励符合条件的银行机构在依法合规和有效控制风险的前提下继续发展离岸金融业务。发布银行业市场准入报告类事项监管清单,统一规范中外资银行报告类事项监管要求。在依法合规条件下,允许外资金融机构在自贸试验区设立外资银行,允许民营资本与外资金融机构在自贸试验区共同设立中外合资银行。支持自贸试验区内符合互认条件的基金产品参与内地与香港基金产品互认。支持私募股权投资基金开展跨境投融资业务。探索知识产权证券化业务。健全金融监管体系,守住不发生系统性金融风险的底线。完善跨境资金监控体制机制,强化反洗钱、反恐怖融资、反逃税工作,及时发现跨境洗钱和恐怖融资风险,防范利用跨境贸易从事洗钱犯罪活动。探索在滨海新区中心商务片区开展金融综合监管试点,依法合规开展以小额贷款、私募基金、担保、资产管理等为重点,以合作监管与协调监管为支撑的金融综合监管改革。地方政府要在坚持金融管理主要是中央事权的前提下,按照中央统一规则,强化属地风险处置责任。
6. Building high-level international trade "single windows." The UN international trade "single window" standards shall be learned from, and trade data shall be coordinated, simplified and standardized. The promotion of the expansion of the fields covered by China (Tianjin) International Trade "Single Windows" to trade in technology, service outsourcing, maintenance services, and other fields of trade in services shall be explored. When the conditions are ripe, the declaration of export tax rebates (exemption) shall be gradually incorporated into the “single window” administration. Whole-process paperless work covering at all parts such as arrival and leaving of vessels, port operation, customs clearance of goods, and other port operations shall be realized to the greatest extent, and the administration of electronic certificates and proof in the trade field shall be advanced. The integration and connection with national "single window" standards and specifications shall be achieved to strengthen data connection and collaborative regulation. The inter-departmental sharing of enterprise credit rating information shall be advanced. The information exchange and service sharing between "single windows" and ports in countries and regions along the Belt and Road shall be vigorously advanced.

 (六)建成高水平的国际贸易“单一窗口”。借鉴联合国国际贸易“单一窗口”标准,实施贸易数据协同、简化和标准化。探索推动将中国(天津)国际贸易“单一窗口”覆盖领域拓展至技术贸易、服务外包、维修服务等服务贸易领域。待条件成熟后逐步将出口退(免)税申报纳入“单一窗口”管理。最大限度实现覆盖船舶抵离、港口作业、货物通关等口岸作业各环节的全程无纸化,推进贸易领域证书证明电子化管理。实现与国家层面“单一窗口”标准规范融合对接,加强数据衔接和协同监管。推进企业信用等级信息跨部门共享。推进“单一窗口”与“一带一路”沿线国家和地区口岸信息互换和服务共享。
