| Chapter I General Provisions | | 第一章 总则 |
| Article 1 For the purposes of regulating the consultation of real estate registration materials, strengthening the management, protection and utilization of real estate registration materials, maintaining the safety of real estate transactions, and protecting the lawful rights and interests of the real estate right holders, these Measures are developed in accordance with the Property Law of the People's Republic of China, the Interim Regulation on Real Estate Registration and other laws and regulations. | | 第一条 为了规范不动产登记资料查询活动，加强不动产登记资料管理、保护和利用，维护不动产交易安全，保护不动产权利人的合法权益，根据《中华人民共和国物权法》《不动产登记暂行条例》等法律法规，制定本办法。 |
| Article 2 For the purposes of the Measures, the real estate registration materials include: | | 第二条 本办法所称不动产登记资料，包括： |
| (1) The real estate registry and other real estate registration results; and | | （一）不动产登记簿等不动产登记结果； |
| (2) The original real estate registration materials, including the written application for real estate registration, identity materials of applicants, origin of real estate ownership, reasons for registration, investigation results of real estate cadastre and other materials, and review materials of the real estate registration institution. | | （二）不动产登记原始资料，包括不动产登记申请书、申请人身份材料、不动产权属来源、登记原因、不动产权籍调查成果等材料以及不动产登记机构审核材料。 |
| The real estate registration materials shall be kept and managed by real estate registration institutions. | | 不动产登记资料由不动产登记机构负责保存和管理。 |
| Article 3 real estate registration institutions of people's governments at or above the county level shall be responsible for the management of the consultation of real estate registration materials. | | 第三条 县级以上人民政府不动产登记机构负责不动产登记资料查询管理工作。 |
| Article 4 Real estate right holders or interested parties may, according to the provisions of these Measures, consult or copy the real estate registration materials. | | 第四条 不动产权利人、利害关系人可以依照本办法的规定，查询、复制不动产登记资料。 |
| Real estate right holders or interested parties may retain lawyers or other agents to consult or copy the real estate registration materials. | | 不动产权利人、利害关系人可以委托律师或者其他代理人查询、复制不动产登记资料。 |
| Article 5 The consultation of real estate registration materials shall be conducted under the principles of legitimacy, facilitating people and efficiency. | | 第五条 不动产登记资料查询，遵循依法、便民、高效的原则。 |
| Article 6 The real estate registration institutions shall strengthen the informationization construction of real estate registration, and provide convenience for consulters on the basis of the basic platform of real estate registration information management by applying the Internet technology, setting up self-service consultation terminals, setting registration information consultation ports at relevant premises and other ways. | | 第六条 不动产登记机构应当加强不动产登记信息化建设，以不动产登记信息管理基础平台为基础，通过运用互联网技术、设置自助查询终端、在相关场所设置登记信息查询端口等方式，为查询人提供便利。 |
| Chapter II General Provisions | | 第二章 一般规定 |
| Article 7 The real estate registration materials shall be consulted at the real estate registration institution of the municipal or county people's government in the place where the real estate is located, unless as otherwise prescribed in laws and regulations. | | 第七条 查询不动产登记资料，应当在不动产所在地的市、县人民政府不动产登记机构进行，但法律法规另有规定的除外。 |
| Where a consulter applies to a real estate registration institution in a place other than the place where the real estate is located for consultation, the institution shall notify the consulter of going to the appropriate institution for consultation. | | 查询人到非不动产所在地的不动产登记机构申请查询的，该机构应当告知其到相应的机构查询。 |
| A real estate registration institution shall provide necessary places for consultation, and arrange special persons to be in charge of the consultation and copying of the real estate registration materials, issuance of the certificate of consultation results and other work. | | 不动产登记机构应当提供必要的查询场地，并安排专门人员负责不动产登记资料的查询、复制和出具查询结果证明等工作。 |
| Where an application for consultation of the original real estate registration materials is filed, priority shall be given to the acquisition of digitalized results. If it is indeed needed and necessary, the original paper real estate registration materials may be acquired. | | 申请查询不动产登记原始资料，应当优先调取数字化成果，确有需求和必要，可以调取纸质不动产登记原始资料。 |
| Article 8 To apply for consultation of the real estate registration materials, a real estate right holder or interested party shall submit a written application for consultation and the identification thereof. | | 第八条 不动产权利人、利害关系人申请查询不动产登记资料，应当提交查询申请书以及不动产权利人、利害关系人的身份证明材料。 |
| An application for consultation shall include the following: | | 查询申请书应当包括下列内容： |
| (1) The consultation subject. | | （一）查询主体； |
| (2) The purpose of consultation. | | （二）查询目的； |
| (3) The contents to be consulted. | | （三）查询内容； |
| (4) The requirements for the consultation results. | | （四）查询结果要求； |
| (5) The list of application materials submitted. | | （五）提交的申请材料清单。 |
| Article 9 Where a real estate right holder or interested party entrusts an agent to apply for consultation of the real estate registration materials on his or her behalf, the entrustee shall submit the originals of the identification of the both parties and the power of attorney. | | 第九条 不动产权利人、利害关系人委托代理人代为申请查询不动产登记资料的，被委托人应当提交双方身份证明原件和授权委托书。 |
| A power of attorney shall indicate the names or designations of the both parties, citizen identification numbers or unified social credit codes, entrusted matter, time limit for entrustment, legal obligations, date of entrustment and other contents, and the two parties shall affix signatures or seals thereto. | | 授权委托书中应当注明双方姓名或者名称、公民身份号码或者统一社会信用代码、委托事项、委托时限、法律义务、委托日期等内容，双方签字或者盖章。 |
| Where an agent is entrusted to consult or copy the real estate registration materials, the scope of consultation or copying shall be determined in the power of attorney. | | 代理人受委托查询、复制不动产登记资料的，其查询、复制范围由授权委托书确定。 |
| Article 10 Where the consultation conditions are met and the consulter needs to issue the certificate of the real estate registration materials consultation results or copy the real estate registration materials, the real estate registration institution shall provide it immediately. A real estate registration institution that can not do so for special reasons shall provide it for the consulter within five working days. | | 第十条 符合查询条件，查询人需要出具不动产登记资料查询结果证明或者复制不动产登记资料的，不动产登记机构应当当场提供。因特殊原因不能当场提供的，应当在5个工作日内向查询人提供。 |
| The certificate of consultation results shall indicate the date of issuance, and be affixed with the special seal of the real estate registration institution for consultation. | | 查询结果证明应当注明出具的时间，并加盖不动产登记机构查询专用章。 |
| Article 11 Under any of the following circumstances, the real estate registration institution shall reject the consultation, and issue a notice on the refusal of consultation: | | 第十一条 有下列情形之一的，不动产登记机构不予查询，并出具不予查询告知书： |
| (1) The application materials submitted by the consulter fail to comply with the provisions of the Measures. | | （一）查询人提交的申请材料不符合本办法规定的； |
| (2) The subject applying for consultation or the matters to be consulted do not comply with the provisions of the Measures. | | （二）申请查询的主体或者查询事项不符合本办法规定的； |
| (3) The purpose of applying for consultation does not comply with the laws and regulations. | | （三）申请查询的目的不符合法律法规规定的； |
| (4) Other circumstances as set out in laws and administrative regulations. | | （四）法律、行政法规规定的其他情形。 |
| A consulter that rejects to accept a notice on refusal of consultation issued by a real estate registration institution may apply for administrative reconsideration or file an administrative lawsuit according to the law. | | 查询人对不动产登记机构出具的不予查询告知书不服的，可以依法申请行政复议或者提起行政诉讼。 |
Article 12 Where the real estate registration materials applied to be consulted involve state secrets, the real estate registration institution shall be governed by the Law of the People's Republic of China on Guarding State Secrets and other relevant provisions.
