The administrations for industry and commerce and market supervision departments of all provinces, autonomous regions, and municipalities directly under the Central Government: 各省、自治区、直辖市工商行政管理局、市场监督管理部门:
Since the National Enterprise Credit Information Publicity System (hereinafter referred to as the "Publicity System") has been put into formal use, the industry and commerce and market regulatory authorities have, according to the unified arrangements of the State Administration for Industry and Commerce ("SAIC"), taken the lead in promoting unified collection, publicity, openness and sharing of enterprise-related information, tightened interim and ex-post regulation by depending on the Publicity System, endeavored to raise the modernization level of the capability of market regulation and governance, and made significant achievements. For the purposes of strengthening the application and administration of the Publicity System, maintaining safe, stable and efficient operation of the Publicity System, and maximizing the basic role of the Publicity System in supporting the reform of the business system and the reform of simplification of administrative procedures, delegation of powers, combination of decentralization and control, and optimization of services, you are hereby notified of the relevant issues as follows: 国家企业信用信息公示系统(以下简称公示系统)正式启用以来,各地工商、市场监管部门按照工商总局的统一部署,牵头推动涉企信息统一归集公示和开放共享,依托公示系统加强事中事后监管,努力提升市场监管治理能力现代化水平,取得明显成效。为加强公示系统应用和管理,保障公示系统安全、稳定、高效运行,充分发挥公示系统支撑商事制度改革和“放管服”改革的基础性作用,现就有关问题通知如下:
I. Fully recognizing the significance of strengthening the application and administration of the Publicity System   一、充分认识加强公示系统应用和管理的重要意义
The Publicity System is a national enterprise credit information publicity platform established with the approval of the State Council, a statutory platform for enterprises to submit and publish annual reports and material information, an inquiry platform for the public to get access to enterprise credit information, a work platform for collaborative regulation and joint punishment by the government agencies at all levels, and an operating platform for the industry and commerce and market regulatory authorities to conduct interim and ex-post regulation. 公示系统是国务院批准建设的国家级企业信用信息公示平台,是企业报送并公示年报和即时信息的法定平台,是社会公众使用企业信用信息的查询平台,是各级政府部门实施协同监管和联合惩戒的工作平台,是各级工商、市场监管部门开展事中事后监管的操作平台。
Strengthening the application and administration of the Publicity System is a practical measure to accelerate the building of the social credit system and effective support to establish and improve a mechanism of big data-aided scientific decision making and social governance, helpful to improve the credit restraint mechanism, regulate enterprise operations, make interim and ex-post regulation more scientific, accurate and timely, and solve difficult problems such as insufficient law enforcement resources at low level, a lack of precision in regulatory law enforcement, and the absence of enterprises' awareness of honesty and self-regulation, and is of great significance for innovating the market regulation mechanism and creating a good business environment. 加强公示系统应用和管理,是加快社会信用体系建设的务实举措,是建立健全大数据辅助科学决策和社会治理机制的有效支撑,有利于健全信用约束机制,规范企业经营行为,增强事中事后监管的科学性、准确性和时效性,有助于破解基层执法资源不足、监管执法精准性不够、企业诚信自律意识缺失等难点问题,对创新市场监管机制、营造良好营商环境具有重大意义。
The industry and commerce and market regulatory authorities in all regions shall fully recognize the importance and urgency of strengthening the application and administration of the Publicity System, use strengthening the application and administration of the Publicity System as an important foothold to innovate on the regulatory mechanism, further the reform of the business system, and create a good business environment, take various measures for solid advancement, and provide more powerful support for tightening interim and ex-post regulation. 各地工商、市场监管部门要充分认识加强公示系统应用和管理的重要性与紧迫性,将加强公示系统应用和管理作为创新监管机制、深化商事制度改革、营造良好营商环境的重要抓手,多措并举,扎实推进,为加强事中事后监管提供更加有力支撑。
II. Accurately grasp the priority tasks for strengthening the application and administration of the Publicity System   二、准确把握加强公示系统应用和管理的重点任务
The comprehensive application and scientific administration of the Publicity System shall be solidly advanced according to the overall requirements of "gathering at one website and sharing among three parties." "Gathering at one website" means that unified gathering and publicity of enterprise-related information from government agencies and enterprises' annual reports and material information are achieved by depending on the Integrated Enterprise Credit Information Network Platform. "Sharing among three parties" means that services are provided for enterprises to voluntarily accept social supervision, accumulatively improve their creditability, and obtain more credit dividends, for government agencies at all levels to share enterprise-related information, achieve interactions in the work, and raise governance level, and for the public to search for and assess enterprise information and credit standings, reduce institutional transaction costs, and avoid trading risks. 要按照“一网归集、三方使用”的总体要求,扎实推进公示系统的全面应用、科学管理。“一网归集”是指依托企业信用信息一体化网络平台,实现政府部门涉企信息、企业年报和即时公示信息的统一归集、公示。“三方使用”是指服务于企业主动接受社会监督、积累自身信用、收获更多信用红利,服务于各级政府部门共享涉企信息、实现工作联动、提升治理水平,服务于社会公众查询判断企业信息和信用状况、降低制度性交易成本、避免交易风险。
1. Promptly and comprehensively gathering enterprise-related information and promoting formation of precision credit personae of enterprises. The working mechanism for gathering enterprise-related information from government agencies shall be improved, the leading role of the industry and commerce and market regulatory authorities shall be maximized, and, according to the principle of "who generates information provides such information and is responsible therefor," enterprise-related information shall be gathered in an all-around manner and through various channels, so as to raise the general ratio of government agencies from which information is gathered and promote the achievement of "gathering whatever should be gathered" and "publishing whatever should be published." "Who makes registration makes entries" and that "who handles cases makes entries" shall be adhered to, registration and recordation, movable mortgage registration, equity pledge registration, intellectual property pledge registration, trademark registration, administrative penalty, random inspection and inspection results, joint punishment, summary registration, abnormal business directory, seriously illegal and dishonest enterprise list ("blacklist"), and other information arising out of legal performance of duties shall be gathered instantaneously, based on division of duties, information concerning objection shall be processed in a timely manner, and circulation of the data on moving in or out of enterprises, circulation and endorsement of cross-regional enterprise-related credit information, exchange of the data on objection to published information, issuance of objection to summary registration to lower levels, and other systems of the SAIC Integrated Data Platform shall be effectively linked together and used. Enterprises' annual reports and relevant information shall continue to be effectively published, more attention shall be paid to the quality of annual reports on the basis of consolidation of annual report filing ratios, the information of the publicity of enterprises' annual reports and material information shall be tightened, and the primary responsibility of enterprises shall be enhanced, so as to accelerate the formation of dimensional personae of enterprises through credit information.

 1.及时全面归集涉企信息,推动形成企业信用精准画像。完善政府部门涉企信息归集工作机制,充分发挥工商、市场监管部门的牵头作用,按照“谁产生、谁提供、谁负责”的原则,全方位、多渠道归集涉企信息,提高涉企信息归集的政府部门总体覆盖率,推动实现“应归尽归”和“应公示、尽公示”。坚持“谁登记、谁录入”“谁办案、谁录入”,实时归集依法履职产生的注册登记备案、动产抵押登记、股权出质登记、知识产权出质登记、商标注册、行政处罚、抽查检查结果、联合惩戒、简易注销、经营异常名录和严重违法失信企业名单(“黑名单”)等信息,并根据职责分工,及时处理异议信息,做好与工商总局一体化数据平台企业迁入迁出数据流转、跨地域涉企信用信息流转与记名、公示信息异议数据交换、简易注销异议下发等系统的对接使用。继续做好企业年报和相关信息公示工作,在巩固年报率基础上更加注重年报质量,加强对企业年报信息和即时信息公示的检查,强化企业主体责任,加快形成企业信用信息多维全景画像。
