| Protection of intellectual property is a basic means to stimulate innovation, a basic guarantee for motivation for innovation, and an essential element of international competitiveness. The intellectual property adjudicative work of people's courts is relevant to the implementation of the innovation-driven development strategy, economic, social, and cultural development and prosperity, and the two big pictures at home and abroad and is significant for building a powerful intellectual property nation and a world science and technology power. For the purposes of profoundly implementing the innovation-driven development strategy and the national intellectual property strategy, intensifying creation, protection and use of intellectual property, removing system and mechanism obstructions restricting development of the intellectual property adjudication, and maximizing the role of the intellectual property adjudication in protecting innovation and promoting scientific and technological progress and social development, the following opinions are hereby offered. | | 知识产权保护是激励创新的基本手段，是创新原动力的基本保障，是国际竞争力的核心要素。人民法院知识产权审判工作，事关创新驱动发展战略实施，事关经济社会文化发展繁荣，事关国内国际两个大局，对于建设知识产权强国和世界科技强国具有重要意义。为深入贯彻实施创新驱动发展战略和国家知识产权战略，强化知识产权创造、保护、运用，破解制约知识产权审判发展的体制机制障碍，充分发挥知识产权审判激励和保护创新、促进科技进步和社会发展的职能作用，提出以下意见。 |

| The spirit of the 19th CPC National Congress shall be implemented, the Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era shall be set as guidance, "awareness of politics, big picture, the core, and compliance" shall be firmly built, according to the requirements of overall advancement of the overall layout for "economic, political, cultural, social, and ecological progress" and coordinated advancement of the Four-Pronged Comprehensive Strategy, the objective of "making efforts to allow the people to feel equity and justice in each judicial case" shall be closely centered on, people-oriented justice and impartial justice shall be adhered to, the reform in the field of intellectual property adjudication shall continue to be furthered, the dominant role of judicial protection of intellectual property shall be maximized, a concept that protecting intellectual property is protecting innovation shall be developed, the legal environment for science and technology innovation shall be optimized, and the implementation of the innovation-driven development strategy shall be prompted, so as to provide powerful judicial guarantees for achieving the Two Centenary Goals and building a powerful intellectual property nation and a scientific and technological world power. | | 全面贯彻落实党的十九大精神，以习近平新时代中国特色社会主义思想为指导，牢固树立“四个意识”，按照统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局要求，紧紧围绕“努力让人民群众在每一个司法案件中感受到公平正义”目标，坚持司法为民、公正司法，不断深化知识产权审判领域改革，充分发挥知识产权司法保护主导作用，树立保护知识产权就是保护创新的理念，优化科技创新法治环境，推动实施创新驱动发展战略，为实现“两个一百年”奋斗目标和建设知识产权强国、世界科技强国提供有力司法保障。 |

Based on national strategies, closely centering on the big picture of development of the party and the country, new changes of international conditions shall be vigorously adapted to, the top design of the problems of the nature of big picture, system and fundamentals relevant to long-term development of the intellectual property adjudication shall be tightened, and systems and mechanisms for the judicial protection of intellectual property shall be reformed and refined. | | --坚持高点定位。立足国家战略层面，紧紧围绕党和国家发展大局，积极适应国际形势新变化，加强事关知识产权审判长远发展的全局性、体制性、根本性问题的顶层设计，改革完善知识产权司法保护体制机制。 |

Closely taking into account the judicial need of the people, in consideration of the critical fields and weak links affecting and restricting the development of the intellectual property adjudication, targeted measures shall be researched, resolution of difficulties and fixing of weakness shall be focused on, and the level of judicial protection of intellectual property shall be further lifted. | | --坚持问题导向。紧扣人民群众司法需求，针对影响和制约知识产权审判发展的关键领域和薄弱环节，研究对策措施，着力破解难题、补齐短板，进一步提升知识产权司法保护水平。 |
| —Adhering to reform and innovation. Minds shall be liberated, truth shall be sought from facts, the adjudicative pattern shall be observed, innovation shall be motivated by an innovative method, innovation shall be protected in an innovative manner, and the problems and difficulties challenging the reform in the field of intellectual property adjudication shall be solved with a reform mindset, so as to allow reform and innovation to become an engine for sustained and sound development of the intellectual property adjudication. | | --坚持改革创新。解放思想，实事求是，遵循审判规律，以创新的方法激励创新，以创新的方式保护创新，以改革的思维解决知识产权审判领域改革中面临的问题和困难，使改革创新成为知识产权审判持续健康发展的动力源泉。 |

China's national conditions shall be taken into account, international rules shall be respected, successful international experience in the judicial protection of intellectual property shall be borrowed, and a new mode of the judicial protection of intellectual property with Chinese characteristics shall be vigorously developed, so as to continue boosting China's leadership in international intellectual property governance rules. | | --坚持开放发展。既立足我国国情，又尊重国际规则，借鉴国际上知识产权司法保护的成功经验，积极构建中国特色知识产权司法保护新模式，不断增强我国在知识产权国际治理规则中的引领力。 |

| With improving the litigation system for intellectual property as foundation, with intensifying establishment of the intellectual property court systems as priority, with heightening the building of intellectual property adjudication teams as guarantee, quality and efficiency of intellectual property adjudication shall be constantly improved, the judicial protection of intellectual property shall be enhanced, infringements upon intellectual property shall be effectively contained, judicial credibility and international influence in the field of intellectual property shall be furthered, and the intellectual property adjudication system and trial capability shall be prompted to become more modernized. | | 以完善知识产权诉讼制度为基础，以加强知识产权法院体系建设为重点，以加强知识产权审判队伍建设为保障，不断提高知识产权审判质量效率，加大知识产权司法保护力度，有效遏制侵犯知识产权行为，进一步提升知识产权领域司法公信力和国际影响力，加快推进知识产权审判体系和审判能力向现代化迈进。 |
| II. Improving the litigation system for intellectual property | | 二、完善知识产权诉讼制度 |
| 1. Establishing evidence rules in line with the characteristics of intellectual property cases | | （一）建立符合知识产权案件特点的诉讼证据规则 |
Based on the characteristics of intellectual property such as intangibility, timeliness, and territoriality , the evidence preservation system shall be refined, the role of expert assistants shall be used, the investigation and evidence collection by people's courts based on their authority shall be appropriately heightened, and a legal proceeding mechanism motivating parties to vigorously and voluntarily provide evidence shall be established. The role of notarization in fixing evidence in intellectual property cases shall be maximized in various manners. The building of a good faith litigaiton system in the field of intellectual property shall be strengthened, development of evidence disclosure, removal of evidence obstructions, and other rules shall be explored, burden of proof shall be reasonably apportioned, the burden of producing evidence on right holders shall be mitigated appropriately, and the problem that it is difficult for holders of intellectual property to produce evidence shall be solved vigorously.
