The Rules on the Mid-Term Review of Dumping and Dumping Margin, as adopted at the 111th executive meeting of the Ministry of Commerce on March 14, 2018, are hereby issued and shall come into force on May 4, 2018. 《倾销及倾销幅度期间复审规则》已经2018年3月14日商务部第111次部务会议审议通过,现予发布,自2018年5月4日起施行。

Rules on the Mid-Term Review of Dumping and Dumping Margin 倾销及倾销幅度期间复审规则
Article 1 For the purposes of guaranteeing the openness, fairness and impartiality of the midterm review of anti-dumping, these Rules are developed according to the provisions of the Anti-dumping Regulation of the People's Republic of China.   第一条 为保证反倾销期间复审的公平、公正、公开,根据《中华人民共和国反倾销条例》的规定,制定本规则。
Article 2 The Ministry of Commerce (hereinafter referred to as the “investigation authority”) shall, during the validity period of the anti-dumping measures and according to the changed normal value and export price after the anti-dumping measures come into force, review the necessity of implementing the anti-dumping measures according to the original form and level (hereinafter referred to as “mid-term review”) according to these Rules.   第二条 商务部(以下称调查机关)在反倾销措施有效期间内,根据反倾销措施生效后变化了的正常价值、出口价格对继续按照原来的形式和水平实施反倾销措施的必要性进行复审(以下简称期间复审),适用本规则。
Article 3 The investigation authority may conduct case-filing upon applications of the original applicants for anti-dumping investigation, natural persons, legal persons or relevant organizations of the domestic industry or representing the domestic industry (hereinafter collectively referred to as the “domestic industry”), exporters and manufacturers of the countries (regions) in dispute, and domestic importers, for mid-term review.   第三条 调查机关可以应原反倾销调查申请人、国内产业或代表国内产业的自然人、法人或有关组织(以下统称国内产业)、涉案国(地区)的出口商、生产商、国内进口商的申请立案,进行期间复审。
Where there are justified reasons, the investigation authority may conduct case-filing on its own, for mid-term review. 调查机关有正当理由的,可以自行立案,进行期间复审。
Article 4 An application for mid-term review shall be filed within 30 days of the date of expiration of every 12 months after the anti-dumping measures come into force.   第四条 期间复审申请应当自反倾销措施生效后每届满十二个月之日起三十日内提出。
An application for mid-term review of the reviewed anti-dumping measures shall be filed within 30 days of the date of expiration of every 12 months after a reviewed ruling comes into force. 对经复审的反倾销措施申请期间复审的,应当自复审后的裁决生效后每届满十二个月之日起三十日内提出。
Under special circumstances, with the permission of the investigation authority, an application for mid-term review may be filed at a time other than the time set out in the aforesaid provisions. 在特殊情况下,经调查机关允许,期间复审申请可以在上述规定以外的其他时间提出。
Article 5 An application for mid-term review shall be filed in writing, and the applicant, the legal representative or a person authorized thereby according to the law shall affix signature thereto.   第五条 期间复审申请应当以书面形式提出,并由申请人本人、法定代表人或经其依法授权的人签署。
An application for mid-term review shall be divided into confidential text (if an applicant files an application for confidentiality) and public text. One original and two copies shall be submitted for both the confidential text and the public text. In addition to the written text, an electronic data carrier shall also be submitted. 期间复审申请应当分为保密文本(如申请人提出保密申请)和公开文本。保密文本和公开文本均应提交书面正本一份,副本两份。除书面文本外,还应同时提供电子数据载体。
Article 6 To file an application for mid-term review, an exporter or manufacturer shall submit the following evidence materials:   第六条 出口商、生产商提出期间复审申请的,应当提交下列证据材料:
(1) the name, address and other relevant circumstances of the applicant; (一)申请人的名称、地址和其他有关情况;
(2) the domestic sales data of the applicant within 12 months prior to filing of the application; (二)申请前十二个月内申请人的国内销售情况的数据;
(3) the applicant's data of export to China within 12 months prior to filing of the application; (三)申请前十二个月内申请人对中国出口情况的数据;
(4) the various adjustments that must be made for calculating the dumping margin and the preliminary calculation results of the dumping margin; (四)为计算倾销幅度而必须作出的各种调整及倾销幅度的初步计算结果;
(5) the reasons for the continuity of the significant changes in the normal value, export prices and dumping margin; and (五)正常价值、出口价格及倾销幅度所发生的重大变化将会持续的原因;
(6) other contents that the applicant deems necessary to explain. (六)申请人认为需要说明的其他内容。
The materials set out in item (1) to (5) of the preceding subparagraph shall be submitted in accordance with the content and form required by the original anti-dumping investigation questionnaire. 前款第(一)至(五)项规定的材料应当按照原反倾销调查问卷所要求的内容及形式提交。
Article 7 Where the original anti-dumping measures are collecting anti-dumping duties, the export for which anti-dumping duties are not collected shall not be used as the basis for filing an application for mid-term review.   第七条 原反倾销措施为征收反倾销税的,未征收反倾销税的出口不得作为提出期间复审申请的依据。
Article 8 The investigation authority shall, within seven working days of the receipt of an application of an exporter or producer for mid-term review, notify the original applicant for anti-dumping investigation, and the original applicant for anti-dumping investigation may, within 21 days of the receipt of a notice, issue opinions on whether to conduct case-filing for review.   第八条 调查机关应当自收到出口商、生产商的期间复审申请之日起七个工作日内通知原反倾销调查申请人,原反倾销调查申请人可自收到通知之日起二十一日内对应否立案进行复审发表意见。
Article 9 To file an application for mid-term review, a domestic industry shall submit the following evidence and materials:   第九条 国内产业提出期间复审申请的,应当提交下列证据和材料:
(1) the name, address and relevant circumstances of the applicant; (一)申请人的名称、地址及有关情况;
(2) the changes in the normal value, export price and dumping margin compared with the level of the original anti-dumping measures; and (二)与原反倾销措施水平相比,正常价值、出口价格及倾销幅度的变化情况;
(3) other contents that the applicant deems necessary to explain. (三)申请人认为需要说明的其他内容。
A domestic industry filing an application for mid-term review shall comply with the provisions of Article 17 of the Anti-dumping Regulation of the People's Republic of China on representativeness of the industry. An original applicant for anti-dumping investigation filing an application for mid-term review is not required to re-prove the representativeness of the industry. 国内产业提出期间复审申请的,应当符合《中华人民共和国反倾销条例》第十七条关于产业代表性的规定。原反倾销调查申请人提出期间复审申请的,无须重新证明产业代表性。
Article 10 An application of a domestic industry for mid-term review may be filed for all exporters and producers of all or part of the countries (regions) involved in the original anti-dumping investigation, and may also specifically restrict the scope of review to some exporters and producers specified.   第十条 国内产业提出的期间复审申请可以针对原反倾销调查涉及的所有或部分国家(地区)的全部出口商、生产商,也可明确将复审范围限于指明的部分出口商、生产商。
Article 11 An investigation authority shall, within seven working days of the receipt of an application of a domestic industry for mid-term review, submit the non-confidential summary of the public text and the confidential materials of an application for review to the government of the relevant exporting country (region).
